  2. Hi, I have been looking at this site for the last couple of weeks. I took my Store Card out a long time ago (1997) with GE Money (now Santander Cards) and when I looked I have been paying PPI but was unaware there was misselling problems with these, just thought it was loans so was very interested as I was not told anything about the policy and am in fact covered through work i.e. full pay for 6 months if sick followed by 75% until return and am entitled to redundancy etc. I also have private critical illness cover. Anyway would I be able to claim for this seeing as how it is so long ago?Anyway I thought I would ask for a copy of my agreement and sure enough when it has arrived there is a squiggle near the box for PPI but is not a tick but more like a crossing out or just a mark on the form. It was such a long time ago (1997) that I can't remember whether it was pre-ticked and I have tried to rub it out. Also, it states that it is an application for brides to be which is obviously false since I had not even met my husband then and did not get married until 2002! Will I have a case since it is so long ago and I have some arrears on this account from last year as my work implemented shorter hours about 14 months ago and I missed 3 months payments but have been negotiating with Santander to clear these on a monthly basis and have not missed any other payments. I am not sure how to post a copy of the account I have received as the attachment button does not seem to be working.Thank you so much for any help/advice.
  3. Thanks Woody - it feels really good! Anyway my monies have now cleared (paid into the wrong account though!) and please could someone tell me how I change the title of my thread to won and also how I make a donation. The other thing I need to do is send a letter to the court explaining that the matter is settled - is there a template for this. I had a quick look round but couldn't find one. The other thing I wanted to ask was whether I should include in the letter the fact that I said to the Judge in my letter to get the stay lifted that as soon as I had a date, I was sure Barclays would then settle straight away - which of course is exactly what happened. It may help others if I make the point that Barclays are just wasting the courts time as they have no intention of going to court. Maybe the Judge might strike barclays out!! you never know!
  4. Hi Paul You enclose a schedule of charges with your LBA although this would not include the interest at this stage. Interest gets added at the court stage at the statutory rate of 8% which would then be added to your schedule of charges when you file your claim.
  5. Hi all. I was dealing with Kate Ashton by email who was a bit slow in replying to say the least. However when she did reply she was alway very polite. I also got the "letter will be sent out by the end of the week" email and waited until the Friday of that week and then emailed Kate asking for confirmation that this had been sent as I was now having to request a day off work to attend the hearing which I would be claiming back for. Now here is the crucial bit, after advice from the wonderful Dar£n, I cc'd Dino in on this and surprise surprise I heard straight back from Dino who said that Kate was away on the Friday but would deal with it on Monday. He must have chased her because I received a letter of settlement attached to an email on Monday morning with an apology that the original must have got lost in the post! So in future I would suggest copying emails to Dino if you get no luck with your contact after the first couple of tries.
  6. Hi all My case was stayed until 27 June at the beginning of May with Judge Dudley. I think it is a disgrace that for 9 weeks the Judge has just refused to look at any of these claims - it is just playing into the bank's hands. Anyway I took matters into my own hands and wrote a letter asking for the stay to be lifted and for a hearing to be set and this was done within a week and Barclays agreed to settle in full on Monday. The monies should be cleared in my account today!!   9. I HAVE WON:D Kate has just emailed me enclosing my settlement letter offering to settle in full. Anyway I have crossed out the bit about confidentiality and said I will let the court know when I have received settlement and now am just waiting for the monies to be received into my account. Whoopeeeeeeeee! Thank you so much to all those who have been such a great help to me - especially you Dar£n - maybe you ought to start charging for your services!!!! anyway am now off to carry on dancing round my office and to let my hubby know etc!
