    • Thank you BankFodder. I will do as you suggest to get everything in writing first and will construct the letter of claim over the weekend. Is it best to use the format for the letter of claim as the one on this website? Lastly, did I read the judgement correctly for the Farooq judgement as its not quite clear to me which act I am covered best by?
    • A letter of claim can't be served by email as per CPR 6.3 unless you've specifically told them. Also can't give you 7 days to pay, they've got to give at least 14 days. They know this, they're just hoping you wet yourself and cough up. This won't be going anywhere. IGNORE.
    • Good Morning, I received a speeding ticket last December, I had requested further information from the ticket office which they provided, I also sent back the form confirming i was the diver at the time, however, i had overlooked the signature at the bottom of the page, nobody from the ticket office got back in touch to mention this and i was trying to book a course with no luck, I got in touch with them and sent them a screenshot showing them I was unable to book the course, they came came back to me and said we have no documents to say you were the driver (they did they just failed to mention I never signed it) they re sent the form and it was over the 120 days, i had mentioned to them previously that the timeframe was coming up and they would need to extend this. They are now saying they have complied legally and i need to accept the 3 points, I am trying to plead my case and I am tempted to let this go to court and provide the evidence of my constant communication on the matter. has anyone got any experience with this? TIA.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This one is personal. they have made my life a misery for the last few years. the charges i got by myself, their help when required was generally abismal. at the worst point i asked if i could arrange a payment plan with less interest as i was struggling to survive. The reply came that "its a credit card, you spend it you pay it. Why should we reduce your interest or payments?". So i struggled on for a few months then just gave up and stopped paying it. Got a call a few weeks later asking about payments, explained that it was either eat or pay the card so figured they could wait. Expected to get one hell of a response to this but oddly enough, a very supportive lady took me through the process of a payment plan which SHE suggested (one nice person in there so added to balance post).

 

DPA letter is in post today, sounds like they are as cooperative about this as most things so BRING IT ON B*TCH*S.

No response from them after 18 days. Called them today and was told i sent it to barclays address not barclaycard!! clever me. They have recieved the request on the 13th and sent a letter on 16th saying sorry no cheque please send. Told the guy on the phone that there was a cheque and it must be at barclays. Has said he will process the request anyway and chase up the cheque.

 

He also said that as they are dpa requests they do not fall under the banking code as such. They do not need to reply in 5 days if this is the case. He said they are still trying to reply in 10 days but its a bit busy at the moment (bless).

Also mentioned some consumer groups on the net have dodgy info on them, however he seemed very aware that these sites are why they are swamped by people getting even.

 

It seems even though some info is not perfect (joys of open forums with all free to help), even the incorrect info still gets sent to the right addresses in the end.

Today i got my printout back to 2004. Not at all impressed as i know the main chunk of charges predate this.

I am wondering if its worth sending another letter demanding them. The threads i have read all seem to show a standard response to this and no additional statements. I was wondering if anyone has had luck with the rest of their statements.

As the amount of charges is so much i am thinking i may just pay the £3 per statement (not something i can afford but if i have to, i will find the money.)

 

Any info on pre 2004 statements would be great. This lot are really p*ssing me off now. Have full printout from opening of accounts from barclays current and natwest student accounts.

Have decided to put this one off for a bit. I'm going to wait for a payout and buy the statements will then add the cost to the total claim. could be interesting to see if they just waive the fee when they realise i'm willing to do this, but will add to their bill and then report them to the information commisioner for being obstructive. (well fingers crossed anyway.

have just found out i sent mt SAR to the wrong address and barclaycard dont have it. great. i used the radbroke hall address which apparently wont work. the barclaycard person on the phone gave me a po box number to send it too but am going to use Data Protection Team

I would write to them and state that the date of the SAR still stands as you sent it to Barclays, and they should have forwarded it to Barclaycard Dept LRC, I would address your letter to Adrian Whalley hes the head of Data Protection at Barclaycard. I had a SAR with Barclaycard and sent to the adress you have listed, however I also sent one to Barclays re my current account and they sent me some data relating to Barclaycard, so I Pete Townsend can send stuff on behalf of AW then I'm sure they could have forwarded the SAR letter to Barclaycard. They are just rying it on IMHO.

recieved a letter today saying they are sorry but my statements wont be arriving in time. they blame sheer numbers for this.

well wouldnt it have been better to send them the first time i asked????

guess i hve to look to see how to report them, even though they say they have contacted the information commisioner to explain the delay. they spend years denying us our statements then they cant cope when they are forced to release them.

do they care about the problems they have caused us by their actions? well no obviously, but they expect us to bear with them during the problems they are experiencing (hmmm i think NOT).

just a thought, i need to use data protection to access my personal info form a previuos employer. anyone have any ideas how i would need to change the subject access request? im going to give it a go myself but any ideas (or even better, links would be much appreciated).

Just take out the stuff about charges and add all the info about your employment ie dates to and from, place of work, job role then I would just ask for all personal data they hold including all letters, interview notes, employment details and any other personal data they hold on you. If there is anything specific you need then list it.

back on subject though. phoned BarclayC the other day about the letter. they said all the ussual stuff, but i want interested. told the lady that called that i wasnt interested in the delays they had caused and would complain to Information C if they werent in my hand i 3 days. she kept trying to justify their position but this was not of interest to me, and i told her so. long and short, if you call them and threaten them with the IC they will get your statements out. she tried to spin me the line about them informing the IC they were having problems, but i dont think this cuts much ice with the IC as a complaint is a complaint to them.

 

am now going through the statements and its not as much as i thought. have also noticed lots of goodwill credits, do i need to take these of the total as they are bound to be the charges. thing is they would need to prove what the refund was for to use this against me. any advice would be cool.
