    • I think you need to tell us what actually happened. Your original post gives the impression that you were taken to court for a speeding offence. But you go on to say that you received no paperwork. So you could not have been summonsed for a speeding offence because the police had no evidence that you (or anybody else) was driving (and it seems you were not anyway). You were probably summonsed (or more likely received a Single Justice Procedure Notice) for "failing to provide the driver's details." You would not normally be banned for this offence if you were convicted - it carries six points. So did you have any earlier points which meant you were liable to a "totting up" ban?  If you were originally convicted (as it seems you might have been) how was that conviction set aside? Did you perform a Statutory Declaration? There is simply too much missing for any meaningful help to be given. It seems as if there may have been an error by the DVLA but before you consider suing those idiots until the cows come home, you need to explain exactly what has happened.  
    • Point 4 and 10 duplicate Point 5 and 8 duplicate  Try to keep to one para with regards the agreement...various paras duplicating the same. Statement of truth is out of date refer to the claimants statement

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone..just read through the thread to catch up..looks like I missed the party lol. Anyway MBNA replied to my SAR by sending my statements and my uncashed cx plus credited my account with £840 as a goodwill gesture but also as a final settlement!! I have fired a letter of to them accepting the £840 only as part payment if this is not acceptable to them..then I asked them to take the credit back. I have now sent my pre claim and I am waiting with baited breath for their reply.

In fairness, BA is waiting for me to compose the letters and she was gracious enough not to say that!!!!

I will happily put my name to the mass complaint, when my 40 days are up. I am on day 29 however, no acknowledgment yet, neither has my cheque been cashed through my account yet. I will be in touch if needs be,

I try to be discreet at times. I have all the files compiled and they are going to mailed to all the Stat authorities. MBNA might be feeling a bit green around the gills when these complaints are checked out.

 

I do hope someone from MBNA is monitoring this thread. they can't say they weren't warned.

No, do it, PM BA and she will give you her e-mail address. I am very very very very late doing the accompanying letters, BA hasn't hassled me at all, bless her and I MUST do this, just other stuff (like sleep!) has taken precedence!! I am sure she won't mind a straggler.........!!

To quote a well known phrase, I don't believe it!!!

After an outrageous 80 days from the original date of my SAR, 2 letters from MBNA, 1 letter from myself and numerous phone calls, the black hole that is Chester Towers administration has finally coughed up details of my charges!

In a novel twist, they have also returned my much travelled and dog eared £10 cheque for the second time along with the immortal words that 'we have provided this information to you free of charge on this occasion'.

This looks like a sure admission of guilt on their blatant non compliance.

I would be interested to hear if anyone else from the mass complaint team has received a similar response.

 

The letter was signed by one Rachel Claridge, Assistant Vice President, a name that is unfamiliar to me so far.

 

As expected the initial payment the whacked on my account as 'full settlement' was less than half of the total charges.

My prelim letter is winging it's way to Ms Claridige to join the rest of the claims overflowing from her in tray.

 

No more delays! I know that hell will freeze over before they start meeting any deadlines so I am ready with my LBA after 14 days and MCOL after 28 days.

 

Battleaxe, please update my file with 25th April as date SAR fulfilled.

Lazbones, naturally the SAR was not in the form of full copy statements as I have received back (within 40 days!) from other banks, but all of the charges were listed going back 6 years which was enough to get my prelim organised so it could be worse ... and at no charge too!

All complaints have been posted to FSA, OFT and FOS. Thank you for your response and thank you Cornucopia for galvanising everyone into action regarding this. When the folders hit the relevant stat authorities desks, perhaps these authorities will see that we will no longer play the games MBNA et al, want us to play.

thank you and well done to both of you, for all your hard work at bringing everyone together and complaining. Maybe now things might get easier for all dealing with MBNA. Thats if they do anything with our complaints. LETS HOPE !!!

great work, all us Welcome Finance victims wanted to complain but who to? Financial Ombudsman told me they dont accept mass complaints, but it appears FSA do but they say they do not deal with WF?? any advice appreciated.

Corn?? I added all my details to Battleaxes mass complaint, MBNA have now told me that they cannot provide me with my CCA, what should I do now? Any ideas, or maybe you know someone that can give me a nidge in the right direction?? My thread is Standingupformyself and MBNA/ABBEY CREDIT CARD Thank you
