  2. Well I got a lenghty letter back, skipping the blurb and getting down to the nitty gritty, out of the £2463.43 I am claiming they are offering £1970.00. This I will naturally be declaining. Just goto formulate a letter now and inform the FOS.
  3. Just had "Debt Collection Services" phone my mobile out of the blue. After sucessfully speaking to someone after the 3rd attempt I soon found it was HFC. The DD for my home owner loan bounced. I was told they will be representing the DD in 7 days time. The fact I wasn't aware of this prior to the call fell on deaf ears. Goto some how get 250.00 scraped together! Although there was some light at the end of the tunnel. I have been waiting for a settlement figure from them to allow me to remorgage, they assured it will be sent out today! Feeling abit annoyed I thought I'd look on the net for advise. I came across the FOS (Financial Ombudsman Service) http://www.financial-ombudsman.org.uk Clicked on the contact us link at the top of the page and dialed. I couldn't have spoken to a friendlier and more helpful person. Apparently HFC can apply charges for late payment even though I wasn't aware of it in writing. Also I brushed on the subject of Bank Charges. With no further adoo he took my personal and banking details, any documents sent and when, thentold me they will be contacting HSBC about the matter. Also I will be receiving info from the FOS. I was assured this is a Free service but all in all I am abit unsure if I have done the right thing. Has any taken this avenue?
  4. Thanks Sarah.. Im keeping the all paperwork that comes though and will add it to my moneyclaim file against them. Another interesting thing, I looked on my online banking to find they have cancelled my gym membership DD without telling me in writing, can they do that?? Regards

Am registering with money claim as we speak in preparation for the expected non payment by HSBC by the 16th - Sent the Letter before action on the 2nd Had a letter today from HSBC saying they are bouncing a DD for 236.39 also they will be charging me 30.00 for the privilege. I can see another claim coming on after this one is complete! Angela, thats a whopping amount - all the best HSBCrusher - Thanks for the advise. I can now see what you mean by empowered

  7. Ive sent my letter before action off today with my 6 years bank statements today, any advise? Ive not made any legal arrangements yet. Any help would be appreciated at this time.

  9. I am guessing they are are having to look into it further as you declined their first offer. Hold out until you get what you deserve! I sent a letter off today recorded delivery telling them to stop phoning me immediately. Also informing them I am finding the multiple daily calls from HSBC harassment, mentioning "Protection from Harassment Act 1970", "Article 8 of the Human Right Act 1990" and the "Wireless Telegraphy Act 1949" etc. Hope it works
  10. Don't forget, if it isn't the full amount, with any interest charges, don't accept it! Also don't accept any confidentiality conditions - It's your money, they have taken it unlawfully, why should you keep quiet about it?! Have they mentioned anything about wanting to close your account? I heard on Radio 4's Money box programme the other day the Alliance and Leicester seemed to adopting an attitude of "We'll pay you off but we don't want you're business". As a safety net I've just setup an account on-line with Nat West, just in case.
  11. Totted up the figures last night, came out with £2463.43 (including the interest they charged me). Sending off the Preliminary approach today

I've just had another call from the HSBC telling me I'm OD this time only to the tune of 230.00, asking if I have any means to pay off the outstanding balance or when money will be deposited in the account. This appears to have started since the data protection declaration letter was sent. Is something going on or am I just getting abit paranoid? Regards
  13. Hi there Sarah I know that you mean by the word "Duplicate" printed on the top of the statements. Perhaps I worded it badly, the dates of the transactions and transaction details on the statements match ones in other envelopes. I am getting slightly concerned with the time it is taking to receive the statements. I sent the original Data Protection Act Declaration letter on the 26th of last month. In the letter it says they have 40 days to comply. Is this saying they have 40 days to start sending the statements or send the lot? Any comments would be welcome. Regards Andy
  14. Thanks Homer. I've gone though the statements HSBC has sent already (about 40 envelopes so far). Quite a few of the statements seem to be duplicates of others they sent. Looking though what they have sent, I still haven't got statements for a complete year yet, how long does it typically take to receive all the statements? The postman is starting to moan! Regards

  16. Hi Maverik. Yeah sorry I did read it wrong, and yes they did come through in "Batches". Had 18 envelopes through the door on the Monday and a further 4 on the Tuesday. It should be enough for me to get my teeth into now Im back home after a week down south! Tonights job is to go and tot up 6 years of charges. Will keep you guys informed. I did see something about claiming 8% APR on these charges and soemthing about a calculator to work these out. Can someone point me in the right direction? Regards.
  17. I've finally got a letter back from HSBC, with my £10 cheque attached "Thank you for your letter dated 26 June 2006 with regards to information about transactions and charges on your account. We will forward to you copies of the statements covering the period in question. These will begin to arrive in seperate branches and will be with you shortly. We are happy to waive any fees for the productions of this information and we return your payment. Although many of our systems are automated, a "manual intervention" by HSBC staff may be required in a variety of situation including; account opening, dealing with correspondence or telephone calls, when deposits or withdrawals are made over the counter at our brances and from time to time during account administration. If you require more information, please let us know. Yours sincerely Ian Shepherd Centre Manager" I'm waiting with bated breath for the statements. A couple of things are now wrattling round my head. First, am I right in thinking this is a "standard letter"? They don't seem to know where this is heading as the letter goes on about general admin of the account. Secondly, what do they mean by statements arriving in seperate branches? Do they expect me to run round the country picking them up? You're comments will be welcome Regards Andy

  20. Hi there. I'm new to this also but theres a very helpfull crowd on here. First I filled in and sent this letter: http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/6990-filing-your-data-protection.html I included the cheque for £10 in the envelope and handed it in to my local HSBC branch asking them to forward it the branch my account is with. You should recieve 6 years of bank statements within 40 days. Hope this helps.
  21. Well I have dropped my addressed envelope, enclosing a letter and £10 cheque off at the Acombe (York) branch asking them to forward it to the Wincanton branch. I asked for a reciept to confirm they have received it but Cynthia who was the only one behind the counter said they don't issue receipts so I have come away empty handed. I was told they will forward it to head office who will direct it to the branch address written on the front of the envelope. How long should I typically have to wait for before I get a responce, if I get one? Many thanks Andy I'm off outside for a cigarette, I feel like I need one!
  22. Monday is the big day when I start the case against HSBC. I am printing off the letter for my 6 years bank statements as we speak. I will keep you guys posted as to what the responce is. As I said before any feedback would be appreciated. Andy
