    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real.     • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I have read on many threads about letters to get fees back from Halifax (and other a/c). Can anyone please provide me with a template letter - (I have tried to find on on the forum or on the "resources" section of website).

 

I hope to appeal against my 2 current accounts and credit cards, unfortunately the fines could number a couple of hundred for each a/c (got into trouble whilst at uni).

 

Your advise and help is really appreciated.

I sent a DPA earlier this month.

 

Hadnt got fined by Halifax for a while (mainly in student daysand imediate aftermath) as I have been trying to be good with my finances.

 

This month however I got fined £39 for a cheque to my barclaycard bouncing! Im going to write a letter to my local branch and hope to get a refund that way- and if that doesnt solicit correct reply I will no doubt have to add it on to any reply I get from the DPA.

 

This £39 fine has really fired me up, and when I go though with the claims process will make me less likely to bow out early!:mad:

Friday 12th I got a letter from Halifax Card Services, Pitreavie Busn. Park Dunfermeline. I repeat in full (typed not scanned):

 

"10th May

Dear Mr Denny,

Our Reference : *******

 

Thank you for your recent enquiry about the late payment chareges on your account and I am sorry you have found cause for complaint.

 

We have received the details of the OFT findings and are studying those findsings closely, assesing the impact this has on all of our customers.

 

There is no change to our current fee refund policy and we do not expect to make any announcements before the 31st May.

 

Although this may not be the response for which you had hoped, I trust my response clairifies our position. please refer to the Complaints Leaflet previously sent, which details your choices and confirms our affiliaton to the Financial Ombudsman Service. If I do not hear from you within eight weeks I will cloce my file

What shall I do? I anticipate responding and saying they still have 40 days - she has totally ignored my appeal for the statements under the DPA.

 

The first letter that I sent was the standard template from the files, though i did not include a cheque for ten punds - editing it to say they could debit that from my A/c. With my reply I will put in the cheque.

 

Should I reply to the same Lady, or should I address it to "whom it may concern" - if it goes to one person potentially could they worm out of the 40day time frame by arguing that the person wasnt around

Today I called Gemma M, the lady from the letter - she blurted out, "we will get the statement sent to you and also a settlement offer" - this was the first time I had called them.

 

however Halifax internal systems of call centres/offices must be muddled as she was under the impression I was requesting for credit card fees - I told her this was not the case.

 

I have taken the oportunity to put the gist of above in a written request to her as I want a papertrail - I will be sending this tommorow.

I havn't been provided with any-statements yet but Halifax have offered me £330!

 

I called the person up and said I want the statements before considering any offer. They returned the £10 dpa cheque that I sent.

 

I am not sure whether to repond in letter as well, so that I have a papertrail. Does anyone havea suitable template Please?

Today I was offered by them £330 which is a full refund for every charge. I have accepted and am now carrying on to pursue claim against the Hfax current a/c (made sure the acceptence form stipulated it only related to the credit card). I let them off the interest as its not much, and I think the offer is fair enough.

 

I had a minimum of fuss in getting this. There was some initial provarication where they ignored the request for statements and sent some customer services gumpff through - but I got what I wanted from 2 telephone calls and a further 3 telephone calls.
