    • the scrappage scheme is nothing to do with the agreement ...sorry. it's an enticement to purchase a replacement vehicle. just the same as shop signs that say 50% off or whatever.  its a done and dusted deal done before you enter into the agreement for the remaining £sum. 
    • don't get too hung up on the real meaning of 'fake' in terms of the documents a claimant might produce relating to a potential court claim. by fake we typically mean, they are not obviously the 'real McCoy' ,100% associated with whatever credit they are trying to pin on punters. they are often of the right 'version' that an OC would have used for that particular take out date, but with details inserted in a diff font where they should be for say your name address DOB etc. All DCA's typically  have filing cabinets covering each year for most creditor, whip 'em out, scan and copy n paste your details onto them, even easier now with online sign ups. no hard copies ever sent cause 90% of mugs have lost them..... one of our most powerful tools is the fact any docs they produce, unless they state they are 'a reconstruction'  MUST come from the original creditor noty some hidden pile the claimants have. Link are absolute masters at this so dont stick to lowell threads. dx    
    • Driving home last night I contacted wing mirrors with a car coming the opposite way. The wing mirror folded in and the glass popped out. Very minor damage.  I stopped at the next layby (A road) to repair the mirror. A passerby stopped and said they saw the other car stopped behind me in another layby - they went back and passed over details so we could get in touch.  The conversation started cordially, but quickly got heated when I said I was well on my side and they drifted over (which is what happened).  I wasn't going to bother filing a claim as there isn't enough damage to justify it. So I've said to the other party lets just call it quits as there are no witnesses and we both think we are innocent.   they said they are contacting the police and insurance and that they have witnesses. But a quick facebook search found a post by the other person saying they were in a crash, and were 'spun' off the road. Picture of a broken wing mirror and a slight scuff on the front and rear wheel arch. they are asking for witnesses. I have screenshots of the post, and sent them another message saying I can see you dont have witnesses as you are appealing for them. I'd really not drag this out. Lets call it quits and move on. this was followed by a couple of messages that didn't really make much sense. e.g. 'do the right thing'. What should I do now?  Contact police?  Contact my insurance? - Can I tell them about this incident but say I dont want to claim? Will that affect my premium?  
    • This is the crux of the argument. The scrappage contribution should have also been counted as a deposit. It was literally a part exchange in return for a cash deduction so there is no reason it wouldn't be treated the same way.  I did not request a VT, I was struggling to pay after a separation from my partner at the time. However had the figures been reflected correctly, the VT cost would have been 2k not 9k and I may have considered it as an option. Instead, the car was marked stolen and removed from my possession by the police
    • LOL - old one the fiver theory - although with the poops its take a fiver now, promise 10p  sometime in the future while claiming the reverse theory   So when is jenrick, an apparent slam dunk as referenced higher in the thread, being referred to the police? These poops need to know that anything they throw will be returned .. with interest

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Received my telephone call from metro, and she confirmed it was the loan account amount outstanding but the account number alongside the amount is for my current account.

should I cca them?

remus, this is the info I believe you were looking for with regards to notice of assignments.

 

If the notice includes an amount demanded that is incorrect it renders the notice legally invalid (e.g. unlawful charges or DCA admin/collection charges).

Even if the amount doesn't include charges but is misstated it is still invalid.

If the date is incorrect it is legally invalid (i.e. does not tie in with the deed of assignment - the execution of assignment should be the same as the date shown on the notice).

The case that supports this is W.F.Harrison & Co Ltd v Burke [1956] 1 WLR 419

Hi all, update with claim, have been reading with great pleasure that Freakyleaky Mellymum and Nooey have WON:D.

 

Rang the court to see if HSBC had put in their AQ, seems not, and the Judge may well be ordering standard directions as part of a block of similar cases. (does not expect it to get court, going by other cases;) ).

