Today's the day I'm going to file three claims on MCOL... I just need to double check the interest.

 

I'm claiming back o/d interest and also 8%. On the claim do I add the 8% interest on to the claim total or do I leave it out until I get a court date.

I'm in the process of typing up the N1 version and handing them to the Court on Monday.

 

Hopefully it may speed things up, as MCOL would have to transfer it to local court anyway.

mcol is just convenient as you can watch the status of your claim online - that's the only difference bubbles.

Hi!!

 

Walked in to my County Court today and handed in all three claims...Just have to wait for my Acknowledgment letter.

did you file all three in one claim or separately. if they were together - you were probably wise to do the n1 as there is no limit on the wording of the poc - you'd have been stretched getting 3accounts worth of info into the mcol.

 

as you've already given the court copied of your breakdown when you filed you can ignore the first letter on this info - but send a breakdown to dg when the acknowledgment arrives.

 

After You Have Issued Your Claim

Your POC's state that you will be supplying a schedule of charges, but MCOL does not allow you to attach it to your claim at the time of filing.

So, once you have filed your claim, you need to send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim. Their name and address will be on page 2.

I understand you have a policy of initially rejecting claims for overdraft interest. However, should this be the case after you have reviewed my claim, you should be aware that my claim for overdraft interest has been meticulously calculated and double checked. It only ever relates to the cumulative charges within the overdrawn balance of the account at the point that the overdraft interest was debited

 

If it is that in your view the interest is not claimable, I am prepared to discuss this with yourseves and the judge in court.

Thanks for info, I had to file three seperates as 1st claim is for £4717 (hubbies ac), 2nd is for £928 and 3rd is for £2698.25 (closed RBS account).

 

Hopefully I should be hearing from dg soon!!!!!

after you've sent them a breakdown - you could ring them a week or so after to ask if it's been received = other than that, you probably won't hear from dg until they have filed their defence.
