      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

Charges that have been made on my LLoyds TSB account relate to returned cheques/direct debits, and have been for £35 each. I'm not sure if these charges are refundable. I'll explain what's happened anyway.

 

I requested details of all charges applied to my account over the last 6 years with the following wording "I request that Lloyds TSB provides me with details of all default charges for unauthorised overdrafts and unpaid direct debits/standing orders/cheques I have paid in the last six years."

 

They responded dead on the 40 day deadline for this with a list of charges totalling £2890. They charged me £10 for this.

 

I then wrote back, requesting a refund on these charges.

 

2 weeks later I have received a letter which states "Like any business, we do make a charge for some of our extra services. When customers don't have enough in their accounts to cover a payment, this always means extra work - and it has to happen very quickly." Then "We feel it's fair to charge for this service."

 

It also states "The Office of Fair Trading has published new guidelines on credit card default charges. We're still talking it through with them, but the important point is that the guidelines are about "default" charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. These are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations."

 

They then state that they cannot agree to cancel the charges, and that if we cannot come to an agreement they will provide me with details of the Financial Ombudsman Service so they can consider my complaint independently.

 

I'm very confused :/ Is this right? Should I pursue this further?

Firstly ignore the letter from Lloyds-it is a bog standard 'please go away and dont bother us again'.

 

What you should do is send them the LBA(Letter before Action),give them 14 calendar days to reply and if the issue is not resolved in that time take them to court.

Hi.

I just received £750 from Lloyds in full and final of a £895 claim so go for it. Just dont claime for: Interest, Cheque clearing charges - the legit stuff. Only claim for the charges for falling over your limit - cheques returned etc. If you are here, you can get your charges online too - get online with them and play them at their own game. I recommend you go to Money Saving Expert: Consumer Revenge - Credit Cards, Shopping, Bank Charges, Cheap Flights and more and download all the letters. Then stick strictly to the rules Matyn Lewis has suggested.

I'M EVEN MORE CONFUSED NOW!!!

 

I've eventually got my head around the letter before action, and was to send it today but have come across a problem. I've just noticed on the print outs that Lloyds TSB have sent me that the majority of the statement entries they have listed are for an account that is not mine. It clearly states the account number at the top of each sheet, but I automatically assumed that when I requested a list of charges they would surely only send mine, and therefore my charges aren't as high as I thought. (They should compensate me for making me think that they were!)

 

So where do I go from here? Should I start the procedure again with letter 1 with the correct amount of charges? Proceed as if I hadn't noticed the different account numbers? Or make a huge issue out of the fact that somebody elses bank charges have been sent to me?

I was going to send out the letter before action today, having received a response from TSB stating that their charges are lawful, but have come across a problem.

 

I've noticed on the print outs that Lloyds TSB have sent me that the majority of the statement entries they have listed are for an account that is not mine. It clearly states the account number at the top of each sheet, but I automatically assumed that when I requested a list of charges they would surely only send mine, and therefore my charges aren't as high as I thought. (They should compensate me for making me think that they were!) Therefore I have sent a letter asking for a refund on £2800 ish and it looks like only £1100 ish are actually my charges!

 

So where do I go from here? Should I start the procedure again with letter 1 with the correct amount of charges? Proceed as if I hadn't noticed the different account numbers? Or make a huge issue out of the fact that somebody elses bank charges have been sent to me?

 

I hope they haven't been sending mine to anybody else!

My brother once received a letter informing him of his charges and in the same envelope were letters for about 8 other people informing them of theirs, except they went to him!

 

So I'm ok to send a preliminary request for payment using the correct amount or should I send a LBA with the amended amount on it?

I sent a request for a list of charges which I received (along with somebody elses!!) and paid £10, and then a letter asking for the charges to be repaid to me.

 

Received a letter back from them in response to my second letter telling me that the charges applied were for dealing with my request to go over my agreed overdraft limit, they are not default charges because I haven't broken my agreement, they are prices for the service they provide.

pauline - Hi,

 

LTSB are inundated with requests and are making mistakes all over the place. I think you should not rush, make sure you have all your copy statements, it can take a while, yes you can weld the big stick with court action and so on; I did however find two useful places to contact LTSB to make things happen for me. 1st was the Andover unit and second was believe it or not my local branch that had all the microfiche records. When I did get them they all came in fragmented form i.e. missing months, and then I got them in triplicate (which was great as it saved me loads on photocopying them)

Hi Pauline. There is one sure,safe and free way of working out your charges. If you have access to your Lloyds account online there is an option on the main page when logged on that gives you the chance to view charges only from 2002. Go to that section, select the first 3 month period and print it off. Do this for each 3 month period to the present day and get your calculator out.Tick on the printout those charges you wish to claim back, add them up and you have your legit figure. I wouldnt try to claim for charges falsley listed as it would be fraud and then we are no better than the people we are claiming from.

 

With regard to others comments about MSE, we should not forget that the founder, Martin Lewis, has championed this issue and without him, many millions of pounds would not have been reclaimed. I am not saying that this site has not, just saying that MSE has a valid place in this issue. It is generally agreed that MSE is an easier site to navigate than this one tho.

I too would wish to add my support to MSE. Without Martin Lewis I wouldn't have found this site. Only came here at the later stages when I had a question about dispensing with AQs. Having said that, once you have found your way around, this site offers far more.
