    • This is the first item that I've ever claimed for - I don't really send too many parcels, probably 5 in the last 5 years, and only two with P2G / EVRi. I've attached two emails from P2G regarding their requiring the documents. They don't specify in the emails what documents I should be sending, although when opening the claim they were requesting that I needed photographic proof of sending - picture of the parcel with their label attached, in the EVRi ParcelShop. The second email is their closing the enquiry due to my failure to produce said document(s). I haven't yet drafted my claim letter, I wanted to be sure of this document situation first before I began action. But therein lies another problem. Not having a P2G account, I cannot be sure of the item value that I declared. The retail value at the time was £600, which is less than the £650 I paid several months earlier, so I would likely have used that, but I cannot be sure. And without having an account I can't be certain of the value I used - I may have declared more, but I doubt it. But, I know that I did properly declare the item and a value that reflected its then retail price. but now that the retail price has reduced substantially, even though the nature of compensation is to return the claimant back to their original position, without my purchase receipt, I was concerned that I may have to claim for less. And yes, I've been through the huge document store of information that you have, MoneySavingExpert, Which, Citizens Advice, Gov.uk "make a court claim", my own law books (annoyingly I specialised in consumer law when I studied for my law degree, but I graduated 17 years ago), and so now feel that its time to either act, or drop it.     • Cheers @FTMDave  Yeah hopefully cases like this should discourage them from this nonsense as it’s surely adding to their overheads.     MCOL says defence received so will prep by reading through those links

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, We read with interest your comments regarding Welcome Finance. My daughter has been sucked into a loan which my wife and I didn't know about. She borrowed £3,000, there are lots of issues we are not happy about, we can help her settle her debts, but we would rather take on the fight. yes they told me earlier they had them but only those high up in dg can access them. but they will only release with nu's permission. :( so in case I need them can you offer any laws or statutes I can quote

i have checked with land registry there is no new charge on the property,only the old one

 

The question you need to ask is why did welcome not discharge the security when the first loan was cleared? and resubmit the charge? but more importantly they need to give the amount of the charge and details and any forms signed by you to allow the security, this is a requirement to support the charge...so therefore it effectively should have your loan number and dates on it. Get the charge certificate and see whats what, I'm waiting on mine, costs £16.00 but could be worth it if this doesn't stand up. Also it's easier to challenge charges in England, Scottish law is a bit more complicated...

 

I am not a legally minded person, just suggesting you get all the consumer info you are entitled too then take it to your lawyer. Follow this through as with secured loans this is where Welcome feel they hold the cards.

As Gloucs...says before you take any loan out with PPI, it should be put in writing before you take the loan out....send a SAR off in the first instance Mojo...

 

 

sent the SAR last week but now concerned about gloucs comments about them being put straight in the bin

Andie, that case that PT quoted, Wilson/Hurstanger (i think!) the chapters on secret comissions etc....you are entitled to know if your broker (agent or whatever they are calling themselves thesedays) received/agreed a comission or fee or rebate if you are paying for it, or interest on it.

 

You are also entitled to check that the correct Insurance Premium Tax has been paid on your behalf ;).

 

As you are currently in litigation with them, their figures do not add (statement of price) and they have been less than forthcoming...you have had no choice but to ask for these figures....you have also involved HMRC and they have asked you to fw your figures.

 

Put the onus on Welcome/DG forcing you to involve NU directly. I ahev to go now but will try and read that case PT said a bit more carefully later.

 

Question though....if DG have been talking to NU all this time, why do they still need to get permission from them, and why can NU STILL not contact you directly? HHHmmmm?
