TM legal? why didn't ovo do this themselves as they do but chose to sell the debt on for 10p=£1? funny debt you state you reived a letter of claim, why did you not reply too it.? also is there is no indication of the date this bill comes from on the claimform? how do you know its from 2022? what other previous paperwork have you received? please scan page 1 of the claimform and bothsides of ALL previous letters upto one mass pdf read upload carefully. .................. pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID.     • I've just remembered that a friend of mine had bookings cancelled on Booking.com about a month ago - and the good news is that all worked out in the wash. I'm at work now but will scribble properly in a couple of hours with the full tale.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I have a 12month contract which started in May '06.

 

The problems I am having is that I have domestic oil heating and it has cost me about £800 just to get over the xmas period!

 

I just had my tank filled again today asking the oil delivery guy, should 1000 litres only last 2months? He said 1000 litres for a house of my size should last 6months+ not 2 months and to get my boiler serviced ASAP.

 

I am going to write to my landlord to ask for it to be serviced but I don't hold much hope as I have asked him to do other work such as: fill a great big hole in the garden wall so my kids don't fall down the cavity! He always promises to do the work but never does!!

 

The other major thing I need the landlord to do is to get the electrics sorted out. The mains and meter is actually on the main street with a electric cable drooping down to the house, the meter is not actually installed in the property so anyone can turn me off walking past!!

 

Like I say I am going to write and ask if he wil carry the work out but wondering where I stood if I put something along the lines of:

 

xxxxxxx, xxxxxxx, xxxxxxx work needs to be carried out ASAP. If the work is not done then I will have no option other than to get the work done myself and I will be stopping the rent payments until the money I have had to spend has been covered. I will also not be renewing my tennancy if the work is not carried out.

 

Does anyone know on how I stand on doing this?

 

The letting agent said there is nothing they can do as the landlord decided to maintain it themselves to save costs!!!!

Are you aware if the owner of the property has had a corgi gas certificate on the boiler (legal requirement for all landlords) and had the electrics tested?

 

I personally wouldnt suggest paying for the works myself, perhaps just say that you are not willing to pay the rent until the landlord has paid for the works to be carried out.

Hi,

 

thanks for your reply, The landlord has advised me they are going to do the work ASAP, I will get a date out of them by next week else I will write to them again and advise I will not be paying rent until it is all sorted.

 

All I want is an easy life!

Bear in mind though that witholding rent is a last, last, last resort, as if you get into two months arrears or more the landlord can arrange to have you evicted anyway. A better route maybe would be that, if they didn't arrange reapirs, to write and say that you would get the work done yourself, getting quotes from three different companies, and that the cost of the repairs would come out of the rent in installments of £XX per month over X months - and you give the landlord 7/14 days to reply before work is actually carried out. This may be a safer route for you.

Demon is right. However, deducting the cost of the work from the rent is your legal right of offset, and as such cannot be classed as rent arrears. He is dead right about getting 3 different quote, and the timescale however - if you do not do this then you run the risk of a court not agreeing that you are in the right with getting the works performed.