 

Have been away for a few days, so will be sorting out what is happening with my IB/account, as I still have not heard from HSBC, and can't see if my settlement has gone in:p

Help and advice please, I have received nothing from HSBC, phoned again re IB, and have been told that all my accounts are closed, and I need to ring Metro.

 

Now any thoughts on my next step?

 

Metro have only written re current account stating loan amount outstanding, nothing about the credit card.

 

I checked today, and the monthly payment which I sent via IB on the 5/6 to my current account etc has not been returned as account closed.

 

Should I deal with HSBC? send cca/sar to them.

 

Should I cca Metro as the figures do not relate to the account?

 

If I acknowledge Metro, will I lose the opportunity to find out the reason why HSBC have closed my account (claiming charges)?

:confused:

Dear Sir/Madam,

It has come to my attention that the above current account has been closed.

As I have been on a payment plan with yourselves and the Citizens Advice Bureau, I am at a loss to understand why you have closed my account without any communication from yourselves that such would be the case.

As my current account is in dispute with the reclaiming of unlawful charges, through my local County Court since claim deemed served on the 27th April 2007, I beleive that while said account is in dispute, you are legally required to hold any action on this account, and as such you are breaking the law.

I acknowledge receipt of your statement of means, which I referred to Citizens Advice, who then resent you, my income and expenditure.

I will be sending copies of the communications between ourselves including your inappropriate statement of means, to the Financial Ombudsman, and the Office of Fair Trading.

I look forward to your first communication with me with your reasons for closing my account without any notification.

By all means drop it into your branch but I would also cc it to their Head Office. It is unlikely that your branch made this decision.

Have received response to my letter,

 

Amount offered is insufficient, therefore no agreement or acceptance reached-you were advised of Banks procedure (yes)-regards to claim, any settlement, if necessary will be discussed at appropriate time, not affected by account closure-I stress your claim no bearing on action taken.

must just be co-incidence;)

 

Now I'm befuddled, my claim is on going, no problem, and because of the 'state' of my account, I don't think I have any recourse re the closing of the account.

The repayment monies went to HSBC via IB 5/6 ,to date non has been returned, if account closed, where has it gone?

Is Metro inhouse, and as such if I cca them, HSBC will have the agreement. (the amount Metro are stating is totally wrong, referring to current account with the loan amount).

Do I sar HSBC?

I am so unsure what to do next:eek:

Any advice please, (I note freaky is on form this morning):cool:

re lats request to keep on top of directions, I have received standard directions-copy docs 14 days before hearing.

other directions-(bit unsure) parties must file and serve on the other party written statements of all witnesses (including themselves) at least 14 days before hearing and any witness whose statement is not agreed by the opposing party must attend.

The defendant to file short skeleton argument no less than 14 days before (same as on my LTSB claim).

note to claimant-In cases where your claim has been allocated to a track you may have to pay an allocation fee. If your claim is for £1500 or less you do not have to pay an allocation fee. If your claim is over £1500 you will have to pay a fee of £100 and this will be payable by 30th June (14 days from the date of order).

claim is for £900 so I do not need to pay the fee, should I confirm with the court this is the case?

Hiya Remus, I would issue a CCA and an SAR request to both HSBC and Metro just to see what they are prepaired to show you regarding the closure of your account.

 

With regard to the closure it doesnt matter what reason they use, your claim puts your account in dispute, I would write back to Metro and tell them your accounts are presently the subject of litigation, quote the court reference and the date of issue and tell them you will talk to them following resolution of the court proceedings.

remus it would also be worth writign to the bankin gombudsman, as they are forcing the banks to re-open closed accounts and I beleive they have also made them pay £200 comp for the inconvience they have caused.........

 

whither you actually use it after that is a totally different matter...... but as a point of principle might be worht considering:p

thanks for the reply I have been advised to cca and sar by you lovely peps on this one.

I wanted HSBC to indicate the time they closed the account, as I only found out by not being able to get IB, (lightbulb moment) sar will tell me that:D .
