Can I ask you a quick question Lickthewallfatboy?

 

Is the way you work out the interest different because we are in NI. I had a look at the library and it makes a lot of reference to England and Scotland being different?

 

How did you work out your interest? And did you lodge your claim in person in Belfast?

no-I used the spreadsheet and it worked it out automatically at 8%.

 

I used the small claims online site for NI-it's dead handy(if you need any help PM me and I'll be glad to help.)Then I posted off 2 copies of the spreadsheet to the office in Chichester Street.As Crap one are across the water,the court office will "query your claim"-no panic!!-

 

They will send you out a letter to sign confirming that you are not taking the same action in the English courts.When they get that back,the claim is activated and papers will then take a few days to be served.Then just sit back and wait for Capital One to settle!!

 

Easy!!

I received a letter from our friends at cap 1 about 'IMPORTANT INFORMATION ABOUT DEFAULT CHARGES.

 

They have reduced their charges to that magic £12 accross the board! No explanation why - obviously they dont want to alert those poor victims who havent started action against them yet.

 

Lick the Wall Fatboy - how long did it take cap 1 to respond to you after you sent the small claims court stuff in? I completed online on 20 July and they received my confirmation to proceed outside NI jurisdicton on 27 July. Also, did they close your account - not that you would be bothered anyhow

I lodged the claim on July 5,and we withdrew it on 4 August after confirming that the account was cleared and we had the cheque-so you're looking at a full month there...

 

there was a statement in the letter of settlement to the effect that if we wnated to stay with them we had to accept charges in future-we just wrote in captial letter bedside it-WE DO NOT ACCEPT,PLEASE CLOSE THIS ACCOUNT IMMEDIATELY

 

We are looking to get down to a maximum of 2 cards with zero balance to be used in an emergency or on holiday,so no big deal.It only had a limit of £200 anyway.....

just had a call from crapital one wasnt prepared to give my date of birth over the phone, so the bloke asked me to phone them back before 7pm to discuss my account - he could have given me any old number to call back on do they really expect people to call them back!!

Quick question. I've popped over from the Halifax forum because when I successfully win this one (and I will!), I'll be starting claims against a host of other banks and credit cards, including a few for capital one. With banks, it's fairly clear that the money gets refunded back into your bank account.

With credit cards, does it get credited to the credit card? because some of these accounts are closed, so I wonder if the refund amount puts you in credit, how you get that credit balance back?

If the account is closed, you will be sent a cheque.

 

Or, for an open account where they owe you more than the account balance, thet will pay off the balance and send the remainder by cheque.
