    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Morning, I have recieved a notice of issues i'm presuming the acknowledgement would come form hsbc(DG)?

However now i now the claim number can i send schedule of charges to dg now??- My question is for you Laterlus:D

no, that just gives you the date you count to 14 from - when they acknowledge (it's another court doc) it adds another 14 (total 28 days to defend) on the acknowled. dg's details will be on page 2 - send it to them then.

Evening all.

I have read many posts stating that once the claimant had recieved the acknowledgement, they have bombarded DG and HSbc with constant phone calls, emails and faxes. Is there any need? I recieved my acknowledgement on the 24th April. I sent a copy of my schedule to Dg, recorderd delivery, they recieved on the 26h April. The acknowledment states that they have 28days form the 24th to defend.

 

My point been why not just let the case roll on. All my previous correspondence has been carried out by the letter and i have adheared to the time scales. surely DG will not bow down to constant calling.....:?:

 

OR am i missing something;)

that is old info - the bombarding - we used to advise it as it was a couple of months ago and dg seemed to respond to it - but we've rolled with the punches and now are advising - nothing between filing the the 28 days when they will submit a defence - except to send a copy of your breakdown. then once you've received a copy of their defence and a transfer to a local court - we suggest sending a nudging letter to dg once every 10 days until they make an offer - for suggestions and various points to make in the letters see post number 1 on both the aq threads listed in my signature. but for the 28 days - just sit tight.

NOt sure how true this is(nor i am celebrating), however here goes. The AQ deadline expired on the 4th June 07. I spoke with the court yesterday, enquiring if DG had entered a response, low and behold NO. I asked what would be the next course of action, she responded that it was due in front of the district judge today and that he could award me the monies.:D

 

Is this within his remit??

Yes it is, the district judge asked you and DG to submit your requirements for the case in AQ form, you have.. DG havent. He/she should strike out DG's defence because they are abusing the court process and not complying with a district judges directions/orders.

 

But each judge is different and they all have their own views of how to deal with these cases so you will have to wait and see what he/she actualy does.

Just got off the phone with my local county court. My case has been seen by the judge who has ordered it to be transfered to leeds. WHY?????

 

Have still to await written confirmation of this, apparently they are extremely business and it could take 2 weeks to inform me.

Finally after weeks of been given the wrong information and delays in processing my claim, on the 14th July I finally recieved an offer from DG. They have offered to return all charges except 8% intrest and court fees(£1600 shy). However for the last 3 weeks i have been told by the court that DG had filed the AQ and my case was been transfered to a central court to leeds. This is not the case on Friday 16th JUly i recived a letter from the court giving DG until the 20th July to get there AQ submitted otherwise i would win. So my dilemma given that DG only has until this friday at noon to submit the AQ, do i decline!!!!

i have just made a call to Pontefract County Court, to get an update on my case. On the 30th July i recieved a letter stating that my case had been transfered to Leeds. On the 11th August i recieved another letter stating that following a decision on the 2nd August my case had been transferred back to Pontefract.

 

So I spoke with the court and i have been informed that on the 1st August the test case had been adjourned until a dated yet to be set between the 14th Jan 2008 and 28th Feb 2008.

 

He continued to read the letter and it mentioned 'STAYS' basically it is understood that no stays would be granted based purely on the outcome of a a test case which is penciled in for 2008.:D

Well it has been over 4 months since a STAY was applied to my case.

It was big news when the banks finally went to court, now it is like been stranded on a desert island. :confused:

Hi Bill. We are waiting for a decision on the test case. The judge is taking his time reading all the evidence and will make his decision soon. Mid July seems to be the expected date.

In the meantime don't forget the interest is building all the time.:)
