    • My mind is a blur so i cant recall exactly what the judge said at the end, but he mentioned that he would be making an order for Evri to make payment to me. I wasn't sure if the court order will also be provided to me, either by post or email - if anyone can shed some light please?
    • Agree with everyone here it's bang to rights. Looks like you just slightly jinked left in order to go right. Ultimately, your time saving attempt is going to cost you as I don't think you have any grounds to appeal. I'd just pay the charge and chalk it up to experience.
    • Thank you everyone!  thought to share some points from my experience in court today that may help others who are taking Evri to court: The judge sets out how the hearing will go and how each party should behave; while i was certainly feeling anxious/nervous ahead of the hearing (and I'm sure @jk2054 may have also observed this), the judge really does try to put any non-legal persons at ease; refrain from talking to the other party and instead speak to the judge if you have any questions/responses; the judge and the advocate spoke about tort of negligence - i wasn't sure how this applied to my case but the judge was questionning the advocate about this so i chose to stay out of this; the judge made reference to a historical case of Donaghue v Stevenson which established a duty of care; the judge observed that some of the points in Evri's witness statement by george wood needed cross examination but george was not present today for questionning; While i was claiming 8% interest, the judge pointed out that is the upper limit and that today, savings accounts give 4-5%. I therefore opted for 5% interest which was agreed to by the judge and the advocate; above all else, ensure you know your court bundle and have any notes to help you refer to specific sections - it helped me to structure my answers to the judge/defendant's queries, and point to specific evidence where i was asked to prove e.g., the value of the item. @honeybee13 - yes, will confirm when payment is received. I have emailed the Evri.claims email with my bank details and also provided them after the hearing to the advocate. @BankFodder message received and i am replying to it

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

I'm a newbie! Posted 2 weeks ago my first letter to the Halifax requesting statements/charges over the last 6 years,no news yet (40 days up 12th June) Will update with further news on this excellent site. I roughly estimate i have been charged around £3000 on my current account over that period of time,:mad: but will add it all up when i recieve the statements.One strange thing i must add, is that strangely yesterday i did recieve a letter from the dreaded Halifax demanding that my £600 overdraft be paid back to them in two weeks! I can't do that because of all these charges they have made me have an overdraft! Do you think they are trying to scare me? trying to grab every penny out of me before they have to pay me back the charges? Has anybody else had experience of this type of thing from the Halifax? i will be pleased to hear from anyone about it or any other advice re next steps to take with the whole process.

Had experience with 2 other banks I am claiming from, but they just wanted me to review my account with them. No mention of my claim though.

 

Stick to your timetable and read up on what you need to do. Remember, this could go to court, so be prepared!

Many thanks corsicanpine for your advice. I must admit i'm a little nervous, especially after i heard that a court claim was lost in the last day or so. Does anyone know anymore details? like what bank etc?

Hi there,

 

If you check the letter the Halifax sent you originally giving you the overdraft you'll find it probably has an expiry date on the overdraft at which point they will review it.l

 

They did the same thing to me a year ago, sent me a letter advising my overdraft had expired and I had to pay back £650 in a matter of weeks. Consequently added up a few of there charges along the way...

 

All I can suggest is you contact them and agree a payment plan to pay the overdraft back say a set amount each week, thats what I did... this normally stops them ringing you ten times a day....

The case which went against the claimant was against Lloyds. there is a thread on here somewhere that explains the judgement in detail.

 

It can be seen from this that anyone thinking of taking on their bank, should not do so lightly. They must understand that the case could go before a court and that you need to understand what you are actually claiming for and under which laws or statutes.

 

The best advice is to read, read, and read again. Knowledge is power.

 

In the meantime, dont worry about that and stick to your timetable and make sure you follow the advice found on this site.

By the way, I started my claim against the halifax in February and received full payment last wednesday, 18 days into my court claim.

Have another 2 at acknowledement stage at court which have 14 days to go.

Will phone them asap and see if i can sort out some kind of payment plan. Letter came from Trinity Road, same one i requested statements from which felt strange as there are quite a few addresses for the Halifax.

It might seem daunting just now but the advice you were given to read ,read,read is well worth taking on board. I think we are all a little nervous now since the LLoyds case but we must not give up. Stick to your guns youll be ok .

Hi all,

Sent first letter 3rd May,Phoned Halifax today (homebanking) and asked whether they had recieved my letter requesting statements/charges. My cheque hasn't been cashed yet. The lady told me they had nothing on the system about it,but she said that it would be AT LEAST 40 days because they are swamped their end.Also she said it would not be the 6 years statements they would sending, just a list of the last 6 years charges. Is that right? also did i do the right thing by phoning the home banking number or is there another one thats better? the 40 days are up on June 12th so if i haven't heard anything by then, whats the next step?

the next step would be to send a Prelim letter off to them if you have recieved your statements if you havent then you send a DPA non-compliance letter. The best and only way to really find out what to do step by step is to read the FAQs on here. There is help all along the line for anyone who asks but please read up on all you can.

hi Everyone,

Just To Keep You Up To Date.... The 40 Days For Halifax To Send Me My 6 Years Worth Of Statements Was Up Today, I Have Heard Nothing! So I Phoned The Homebanking Service This Morning And Was Told That They Couldn't Tell Me Anything More Than The Cheque I Sent Them To Cover The Costs Of The Statements Had Not Been Cashed Yet, But That As A Good Will Gesture They Will Order Another Set Of Statements,going Back The 6 Years And Will Not Charge Me For Them,but The Catch Is I Will Have To Wait A Few More Weeks Before They Arrive!! What Should I Do? Report Them Because They Have Broken The 40 Day Rule Or Wait??? Any Advice Greatfully Recieved.:?

i will send them a non compliance letter .I believe i can get a copy of that from the template library, is that right? What happens for example if i still do not get all my statements through? do i report them to someone? also looking to the future, i tried the other day to download spreadsheets from vampiress, my p.c wasn't having any of it and it would not download! is there any others that are easier or different options that have been tried and tested? my computer is very old and full up!
