  1. Hi there I do not want to interrupt but I have done it 5 month ago from start to finish. My claim was only £580 and got my money back after the prelim. I might be wrong but I calculated those 14 days as working days only. From my experience banks always say to you - only working days. I am back because since my last claim I was charged again. My financial situation is not good and I keep going over my overdraft. So, to be on the safe side I will count only working days. Good luck with your claim.
  2. Hi everybody I am back. I got my money last time and now I guess will have a second round. My financial situation is pretty bad. I have 5 full credit cards and two loans I can not repay right now. It all is taken care off with a ligal advice, but meanwhile darling HSBC charges me £25 and £50 each time I go over my overdraft. I believe that for the past 6 months I paid them more than for the past 6 years. I am going to wait for my next statement just to get the precise date of the next charge and then will start the ball rolling. I got through the whole thing very quick and easy last time claiming my money back, so I guess they are not going to be that kind this time. To be frank I do not care any more because I have another account somewhere else, all my DD transfered and I will take it all the way this time. Wish me luck.
  3. I sent my letters by recorded delivery and never got confirmation form Royal Mail website either, but they got it on time because I had the reply 13 working days later. Just stick to your time scedule and do not worry, ok?!
  4. Hi again I did, but only because I do not have money to cover my mortage payment this month. They credited my account within two days. But this account I have had only for two years so I am going to dig out my old statements for previous four years. ( I have changed my account number with in HSBC two years ago) and go to the end. You will get it , do not doubt. I.
  5. Hi Riamad I think my info might be useful for you. I sent my prelim to local branch by recorded delivery. Never got anywhere by checking it online with royal mail. It always said that they do not have info about my item. 13 (working) days later I received the letter from senior quality service team officer with the offer % of my claim. Also informing them I am finding the multiple daily calls from HSBC harassment, mentioning "Protection from Harassment Act 1970", "Article 8 of the Human Right Act 1990" and the "Wireless Telegraphy Act 1949" etc. Hope it works When they were calling me, i wrote a letter to them saying that I would rather comunicate by letters due to my work require all my concentration and the outside disturbance may cause harm to my patients ( im a nurse). After that calls stoped.
  7. Hi Thanks for reply No they did not say anything about account to be closed. I have sent them Notice pursuant to s.10 of The Data Protection Act 1998. because my account is in a very bad state. I am overdrawn up to my eyes and have no money at all comming in. So, I was worried that they might black list me with credit agency. I got letter this morning from the data controller saying that they can not comply with the notice because they need to process my information, even more, because I requested refund of bank charges they need to process the info they hold on me. Regarding account closure, if worse come to worse I have an acount elsewhere. Regards I.
  8. Good Luck I received the reply with the offer slightly less then I asked this morning. I only sent the prelim letter by recorded delivery whichwas never delivered (by post office system on line) 14 working days ago. So, tomorrow would be the first dead line and the date for LBA to go out but they responded. WOW. It works so stick to it.

Thank you for your letter dated 29 June 2006 requesting a refund of your bank charges of £580.00 going back to January 2004. In circumstances where you have authorised a payment that would, if met by us, lead to your account going overdrawn or over an agreed overdraft limit, we have to consider whether to make this payment. A fee is payable for this service provided by the bank, details of which are clearly set out in our published price list. The circumstances in which the fee will apply are clearly set out in our Personal Banking terms and cons which you were provided with a copy of when you opened your account. If your claim for a refund proceeded to Court, we therefore believe we would successfully resist any legal challenge in relation to these fees. HSBC is, however, mindful of the management time and irrecoverable legal costs that it may incur in relation to such a claim. For those commercial reasons alone, and without any admission of liability whatsoever, HSBC is prepared to make a payment to you in the sum of £520.00 representing the charges applied in full and final settlement of this matter. Now I have to reply to him within 7 days and sign the section in the letter saying the full and final settlement. All right big boys, I would like a little help. Hi there, welcome in If you know all your charges file them up with spread sheet from the library if you don’t know the amount the bank has taken from you over the past 6 years (under the Limitation Act 1980, you can only claim for the last 6 years), then send the Data Protection Act request letter in the library (there is sometimes a £10 fee for this - it may be best to send it anyway to stop any delaying tactics from the banks - if they don't use it then great - if they do, then fair enough - at least you'll be getting the rest of your money back). Under the Data Protection Act - the Data Controller has only 40 days to provide this information. Don't worry about the extra wait - you can claim 8% APR on each charge for the full period, so the longer it takes them the more money you will have back. If they still refuse, or do not furnish you with this information within 40 days, report them to the information commissioner - www.informationcommissioner.gov.uk - for a breach of the Data Protection Act.   12. A little update… On 20th of July will be 14 days since I have sent my prelim. I got nothing back. To be honest I was a bit sceptical about all of this but now I am getting more positive that it is actually all true. Sorry… I am very difficult to convince sometime. I sent the letter because right now have nothing to loose. So, nothing at all. I am getting my LBA ready to send by Recorded Delivery on 20th. Now definitely excited.
  13. Hi there sorry for the late reply. Thank you for your info. I checked it today on line, again, no changes. As I said I will wait for the 14 days dead line ans send my LBA. This money I am trying to claim are not huge but I am in a very difficult situation right now and it looks like all my creditors are getting ready for the massive attack on me. So any support appreciated, thnks again.
  14. Hi everybody Just a little update. I send my prelim letters on 30/06/2006 by recorded delivery 1 class. Tried to follow it on the net – the information on my items is not available. Post office, by the way, charges £2.00 for enquiries over the phone, but even though could not get through. :-? I think I will stick to time scale anyway. Despite on their actions will sent LBA on 20 of July.

  21. I have sent a letter to my local branch with request for repayment of charges, but reading through other people stauff noticed that they mention name Phil Beaumont, who is senior service quality officer. Do I need to send one to him as well or it will not make to much difference? Please help!
  22. I have the net access thank you very much but I have kept my statements over past two years. Two years ago I changed the account due to divorse so have no access to my old one on line. I will claim these two years money back and if it goes ok then will request my old statements as well. Thanks a lot again
