    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.
    • Hello everyone,   Just thought id post an update.   I've today now finally received a claim form from PRA Group. Bit annoying as the last payment to them would have August 2018 so was nearly over the line. I believe my only grounds for defence is that they haven't managed to produce a copy of the DN notice, however from some online research I managed to find some case law that stated they can use their systems screenshot to show proof of it being sent.   I know I have to respond back to their claim form and will do so online on moneyclaim, is now the time to pick up the phone to them and negotiate a deal?   Any advice as always is much appreciated it.

    • Thanks for your reply, I have another 3 weeks before the notice ends. I'm also concerned because the property has detoriated since I've been here due to mould, damp and rusting (which I've never seen in a property before) rusty hinges and other damage to the front door caused by damp and mould, I'm concerned they could try and charge me for damages? As long as you've documented and reported this previously you'll have a right to challenge any costs. There was no inventory when I moved in, I also didn't have to pay a deposit. Do an inventory when you move out as proof of the property's condition as you leave it. I've also been told that if I leave before a possession order is given I would be deemed intentionally homeless, is this true? If you leave, yes. However, Your local council has a legal obligation to ensure you won't be left homeless as soon as you get the notice. As stated before, you don't have to leave when the notice expires if you haven't got somewhere else to go. Just keep paying your rent as normal. Your tenancy doesn't legally end until a possession warrant is executed against you or you leave and hand the keys back. My daughter doesn't live with me, I'd likely have medical priority as I have health issues and I'm on pip etc. Contact the council and make them aware then.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys,

 

I have just called Halifax to get my last 6 years bank charges.. They charged me £5 from my account which was took out 5 minuites after the phone call!

 

Before they agreed to send me my charges the guy I was talking to said "Oh Mrs Jones I will have a word with my superviser and see if we can get SOME of these charges refunded today!" I was astonished but kept my cool and said no I will just have my statements please hehehe..

 

Wonder how much they would have offered! :rolleyes:

 

Anyway they say I will recieve them in 7-10 days!

Received 15 envelopes this morning from the Halifax..(Who else!! lol)

Statements going back the 5 years since we opened our account.. I have never been so happy seeking out past charges, felt good hehehe.

 

£1,684 in total.. that is gonna come in handy.. My husband is not working at the mo and I am a Student Nurse on a pityfull bursary!:(

Royal Mail says Prelim delivered on the 03rd Feb (Sat)... Will give them 14 days from today..:rolleyes: LBA due on the 19th Feb!:D

Ok.. first standard letter has been sent to me today... I am sorry to learn that you are unhappy with the charges applied to your account blah blah blah.. 4 weeks la de da de da lol...:D

AtMoSpHeRIC and Netyard, just to let you two know my hubby received reply to at last from halifax making him offer £200 short, he rung them up to say he was not happy and they have offered him full charges back, this is 6 days before he was due to file court action. Always worth a phone call if you do not want the hassle of filing court claim. Good luck.

Well have not heard from Halifax yet :(.. Just the standard one after I sent off the prelim! I am due to file for court on Monday, they still have a few days yet.. Has anyone called them at this stage and got their money back? and if so who did they talk to? I have had no offer, but maybe a polite reminder may kick something off?:confused:

I have seen that other people have called and got their dosh back, I am just scared that I am gonna say something I shouldn't lol.. Don't want to make a great mess of it! Just my luck that I am broke and they will just laugh at me lol...

No Joy they said that my claim will not be sorted out till April! :o

They said they have sent a letter out confirming that they have received my LBA but no offer.. Looks like I am off to court!
