    • I've looked through all our old NPE threads, and as far as we know they have never had the bottle to do court. There are no guarantees of course, but when it comes to put or shut up they definitely tend towards shut up. The defendant contracted Evri to deliver the parcel (Evri Reference xxxxx) and refuses to reimburse the claimant on the grounds that the claimant did not purchase their secondary insurance contract. The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from xxxxx to xxxxxx on £276.80 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £xxxx   Details of claim Amount claimed £276.80 I look forward to your thoughts and comments guys!       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Surprise, Surprise, no response from MBNA and they are well past their SAR deadline, so I am going to sign up to your mass complaint via the renowned Battleaxe. Otherwise, not sure what to do next on this one, maybe sit it out for a little longer ....

Elsewhere progress is better. Halifax credit card have returned the SAR and are now on the prelim letter. LLoyds TSB bank continue to show little interest after LBA so I am about to hit them with MOL (my first experience of the joys of court action).

Also, despite numerous chasing calls, I still havn't received my settlement cheque from Halifax bank, their excuse being that it's in the queue and it's a long queue!

Brett - would it be worth giving them 3 working days notice - or else you'll be pursuing them for further interest accruing on your claim?

Surely, the value of your claim has increased since they agreed to pay up? - maybe you could calculate what the extra amount is, and include that in the letter warning that within 3 days or you'll consider court action again?

I can do a duplicate of everything sent to me for the OFT. I now have the ins to this mob, so it will just mean photocopying everything I have. No big job.

I am better keeping my mind occupied. There is nothing more I can do until next Wednesday afternoon when we see the Consultant, oh a side trip to the GP on Monday for the microbiology results. I have done an SAR on Hinchingbrooke regarding last Wednesday evenings misadventure and to get copies of everything x-rays, reports, scans, letters and the inpatient and outpatient notes, with the warning nothing is to be edited or censored. We are going to need for the second opinion from overseas. Have two experts lined up in California and Sydney to review the s-rays and scans. it's good having a family full of lawyers and doctors, may as well make use of them. Getting that second opinion last time certainly paid off. left the PCT with no room to argue when we proved the local lot wrong with their diagnosis. We fought hard to get the correct treatment, not the bog standard take it or leave crap and now this. oh well that's life.

 

If I get bogged or things overtake me, I will holler..

BA & Corn I haven't abandoned you just busy writing letters, starting claims and generally complaining. Excellent work here and great idea to copy also to FOS what about ding it in triplicate to the Banking authority (forgot their title). They really have just everything coming to them. I'll see if there's anyone you've missed although I really doubt it. BA will get my stuff across to you over the weekend.

You know what, you have given me an idea, I am only saying this out loud because I am wine sodden, but we have a couple of lawyers (well, one to be) in family, my "to be" sister in law on Mr Corn's side (who is staying with us in two weeks for a placement at the chambers) is going to be a Barrister. My cousin, is a financial lawyer and on the board (can't say which bank but lets say they have plenty of flack on other threads on this site), so you know what, maybe time to call in on the basis of family ties!!!

 

We'll see.........

I am laughing so is Kent. He didn't think I was serious until I did the SAR and got him to sign it. I have had enough of the Richard Craniums of this world.

 

I think I overdosed on Valerian last night, because if Kent woke coughing I sure didn't hear it and I feel like I am on a high this morning. he is actually looking better. I mentione if he chooses to bleed over the floor just get outside and do it in the garden as the roses can do with some blood and bone.

i speak to people on a daily basis who have been treated shockingly bad by many creditors however i have a particular axe to grind with MBNA. I'm sickened by the treatment some of my clients have recieved and really hope that they get sanctioned (MBNA that is!).

MBNA are horrendous, which is why we started all this campaigning in the first place, I, for one, have had just about enough and will no longer be bulllied, lied to or intimidated, they treat you as if you are an imbecile but from what we are discovering here, it is they who are in fact imbeciles! Given that nearly 6,000 people have read my thread (MBNA Nightmare!!), it is clear to me that there are many many others at the receiving end of their shocking behaviour.

 

I have to believe that by taking the action we are, we are going to make a difference!!:)