  10. Hi If I were you, to avoid any confusion I would send a letter today by recorded delivery saying "thank you for the payment you have made to my Barclaycard in part-settlement of this claim. I will of course be pursuing the additional amounts owed through the courts as per my LBA dated [DATE]". You obviously have not signed anything to say that this was in full and final settlement so Barclaycard cannot just pay this and consider it dealt with, however a letter stating this will make the position clear. If she hasn’t sent you a settlement letter already, I’ll ensure she has one sent out on Monday. I wouldn’t book a day’s leave from work as I’m sure we can have this resolved next week.   15. I do hope so Dar£n I really do. I have never had such an excruciating time just waiting around for other people. I have got to be the most impatient person ever. Thank you so much for all your helpful advice - I don't know what I would have done without all your help. Talking about waiting I have still had no response to my email to Kate 4.5 hours ago (surprise, surprise!). You would've thought she would deal with me quickly just to get me off her back - I shoudl imagine I have been a right pain in the backside the last 2.5 weeks.
  16. I have just had a really awful thought. A week ago I sent off a letter to the Judge asking him to remove the Stay on my claim. I received a letter today stating that this had been removed and a hearing had been set up for 27 June 2007. I didn't send Barclays a copy of this letter - should I have done this and I am also assuming that the court will send a copy of the order to Barclays re lifting of the stay and the court date.
  17. Hi John10 Don't worry everything you have done so far is correct. Once your LBA time period runs out the next step is to file a claim with MCOL. If you click the link below it will guide you through how to do this. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/34887-5-money-claim-line.html Let me know if you are doing it through your local court because there is a guide to filling in the hard copy forms as well. You will then need to send an updated schedule of charges to the court with your claim number attached and another copy to the bank. The Court does not need to see any of your other correspondence with the bank yet. You keep copies of this for your court bundle which comes later. It would be a good idea to have a look through what is involved here though so you are prepared. Hope this helps. Keep us posted. Karenann
  18. Hi Trucker I live in Essex and my case was forwarded to Basildon Combined County Court within a week of receiving Barclays Defence. They then transferred it to Southend at the beginning of April. I was then given a Stay by the Judge at Southend to last until 27 June. I have just successfully applied to have this lifted and have a hearing on 27 June at 10.00am so Southend seem to deal with things quite quickly and don't have a long waiting time by the looks of things. It more depends how quickly you hear as the typists tend to get a few weeks behind! Great thread by the way. Karenann

Could you please confirm when this letter will be sent as I need to book a day's annual leave from my work to attend the hearing on Wednesday 27 June (which I will then need to add to my claim for any settlement figure).   21. Thanks as ever Dar£n. I am certainly walking around the office with a big goofy grin. I can't believe the Judge paid attention to my letter and then set a date for this soon. I think I will inform Kate and ask when I can expect to receive my letter as I will need to send bundle and book the day off work. See what response I get.
  22. :o HOORAY!!! :o Cannot believe it. My letter worked. The Judge has lifted the stay and set up an allocation/directions hearing in its place for 10.00 am on 27 June. I am absolutely over the moon. The courts listing office told me that she didn't think he would look at the letter this week and I already have a response. Should I email Kate and inform her of developments or just carry on waiting. She said a letter would be with me by the end of the week but nothing has arrived as yet. I feel like I am getting slighty closer now.
  23. Hello all. Well I have just contacted the Court who have confirmed receipt of my letter and that it has been sent up to the Judge. They have no guarantee as to when he will see it because he only deals with correspondence between hearings. They would only say that there is quite a backlog and that it would be dealt with in the next three weeks. Well that's great - the stay is up on 27 June so absolutely no quicker by writing a letter. I did explain that this had been stayed for 9 weeks and was there no way of getting it looked at sooner and she told me that official forms i.e defences always take priority over correspondence - so will have to rely on receiving a letter from Barclays at the end of the week! Have done all that I can now.
  24. Thanks all for responses. Just waiting for a letter now - hopefully won't have to be sending reminders for this next week!!!! I sent a letter to the Judge on Friday - is it worth ringing the court to check he has seen it or whether to leave it a few more days. I don't want to just wait for Barclays and remain inactive.
  25. OH MY GOD!!! Spoke too soon. Have finally had a response - Apparently a letter will be sent out by the end of the week!!! Now do I get excited or is it just another fob off to get rid of me for a week. I have now got so many butterflies in my tummy it's untrue - I want to start cheering and smiling and screaming but don't want to work myself up to be let down. Oh god - I'm too excited to care I will just enjoy this for a day.
