A year or so ago i had an account with my local halifax and i was getting charged at the rate of £28.00 for almost anything(cheque bounced, dd not sent etc) and so i closed it because of that.

Can i actually claim all them charges back even if the account has been closed by me? if so how do i go about it?

Hi all

After the HSBC group now the aim is for the HBOS group.

I had an account with halifax closed 2 years ago, and decided to send a SAR, to check for any charges... £252.00 to my amazement.

In march 04 they took £98 in 3 transaction ( 2x35 + 28).

So today my prelim letter is making its way to HBOS.

Next in line will be a Bank of Scotland account(which i still use)

Update

after my prelim letter i received a response from Halifax saying it will take up to 8 weeks to resolve the complaint...:o

But i am not complaining I am asking for the return of the charges...

Oh well next week will be time for LBA...

No thank you halifax i will stick to my timescales

i get the feeling Halifax are slower than a lot of others? Natwest were steady and kept within all timeframes & Cap1 were v quick (less than 2 weeks, albeit for only a couple of hundred pounds)

 

seems a lot of posts mentioning this 8 week rubbish

You need to start your own thread so people can see your questions and we can keep up with how you are doing.

 

At the top and bottom of a page, click on "new thread" add your title and this will become your thread, keep posting on there and we will all know its you.

 

You can claim charges right up till you file at court.

Phonesurgeon, You say above that you are chasing Halifax first then BOS. A friend of mine was doing a similar thing £4k

Halifax £300 BOS but lumped them all together on the prelim and only sent letters to Halifax, he filed on MCOL and got a full payout last week!

Maybe another option!

Hi all long time no see

UPDATE

I ve filed N1 against Halifax for £252 and by my records they have till the 25/05 to aknlowledge.

 

On the Bank of Scotland front i cannot be sure if there is any charges at all... so i will be checking statements when they get here.

I have filed at my local court for a compliance order against Bank of Scotland for failure to act on a DPA SAR sent to them on 4th Jun 07.

Now the claim is up for hearing and i should send BoS my witness statement by the 5th November.

Any help would be appreciated in drawing a witness statement

UPDATE

 

Complaint made to the ICO and another complaint made to LCS.

The ICO should have sent Bank of Scotland a breach notice and specified the timeframe and actions to comply but still heard nothing so today i ve called Rachel Hinchcliffe at the legal department and she'll get the updated file.

The LCS ( Legal Complaint Service ) were very intersted in the matter and i ve faxed all the relevant document and they will investigate the matter.

 

The non compliance hearing meanwhile is on the 19/12/2007 and i am expected to pay £100 fee plus an extra £500 for... i didn't quite understand why.

 

The fight goes on
