HI Guys

 

Quick update. I rang Courts up AGAIN today to see if there was any movement on my claim .

 

No joy, the lady told me that they havent had anything back from my local Court as yet , but, maybe tomorrow or Monday.

 

Ive just come back from my daughters and she has a claim in , gone for Judgement by default and when she rang about hers earlier on this morning she was told all claims are being stayed:???: .

 

Her Court is the same one Im going through and yet the lady I spoke to knoew nothing of this.!!!!!!!

 

What the hell is going on. Seems to me the courts are getting just as bad as the banks for not knowing what their left hand is doing.

 

Have to wait till next week to se if I get any response from Court.

You have to remember when you ring the courts, you are just getting a desk clerk.

 

So that could explain it.

No change here either still awaiting to hear whats happening ,, think OFT and banks had some kinda meeting either yesterday or tomoz but not sure hopefully we will hear something about it . I think the date for some news about OFT was today wasnt it. Seem to remember the 28th being bandied about in a few threads.

We'll have to keep our eyes out in the papers or on the news. LOL

when I phoned court to see about getting the date of my hearing changed, they did not seem to impressed, but told me that I must apply to court manager in writing, and have a very good reason for request. So I am not holding out hope of change

Rang the Court up earlier on and asked about the claim and was informed that it had been passed to the bailffs in Halifax and if I wanted more information to ring them.

 

Just rang the Halifax court now and I was told that if it has gone to the bailiff then Ill have to ring back tomorrow before 10 as they go on their rounds then.

 

Im keeping my fingers crossed that I am getting a little nearer to the finishing line. My only concern now is that the Halifax might request it to be set aside when the bailiff contacts them. Does anyone know if they can still do this even if the enforcement has been passed by the Judge.

 

Getting really nervous now, so near and yet so far.:o

 

You all know what Ill be doing at about 2 mins passed 9 tomorrow. LOL:lol:

Well got a letter today of the local court to inform me the warrant was issued on 28th Sept and will be executed in the Halifax Court.

 

 

I rang the H/fax court up (before 10) LOL.

 

Spoke to the bailiff who is dealing with my claim and he was a wee bit miffed to say the least.

 

Not with me, but with my local court for telling me to ring him today.

Apparently my case only arrived on his desk this morning so hes not had chance to do anything with it as yet.

 

He said that he wished that the courts would tell people not to ring him untill at least a week from the date the warrant was issued as hes got loads of people ringing him and not getting enough time to sometimes even look at the warrants before people ringing up to make enquiries.

 

So I told him I appreciated the fact that he must be inundated with work and asked him when it would be best then for me to ring again to check on progress.

 

He said if I were to leave it for at least 3 weeks then ring he should have some definate news for me. . Oh well didnt want it for my hols anyway. (SO NOT TRUE) lol.

 

I asked if he thought that there might still be a chance of the bank asking for it to be set aside.

 

He replied that there is always the chance of them doing that. Even though in the past they have nearly always paid up once the warrant has been issued , but, he said that more and more now they are asking for them to be set aside, and that its due to the pending outcome of the OFT case.

 

Just have to be a little more patient for a while longer I suppose.

"If the bank fails to supply you with your data within 40 days then you should complain to the bank. Give them 7 days to comply and tell them that you will begin a complaint to the Information Commissioner and also that you will begin a County Court action under the Data Protection Act.

If the bank does not respond to your 7 day warning then begin your complaint and start your action."

 

I sent them the letter to tell them they've got 7 days last Monday (had confirmation of receipt by phone). Should I give them 4 days extra due to postal strike?

 

PS: I have already reported them to the Info Comm.

30/07/2007 Request sent, including £10 cheque(Special Delivery)

 

03/08/2007 Receipt confirmed by telephone (spoke with A.G.) and on Royal Mail Track & Trace. Cheque processed (on statement)

 

28/09/2007 (40 working days) Called branch I was advised that A.G.does not work at branch and letter wasn’t received (So how did they process cheque?!!)

 

02/10/2007 Sent LBA (reported them to Information Commissioner)

Hi Guys.

 

Just to update, when I got home there was a letter waiting for me from the banks legal dept.

 

They inform me that they have noted I have obtained a judgement in default , and that they will be applying to the court for an order to set aside the the judgement and for an order to stay any action on my judgement untill the resolution of the banks proceedings with the OFT.

 

I am cheesed off to say the least.

As this letter has come from their Legal Services does anyone think I should be worried?

 

Im planning to phone the bailiffs office tomorrow and find out what is going on, so much for me coming back to a nice suprise eh!

 

Any advice would be welcome thanks.

I thought that they would have written to me tbh, especially if the bank has asked for it to be set aside. Arent they supposed to keep people up to date with info like that?

 

I guess they must be really busy then LOL.

 

I did have a great time, the villa was fantastic. One drawback though, Ive developed muscles in my legs like POP-EYE. The ramp leading up to the villa was about a 1 in 3 and then there were 4 lots of steps to climb:eek: but the vista was absolutely breathtaking.

Weather was great, 1st 3 days rain but warm then really hot. Ive come back looking like one big freckle. .Thats the only fault being a red head.

 

Glad to be home though, Ive missed all you guys.

You should contact the courts to see if the have actually applied this, if not then contact the bailiffs to see what they are doing.

 

If they have applied this you will recieve a letter from the court.

I did ring the bailiffs office today but the lady told me to ring again tomorrow as its the Bailiff Manager who will be dealing with my case and he wasnt there today.

 

I will ring again though tomorrow and also ring the court as you suggested, I wouldnt have thought to ring them at all, I thought that the bailiff had the final say now. See, I'm still learning all the time being on here:lol: .

 

If they have asked for it to be set aside then I think I will put it to bed till the OFT case is over. Ive had some good advice from someone we both respect, I think you will know who I mean.

 

If there is one thing Ive learnt on here its to listen to other peoples opinions and experiences, and take their advice on board.

 

There are people on here that I really value getting advice from, yourself included. Thank you once again.

 

I will post the result of my phone call tomorrow, so fingers crossed.

It is a shame but Ill know more news tomorrow, I hope.

 

Ive not had any notification yet off the Courts so you never know , the bank could be blowing hot air.

Best to wait till I know for certain isnt it.

Im cheesed off about it ,of course but, if thats the way it goes then thats the way it goes.

Im not giving up but after all whats the point of throwing good money after bad, especially when I cant afford it.
