    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about bb I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy?

    • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sent off letter asking for my charges back and included the caculation sheet (this was from Martin Lewis site). After reading lots on this site, I looked at the s/sheets and entered some charges and the totals are different, will it matter if I carry on with the rest of it on this site? Going through loads of posts - but still getting "brain-freeze"!!Thanks

You can change whatever you like until you file your claim it wont even change the timetable that you are working to, just write to HSBC and enclose your revised figures. After you have filed your claim with the court any alterations will cost your £35.00 that isn’t recoverable (your mistake).

If you take your time with the CAG spreadsheet it gives you everything you need to pursue your claim to settlement.

I have not seen the suggested schedules of charges from other sites but from the threads I have read they are not as detailed as the CAG spreadsheet.

If HSBC or their solicitors are going to make an offer or defend the claim they will need to know exactly what you are claiming for and if you don’t give them a detailed breakdown of figures it is possible for them to ask for your claim to be struck out due to lack of detail, don’t give them this opportunity.

Hi welshbaba, I have just had a quick look at the Martin Lewis website and it looks like the calculation part you used was calculating the interest @ 8% APR. The amount will differ slightly if the calculations are done on different days as it works out how many days have gone by since you were charged.

Today like lots of others before me I received the "response as soon as I have completed my investigations" letter, 2 days after I sent my LBA. Looking into the next stage, would I be right in starting with the MCOL now and taking my time over the next week and a bit to make sure I get it right?

Register with money claim now and prepare your claim, just don't submit until 14 days from LBA. Take your time and make sure you save any changes you make. When you are ready double check that everything is correct, then press submit.

 

Any problems just ask.

P.s If like me you don't have alot of money, remember to double check your claim coz if you get it wrong you will have to cancel it and wait approx 5 days for the money claim people to send you a cheque back.

If that is the total amount of your charges that you are claiming then the daily rate of interest is £0.33 per day. (£1521.74 x 0.00022)

also, i can't help wondering why you wanted mcol's address - that's very unusual. if you meant the address for the mcol that you are filling in - where it asks for the defendent's address that should be HSBC's Canada Sq address in post 9 above.

Yes Lat that was incl interest.... have I made a boo-boo?? Thats the amount I got when I entered figures on s/sheet and then it gave me the int. figure. Then whenI was fillingin the partics of claim it asked about int. on a daily rate.

well, my take on this is if you are asking for daily rate from the date of filing until it is resolved - the daily rate is based on the charges only, not including interest multiplied by 0.00022 = daily rate. if you include the interest - then you would be asking for interest on top of interest. so have you filed already? if so, let it go - dg will scale it down when they get around to offering - if you haven't filed - do it correctly.

No, not filed it yet - should push the button Monday but with bank hols, will be Tues. just getting everything sorted and want to make sure its all as it should be. The form seemed to be more simple than I thought, making me doubt myself when doin that. U never know they might send me a nice easter pressie tho tomorrow or saturday...........lol - highly unlikely

Well nothin in the mail today ( no surprise there). After sitting here debating wot to do coz of the b/hol w/end I rang them (freefone number got through straight away). Really helpful (should I say that about them??) man -Steve Gardner said "my advice would be to carry on as you are, I can see that approaching the Courts is your next step and by the time we get to your request in around 8 weeks - your account will have been refunded".

Dont really know wot to make of that - didnt expect them to say it!!!!

you will get a notice of issue through the post from the courts. A few days later a notice of acknowlegement.

 

Letter to court can go stright off.

 

Send your letter to DG once you get the notice of acknowlegement - the address will be on page 2.

 

would reccomend you send everything recorded.
