    • Hi everyone, I have an update on my case that I’d like to share with you all.  so after submitting 371 pages in my bundle, a witness statement and skeleton argument for my court case due to take place in Manchester on June 21st I got an email from my litigator stating that hmrc have pulled out and the case is now closed!    this is the body of the letter….. This letter, which is copied to the Appellant, pursuant to Rule 17 of the Tribunal Procedure (First-tier Tribunal) (Tax Chamber) Rules 2009, the Respondents gives notice to the Tribunal of their intention to not defend the above appeal.   The Respondents respectfully invite the Tribunal to allow the appeal and close its file. In lieu of the above the Respondents would respectfully ask the Tribunal to vacate the hearing scheduled for Friday 21 June 2024. We would accordingly invite the Tribunal to close its file. Obviously this is extremely good news which hasn’t sunk in that after 3 years of fighting it is over.    I do have a further fight on my hands in that the Group Action I had joined with Independent Tax that had been disbanded in November last year and I chose not to continue with them. They are trying to bill me over 5k for the work they did under that Group Action which is ludicrous bearing in mind the whole point in joining was that it would keep the cost to a minimum as it would be shared between us all. They had asked if I wanted to continue to have them represent me on an individual level which I declined, if I hadn’t, goodness knows what they would have been trying to charge me now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello Liz, you poor thing.

welcome to the site.

Don't feel isolated any more, we are here to help, and I am glad you have had a good read around.

Open up a thread of your own under the bank you are with.

You really need to talk to CCCS or the citizens advice (should be a branch ner you) and get your current problems sorted out.

And start the ball rolling on claiming back those charges!

You can also stop those intimidating phone calls, as they amount to harrasment.

Yeah sorry I did read it wrong, and yes they did come through in "Batches". Had 18 envelopes through the door on the Monday and a further 4 on the Tuesday. It should be enough for me to get my teeth into now Im back home after a week down south!

 

Tonights job is to go and tot up 6 years of charges. Will keep you guys informed. I did see something about claiming 8% APR on these charges and soemthing about a calculator to work these out. Can someone point me in the right direction?

I've gone though the statements HSBC has sent already (about 40 envelopes so far). Quite a few of the statements seem to be duplicates of others they sent. Looking though what they have sent, I still haven't got statements for a complete year yet, how long does it typically take to receive all the statements? The postman is starting to moan! ;)

I got mine over two days. They do say duplicate on them all though as they have re-issued them now after originally issuing them all those years ago. - Are you sure they defo are duplicates of each other? (Not suggesting your thick of course- maybe an oversight if they arent all duplicates)

I know that you mean by the word "Duplicate" printed on the top of the statements. Perhaps I worded it badly, the dates of the transactions and transaction details on the statements match ones in other envelopes.

 

I am getting slightly concerned with the time it is taking to receive the statements. I sent the original Data Protection Act Declaration letter on the 26th of last month. In the letter it says they have 40 days to comply. Is this saying they have 40 days to start sending the statements or send the lot?

 

Any comments would be welcome.

I've just had another call from the HSBC telling me I'm OD this time only to the tune of 230.00, asking if I have any means to pay off the outstanding balance or when money will be deposited in the account. This appears to have started since the data protection declaration letter was sent. Is something going on or am I just getting abit paranoid?

Don't forget, if it isn't the full amount, with any interest charges, don't accept it! Also don't accept any confidentiality conditions - It's your money, they have taken it unlawfully, why should you keep quiet about it?!

 

Have they mentioned anything about wanting to close your account? I heard on Radio 4's Money box programme the other day the Alliance and Leicester seemed to adopting an attitude of "We'll pay you off but we don't want you're business". As a safety net I've just setup an account on-line with Nat West, just in case. :D

I am guessing they are are having to look into it further as you declined their first offer. Hold out until you get what you deserve!

 

I sent a letter off today recorded delivery telling them to stop phoning me immediately. Also informing them I am finding the multiple daily calls from HSBC harassment, mentioning "Protection from Harassment Act 1970", "Article 8 of the Human Right Act 1990" and the "Wireless Telegraphy Act 1949" etc. Hope it works

When they were calling me, i wrote a letter to them saying that I would rather comunicate by letters due to my work require all my concentration and the outside disturbance may cause harm to my patients ( im a nurse). After that calls stoped.

Had a letter today from HSBC saying they are bouncing a DD for 236.39 also they will be charging me 30.00 for the privilege. I can see another claim coming on after this one is complete!

Dont claim again, if they give you no response or partial offer then just add the recent or due charges onto your online moneyclaim.

Thanks Sarah.. Im keeping the all paperwork that comes though and will add it to my moneyclaim file against them. Another interesting thing, I looked on my online banking to find they have cancelled my gym membership DD without telling me in writing, can they do that??
