    • its SJPN you simply fill the form in pleading not guilty. you will then be sent a later court date by letter to appear at your local magistrates court or the DVLA will might even drop the whole case. if you want ,fill in the small section of the form too, simply stating that payment for said road tax was cancelled and latterly reclaimed as a new DD was already in place. hence i double paid for said disputed period of the claim. just to be 1000% sure. please scan to PDF the page that states what you have been summoned for.  read upload carefully 
    • HI DX Yes check it every month , after I reinstated the second DD I was checking every week. Also checked my bank statements and each payment has cleared. When responding to the court claim does it need to be in specific terms ? Or laid out in a certain format? Or is it just a case of putting down in writing how I have explained it on CAG?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Around 5 - 6 years ago I had an account with Midland (HSBC) and left them due to the amount on charges I kept getting. Only being 17 - 18 wasn't really in control on my finances, not much better now actually but I was wondering if I could claim the money back, even though I no longer have an account with them.

 

I did send them a letter recorded delivery over 2 months ago but haven't heard anything back.

 

Any comments, much appreciated.

yes you can still claim

but there are limitations on 6yrs .

it might be wortth your while to read a few of the threads regarding pre- 6 yrs.

one further thought. i've seen one claim where hsbc just caved in and refunded all charges made on an account where the claimant was under 18 at the time of the charges.

you do need to know the account number - do you have that?

if so, did you actually send an sar (subject access request) asking for the statements from that account. as it's older than 6 years - they may say they don't have the info - so, as dx100uk says - it may pay you to read - especially this thread:Calling all HSBC claimants!! Why restrict your claim to 6 Years?!! and be sure to let them know that you were under 18 during some of this time as i'm pretty sure that goes in your favour big time.

Hi and thanks for the great advise,

 

I will have a right good read through this thread over the weekend as most of my charges date back over 6 years and I get the feeling thats why they are in no rush to reply.

 

I have a signed receipt via the Royal Mail website proving my letters have been received, is there someway I can chase this up?

 

And yes I still have my account number or sort code.

 

Finally, if say I was to apply for charges made on a credit card account, would I just send the same letter applying back for bank charges and modify it, or is there an alternatively letter to send.

pretty much the same deal -

here's one tip:Credit cards are only slightly different in their terminology - you aren't claiming for charges for overdraft fees but for credit limits.

i just found these by going on the search (on the blue line near the top which starts with user cp on the left - -- about half way across is a search - i put in hsbc credit card and got that, i first put in credit card and got loads. so, just read up - you'll get there.

After about a 2 month wait, I finally have my statements back from the HSBC, however they only date back to Feb 2001 - Aril 2003 whin I closed my account. What do I do about the charges I occurred before this date?

 

I had an account with them from 97 and starting getting charges around 99.

 

The statements they have sent me show charges amounting to £159. Can I claim the interest on this amount to date or only upto 2003 when my account was closed. Or can I not even claim intesrest full stop.

Hi and thanks for the advise once again,

 

HSBC have offered me £26 which is all I am entitled to as all other charges date back over 6 years.

 

Should I accept this or ask for the amount shown on the statement £159.

The choice is yours, but bear in mind that if you decide to go for the full £159.00, and go down the court route, your claim will probably get stayed (put on hold until the outcome of the test case in January). Also, if you do go down the court route, you will then be entitled to claim the statutory 8% interest aswell.

 

The choice is yours. Ask yourself whether you are happy to accept their £26 or not. :)

Personally, unless you are in extreme finacial dificulties and you need the £26, I would definately go down the court route. It would be more a matter of principal than anything else with the ammount of money involved!
