    • The finance company has a 50% stake (legal Owner) in the deal so I would certainly involve them. As for the outstanding £3635 bill thats owing to Mercedes in Croydon I wouldn't be in a rush to settle that just yet and keep it in abeyance as leverage.  Where are you at with Doves in Horsham ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just wondering if any of you saw that programme "the worst week of my life" where everything that could go wrong does go wrong?

Well that was me this week.:(

 

Computer problems, Mrs F in hospital, central heating packed in, flat tyre on the jalopy, daughter just told me she has a boyfriend:eek: and many more disasters.

 

So now you know I will expect lot's and lot's of sympathy.

Oh and when I turned the tv on to settle down to watch the rugby I got a bunch of overpaid big girls running round crying at the slightest nudge and kissing each other when they hit the net with a ball!:confused::mad:

Aww thanks guy's and gals. :D

 

Mrs F is on the mend now and I have the gas fire on full. I have found a place to replace the tyre for £35 and the daughter says she doesn't think it will last (1st day:rolleyes: ) and the rugby is on again next weekend.

So all in all the future is bright!:)

Glad to hear Mrs F is on the mend - that has to be the main concern - the rest is just the usual dross that blights all our lives from time to time :D

Sorry to hear about your woes FL and hope Mrs FL is feeling a lot better soon:) .

 

I pleaded with my daughter to go into care from being 14 - 18 but got nowhere. Bu**er would not go and spent a lot of time sat on bottom of stairs saying she could not come into lounge due to my smoking - I had no problem with that one. Things got better from 18 tho so not long:D

 

I'm off to Madrid next weekend for a party with 18 others and have just booked a cruise yesterday for May around the Med - guess who is going to be putting a lot of time in work :rolleyes: Also small lottery win so off to Antigua again in November. Things are looking up:D

she came to immingham (just across the humber bridge from hull) in early march for a birthday party and no one has heard from her since then.....

 

i'm sure she's fine - we didn't make contact as planned....c'est la vie!

 

 

she's such a party animal (weddings, funerals, etc!!)

she is probably still recuperating!

FL am sorry that you and Mrs F have not been to good, hey £35 for a tyre is cheap mine are 3 times that.............lol

 

I have had a couple of friends here , one for almost a month, the other for a week........as well as running up and down to scotland collecting said friend and dog and taking them back...........lol.........

 

am in the process of another wedding cake so all offers of help will be accepted.........

 

am sorry for being quite........lol

how is the case going does anyone know? all seems very quite and Freaky do you know if there are poc for credit cards? have bene looking but cna I find anything!!! that willteach me for going awol...........lol
