  1. Can you accept verbally ? Or do you still have to send in the form ? This is for a credit card complaint , which may differ from the bank charges, I'm not sure how tho. Thanks for your help Karen
  2. Personally, I would wait until the other statements have been issued and then submit your claim. As sending another letter will only issue them a further 14 days from the date of the 2nd letter. There maybe someone else on the site who can advise otherwise. go get em !
  3. I have just been informed that after accepting an offer from th halifax Credit Card complaints department that there is no set timescale as to when they will be issuing my cheque for the amount. Their excuse was that they have such a high volume that they can't put a date on it. Is there anything legally I can do to get a timescale set ?
  4. Thanks Rooster, much appreciated ! Someone told me that there is no need for the further 14 days after your preliminary letter. As they have made their decision. I succesfully claimed my bank charges back and only gave them 14 days, when they didnt respond I took them to court and it was all good. Another 14 days seem so excessive for company of their size. Has anyone had this experiance with the halifax
  5. this Morning I received a letter following my claim for £550 from the Halifax for charges incurred in 2005 / early 2006. I was told that by signing the agreement I head read, understood and agreed to be bound by £25 charges for late payments. The letter then goes on to say that they will not be refunding my charges , and that since the OFT findings in August 2006, they have lowered their charges. Since that applied to none of my charges, as they were all incurred prior to that date, Can anyone give me some advice as to what steps I can take next to get this money back. Should I re-write to them, or as my 14 day deadline has now passed, Can I go straight to MCOL ? Any help is much appreciated. Thanks

When sending my first letter claiming the charges , the template asks for an interest amount , is this all the interest applied to the account , or just the interest that would have been charged because of the Charges, In that case how would I would it out , would it be the amount of charges on that month's statement worked out with my APR ? Someone please help, I need to send the letter tommorow !!
  7. I think I'm in the same situation , i'm claiming £1500. I sent my 13 days ago and i've had nothing back from them at all, Not even a phone call. They have 1 working day to respond to me , before I will be sending my LBA. (I actually haven't got the cash to take them to court right now, may have to borrow it) If you keep in line with your timescales you should be fine. If you don't receive a response , simply send your LBA (or your next letter) Did you get proof of postage ? I got my proof of postage , it's free, just go into the post office and ask for proof of postage and hand your letter over, they'll give you a receipt for it and post it off for you. Of course another Idea is to call the Halifax and ask if they have received your letter, May be a worth while idea telling them you had proof of postage anyway , this way they're more likely to admit they have received it.

Recv'd the Ackowledgement letter , We are sorry etc etc I'm going to write a letter stating this isn't an acceptable response and they only have 9 Days of my original 14 day deadline to respond before I issue court action. Should I mention that if they don't settle pre court there costs will increase significantly as I will claim contractual or 8% interest and also my court fee's ? Put the pressure on them a bit ?   9. There's a lot of talk recently about contractual interest , Is there anyone who has actually won their case and had contractual interest added in top ? Do you work out contractual interest like this.... (Amount of Charge x 29.9%) Obv Pro rata'd for any less / more than a year old. Can anyone help ?
  10. Fantastic , Didnt really understand much of it , but got the general grasp, So is that something you have written into your particulars ? How exactly did you work it out (i.e. how much interest on each charge etc) Or is this something that is written into the claim particulars already ? If i'm claiming £1500 , hopefully it will be a significant amount. Cheers
  11. When I sent my claim letter to the Halifax , I didnt include any interest, as I thought that only applied if applying to the court ? Is that right ? Hopefully if they take it down to the wire I can add my interest on at that stage.... ?
  12. If it does end up where I have to issue a court claim , going down the MCOL route, It's gunna cost me £120 to register it, So I'm already claming £1500, Would the Halifax have to pay me that £120 back, even if they didnt put in a defence , and how would I go about requesting that ?
  13. What if I was to give them no time after the inital 14 days , Then file my claim against them on the 15th Day ? Thus giving it enough time to get the cash before Xmas, Whilst were on the subject, Can I claim back charges from Credit cards I have paid off and cancelled ? Thanks
  14. So you sent them a letter giving them 14 days , and then took them to court. I did actually say I would do that in my initial letter. What experiance with timescales has everyone else has between the time of your first refund request letter , and being paid out?

So If I issued my intial approach letter today , with a schedule of charges etc, Whats the earliest day I can file my Court Claim against them, as I'm claiming for £1500 I presume they're not just gunna give in without a fight, and want to know if i'll get my money in good time for Xmas !! I wondered about this , and when I bumped into a "friend" of mine (more an acquaintance) from the Halifax Customer Relations I was abrubtly told that The charges would not be paid out and that The bank were threatening (they actually used the words threatening) account closure upon settlement. Of course this was outside of a working enviroment so nothing can be pinned to anything legally. Whereas I beleive that as you have done nothing wrong to incur the "HIGH" charges, therefore you should not be considered to be punished for asking for them back. If you read some of the threads on here you'll notice then when it gets to the stage where they make you an offer, they usually put in certain conditions (i.e account closure), in the cases of many , if you write back issuing your write for an unconditional settlement (making sure that includes you can claim any more charges in the future) they usually give in and you get an unconditional free settelement.
  17. Going by these new dates i.e. 15th is Day 0 My LBA would be sent on the 1st Dec , then I would issue a claim on the 17th which is a sunday , Can you issue them on a sunday ? Or would I have to wait until monday? Which is the cheapest, MCOL or local county court ? Thanks ! GiveMeMyMoney123
  18. As Far as I know it you should only be charged £10 and no more for a subject access request. If you challenge this amount and mention S.A.R They should back down. (In my opinion)
  19. I have today sent another letter , using a different template and got proof of postage from Royail Mail, So my LBA should be 16th Decemeber ! Fingers crossed I'd get this money before Christmas.
  20. Does anyone have a template for the LBA, I have a template for the initial approach , and all the rest , but not for the letter you send to them before you proceed with court action. Cheers Anon
  21. thanks bluecloud, I posted the letter but didnt get proof of postage ? Do you think it's worth me re-posting another copy with proof of postage ? How do I go about that, Do I just ask at the Royal mail post office counter ? Thanks again for your advice, if I got the money before Xmas I would be very very happy ! Last Christmas was spoil due to high charges , and his christmas would be great therapy if I got the money !
  22. Hi All, thought i'd log my story on here , as others are doing. I received my statements for the last 3 years (This is since the account was opened) I actually was supposed to be billed £5 for this but have actually had them sent for free ! I have just posted my initial letter today (14th) , asking for around £1500 back in charges and interest. Sent by first class so they should recieve my letter tommorow, which would be the 15th November 2006. I am giving them 14 days to respond, so that would take me up to the 28th November to respond. Failing a satisfactory response I intend to issue a further letter giving hem 14 days. If I still haven't received a full refund, I will write telling them I am issuing court proceedings within 7 days. At this point , I expect them to make an offer of about half. I will obv decline , at the end of he 7 day period I will make my court claim. So my LBA should be on the 21st Decemeber..... Lets get them working over Christmas and make them suffer like I did over my teenage years without any money thanks to Halifax. I don't expect to go to court with this, but am willing to if needed. Any advice anyone can give re the above timetable would be much appreciated. I will keep you all posted should I receive a response. Wish me Luck , some money for the new year would be great !!
