hi all, right i really need help at the moment as my bank has not completed their AQ form. Their form had to be in on friday the 11th may, however it was not submitted. I phoned the court and asked what happens now, the reply i got was the judge will issue a judgement and they have to submit the AQ form in within 28 days???????, To be honest i think this is very very unfair as i was ill at the time of my AQ being submitted and i asked if i could take it in on monday the 14th of may, only to be told if i have not submitted it or by the 11th may i would end up looseing the case. So i am upset to find out the bank are being given an extra month it really stinks. I might as well give up now.

ok lol when i posted this my mail has since arrived, i have a letter from the court to the effect of upon the courts own motion......

IT IS ORDERED THAT the defendant having failed to file the AQ questionaire as directed, unless the defendant files the AQ by 4pm on 23rd may the defence and any part 20 counterclaim will be struck out and judgement entered for the claiment.

Does this mean that if no AQ in by 23rd then i win?

Also is it worth calling barclays to see if they wish to settle or just leave things as they are.

Urgent help now needed.

Hi, fairly new to this group myself, but it looks like Barclays have extra time to file their AQ and if not then yes, judgement will go against them.

Barlcays were late delivering their defence on mine and when I rang the court I was told that the defendant takes precidence!!.. Good luck!

There is a chance they may has missed your file.

If you contact them now, it will give them time to get the AQ in. which means draggin it ourt more

 

I know its frustrating to wait but i'd wait til 24th and then see if theyve entered, if not judgement will be entered. on the 24th contact them saying

 

" nah na nah na nah nah, youve missed the dead line nah na nah na nah nah, oh by the way dyu wanna settle now judgement has been issued against you? eh eh eh"

ok guys i have just got a letter from the courts stating .......

the hearing is allocated to the small claims track.

The bit i am really confused over is this (Take notice that the directions hearing will take place on 18th july blah blah blah). Right the prob is that prior to the letter the court said there was no directions at all?????

then i got the letter so i really am not sure what i have to do now. PLEASE HELP ANYONE.

Down the bottom of the letter it states 15 minutes has been allowed for the directions hearing.

So do i have to get court bundle ready or no, as mentioned earlier when i asked the court this she said you only have to turn up and you dont need anything with you.

Very confused now.

This is not your final hearing.

 

However,

 

I would advise you to contact the Litigation Team at Barclays, tell them you have a court date, but DO NOT tell them it is only a directions hearing.

They will assume they have missed your details in the huge baglog they have and begin negotiations to settle.

thanks for that, what actually threw me was the court phoned before i had the letter and stated that my date was main court date and no other date was to follow, basically she said it is your main date and you will not have to go to court again. So i was totally confused when i got the letter.

ok update, i have not been able to get through to krysta it keeps going to customer relations, when i eventually got through cus relations said we offer you 1,000 and that still stands, i am claiming 4424.03, and i cannot speak to litigation i have to speak to cus relations. Then he went on to say we dont have a court date as and when we get the date they will see me in court a really nice guy NOT!!!!.

I think i will give up now he has really upset me and i was so nice it really is not worth it.

Please don't give up. Send an email - that way you don't have to talk to them. Krysta's email address is

If you just send her an email asking her to let you know the name of the person dealing with your claim she will come back to you and let you know who it is and they will then ask for your schedule of charges. That way you don't have to go through customer services just straight through to the litigation team. I bet you will have a settlment by the end of the week as they seem to be settling quite quickly if they know you have a date now.

Or you could stop running after them, and let them do the running instead, or have you forgotten that YOU are suing THEM, and not the other way round?

 

Stop thinking and behaving like a victim. YOU are taking them to court. If they don't want to have to explain their charging system to a judge, THEY will have to contact you to settle before court. If you had kept that in mind, you wouldn't have allowed that guy to talk to you and upset you the way he did.

 

You have the upper hand, why give it back to them in such a manner? :-?

I spoke to that Paul man yesterday - he was a bit of a waste of space I have to say. However I spoke to Charlotte who is dealing with my case and she was very helpful and nice and told me she will settle. Don't give up now, this is your money you are fighting for and a fair amount it is to......
