Hi everyone

 

Having recently discovered that I can claim back my bank charges I'm both exicted (I know it's amounted to quite a lot over the years )and nervous (taking on the big bad bank).

 

My question is this:

 

I sent subject access request with a £10 postal order by courier on Friday. It was signed for yesterday morning.

 

However, last night I found most of my statements for the last year which the charges amount up to £750. Should I wait for the rest of my statements before sending the payment request letter or should I send one now and add the rest of the charges on when I get the statements? I'm assuming that this will speed up the whole process.

 

If I can do this, how do I go about it? Do I send another seperate payment request letter and do it as two seperate claims?

 

Any advise will be gratefully received :0)

Hi

 

I you feel that you will not gain much more from your set of statements, then send to Preliminary letter in now.

 

Otherwise wait up to 40 days for your bank statements and then check these for charges.

 

Then send the Preliminary letter in.

It won't need to be two separate claims.

 

You can wait for the statements if you want, but my advice would be to send in the prelim letter as soon as possible. If they pay up straight away (HA!!) you can then claim again for the rest. But, assuming you then have to go on through the whole "process", you can keep amending your schedule of charges right up to the point at which you actually submit your court claim.

You can wait for the statements if you want, but my advice would be to send in the prelim letter as soon as possible. If they pay up straight away (HA!!) you can then claim again for the rest. But, assuming you then have to go on through the whole "process", you can keep amending your schedule of charges right up to the point at which you actually submit your court claim.

 

So if I send the prelim letter tomorrow for £750, and then when my statements finally arrive, add the rest of the charges onto the 2nd payment request letter (assuming that they don't offer to pay the full amount of course) will this mean that the same timeframe of 14 days still stands before I take court action, even though I've changed the amount I'm claiming?

 

Sorry if I'm not making sense but this whole process is confusing me and is a bit scary too.

Yes. You can send the "Prelim" letter now, asking for £750. In 14 days time (assuming no positive response from them!) you can send them your "LBA" demanding £750 PLUS any other charges which have come to light by then. Then, 14 days after that (assuming STILL no positive response from them!) you make a County Court Claim against them for the £750 PLUS anything else that's come to light by THEN.

 

You might choose to wait a little just before the court claim if you're still waiting for your statements - but it'll be your choice then. Having already sent your LBA, you can hit them with court whenever you want!

 

Yes, I know it seems scary, but, honestly, the further you go, and the more you read and use this site, the more your confidence WILL grow. And remember - if you're scared, the banks (all of them!) are absolutely terrified! They KNOW they've ripped off billions from their customers.

 

Follow the steps .. all will be well.

Thanks - I feel better already. I'll be sending my prelim letter tomorrow then, I'll feel even better once things start moving.

Either. As long as it's a valid trading address it's O.K.

 

Many people, myself included, prefer the head office address - it just seems more "formal".

 

When I sent my prelim to Trinity Road last sunday, I put a copy, addressed to the branch manager, through the letter box of my local branch. I want them ALL to understand what they're doing to me - and that they're not going to get away with it.
