In the bank templates library there is a 'particulars of claim' document. This gives a good guide to the points you need to make. Good luck.

As I am entitled to Free Court costs, I have to fill one in manually.

Questions:

 

(First Large Box)

1) Defendant(s) - Do I just put in here Barclaus Bank Plc?

2) Brief Details of claim - What can I put in here, there is less space when you have to write it

3) Value - Can I say see attached, and attach a spreadsheet of the values etc?

 

(Second small Box at bottom left of page)

4) Defendant's name and address - What's there address for court action?

 

(Third small Box at bottom right of page)

5) Amount claimed - Is that the TOTAL amout inc. interest

6) Court Fee - Do I insert EXEMPT or leave it blank

7) Same with solicitor's cost, do I leave that blank?

8) Total amount - Just insert the claim total.

 

(NEXT PAGE)

9) Particulars of claim - What do I put here? i.e. Brief details of claim.

1) Yes

2) Return of Penalty Charges

3) Not exceeding £5000 (assuming your claim is less than this - if more put Not exceeding £15000)

4) Use your branch address or if you wish the registered office address

5) Yes

6) leave blank

7) leave blank

8) Yes

9) There is a template for a hard copy particulars of claim in the library

Follow this link, just amend with your details and exchange you for I.

Don't forget to contribute to the CAG. Without them we would probably still be drafting our prelim letters.

OH Cap One - £436/ So far received £40. MCOL submitted 17/7/06. Caved 4/8/06 for full amount!!!

OH Monument - £140, claim filed 8th May. Requested judgement by default, settled in full 4th July via out of court settlement (see thread). Total £192ish received.

Me Barclays - £630. Received letter 13th May offering £300 full and final (they can bog off). Claim filed 16th May. Acknowledgement of Service filed 22nd May to defend all of the claim. Allocation Questionnaire completed and Stay been ordered by Judge on 18/7/06!!!

Barclays are tending to drag out the process as long as possible and only reply on the last dates given.

 

They will probably acknowledge your claim, giving them an extra 28 days. They will then submit their defence after which you will both be required to fill in an allocation questionnaire. After these have been filed you will need to wait for a court date. This date depends on how busy your local court are.

Smile - £370 - Refunded in Full

Capitla One - £100 LBA 25/5

Virgin ? Data Protection Act 25/5

Barclays have until the 22nd June to reply to the courts.

Do I wait until then before using the document to give judgement etc?

I think I do, but i'm being cautious! :)
