    • Hi  I've received letters acknowledging that overdales have received my caa request and CPR request. No info. I'm going to post you my defence for to look at tonight or tomorrow morning. H
    • Morning,  I have recieved a reply from my request for information. They have replied with the credit agreements for my 118 loan and two Captial One cards.  They have said thay as Vodafone is a telecommunications account it is not regulated so the original creditor is not obliged to provide a copy of the agreement.  What are my next steps?  Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Welcome are I think trying to transfer as many accounts as possible to a new lender - so i guess we'd judt pay them instead - hope Welcome doesn't go down the pan before my day in court

 

 

Anyone know who the other lender is? Maybe they will use an incentive to get people to switch.

I need to change my avatar..But cant find a good replacement.

Well I've just this minute received another phone call from Welcome, even though I have it in writing from the manager that I won't receive anymore. This time it was actually a person, rather than the automated voice - I just hung up.

Seriously these guys are a joke - Sol can't get rid of them contacting him, I don't owe any money they owe me and I can't hear hide nor hair of them funny that??????????

bountyhunter - when did you ask for a cca and did you send your letter recorded - if you did and have proof of receipt I think they have 28 days to provide this - if they haven't done it by then it's tough luck on their part.

 

 

I am currently in the middle of a court case with Welcome over the mis-selling of PPI - they have filed a defence with the court and the judge asked me to respond to each defence point they have raised. My question is then how much information do I have to give them? I do not want to give Welcome all my information so they have time to this of a bulls**t story for the judge?

Also I requested a SAR from Welcome back in Septmber 08 and they have still not complied with this request despite me also sending a reminder - can I put this in my answer as surely they can't do that.

Lastly I have also aquired some information regarding these insurances since filing my claim that I believe will work in my favour - do I have to declare this information before going to court or can I just present it to the judge as long as I have the proof to back it up?

They advised me adding PPI to the loan together with acceptance feee was breach of Consumer Credit Act 1974.

 

We not just getting are PPI back but issuing proceedings against then to scrap the loan.

 

I will let you know how I get on.....

Would love some more info on this I'm due in court with Welcome in March for PPI but I think my acceptance fee and insurance has all been lumped together - anything you've got I'd love to hear if you want to share.

he he they can get as nasty as they want....they aint getting a penny more out of me until i see some paperwork and if im not happy with the over -inflated settlement figure they are certain to give me ill tell them to go whistle......Lets hope we are witnessing the beginning of the end of Welcome Finance

No i wish id charged them for the four letters ive sent them so far asking for Credit Agreements, Statements etc.....I will do with the Subject Access Request in March.....i cant wait for the phone call asking "payment for march"....."Erm send me some paperwork and when i recieve it ill pay you"...until then dont phone me again cos i wont answer !!!

Perhaps that's getting them some extra cash by giving aother lender new customers? I don't know if I like the sound of a company lending like that though, especially as every other company is tightening their belts.

 

I don't think they'll disappear as quickly as April, so you should be alright.

Why don't you charge them £10 for each letter you send? They do the same.

 

If I have to send anymore letters, I'll be doing just that.

I guess they push the business sideways, get a percentage !!....i think with this loan repayment of £500million due in July and reading into the Telegraph report/link they dont have any real assets so my wild theory is that i can see Welcome going for administration ?(is that right) around May/June
