    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

    • Page 2 – document 10 and 11 – you should include the fact that it is a Law reform commission report. Best to give it its full name if you can I suggest that you move paragraph 10 up to the first position – paragraph 5 and move everything down. I think other than that – it is good to go. I suggest you don't bother to do any more drafts. Simply rearrange the paragraphs as I suggested above then the title of the documents that you are relying on in the index page.     • I have recently found myself in financial difficulties and with the help of forum members in another thread regarding this, I think I can get myself sorted. My query here is how to deal with a Cifas marker that has been logged against me by one of my creditors for "evasion of payment". Admittedly yes I did get a £5000 loan with them and have not paid any payment but at the start of the year, which is when the loan landed, I realised I was going to be struggling to repay that and other debts and I contacted MCB to ask if there was any way I could extend the loan from 24 months to 36 months. I explained my situation and that I was going with a DMP and asked them if they could help me with this. They did not reply. I then emailed them again a month later explaining that my DMP was going ahead and could they confirm that the direct debit was indeed cancelled. Again, they did not reply. The DMP fell apart and so did everything else thereafter. My bank withdrew my overdraft and said I could not stay with them (I thought initially that it was because of the DMP) so I opened another account (Starling) and set up all my direct debits etc with the new bank. A month into being with the new bank, they contacted me and said they were closing my account in three months. So I started applying for other basic accounts and every single one of them either refused or revoked.  Through the help in the other thread, I requested a SAR from Cifas and discovered that I have this marker against my name for "evasion of payment". I have logged a complaint with MCB on the advice of other forum members, but my query really is do you think the marker is fair given that I did ask them for help and I did explain that I was going to be struggling financially to repay the loan over the original two years, and is there any way that I can get it removed? I fully admit that I have yet to make a payment to them and I suppose in my naivety and panic I thought if I emailed them early on they could extend the loan and help me out, but they didn't even reply  I did manage to open an account with Monzo before the marker was in place, but I am very concerned that if Monzo do what Starling did, I will have no bank account to pay my bills or get my wages paid into.  Realistically based on the information I have given here, what do you think my chances are of getting this marker removed? Any help/advice on this would be greatly appreciated x

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Prior to the test case, the scale of consumer litigation for the return of bank charges was resulting in conflicting outcomes and significant costs to individual consumers

 

err no it wasnt the banks paid out every time

Greetings to one and all. I have returned from my travels to some of the not so nice places in the world. Got the luxury of spending my 30th Birthday in one desert with very little booze, (Thanks for the Birthday wishes by the way PD!) came home for Christmas then away for a spell in a different desert! Been back two weeks and my bloody tan has faded already!

 

I have been trying to keep upto date with the goings on in the OFT test case, but my access to the internet has been poor at best. When I got back I thought "Sod it, I can just wade through hundreds of pages on this site adn catch up." But I was in a good mood so I thought I'd phone the chumps at HSBC to see what lies they'd try and spin me. Sure enough they didn't let me down! I obviously got the guy who was on work experience, so clearly the brains of the outfit.

 

"What's happening with the OFT test cast?" says I

"It's over. As far as I'm aware the banks won, but I'm not 100% sure."

 

Fortunately this callsign wasn't born yesterday and demanded he shut his stupid word hole and put me on to someone who knew what they were talking about. After about 10 minutes on hold (probably whilst they searched the building/street/local fast food joint to find someone with a clue!) a "Supervisor" came on and told me the Judge had retired to consider his verdict. I they gave him both barrels (not for real, I had to hand my rifle back in!) about the chump I spoke to first giving me mis-information. No need to really, but it made me feel better!

 

So here we are, hope all the old faces are still around, Pete/lattie/PD/auders/freaky/jonnymitch etc. Looking forward to getting some banter in!

Argh! If I remember rightly, your court case should have been on my birthday! Bugger! Oh well, I've been waiting since Jan last year, I can hold out a few more months I guess.

Welcome back Rob !!!

 

well you got the right information out of HSBC eventually which is quite unusual :D

We are expecting the high court judge to wake up sometime in July and tell us what he dreamed :D hopefully it wont be a nightmare for us :rolleyes:

 

We are all still about although mostly twiddling our thumbs :rolleyes: good to see your back and raring to go :)

I only drink beer and maybe a little wine or vodka at night, no animal based products :D

 

The only blood letting I do is draining the life blood of the leach banks :) which I do take great pleasure in doing myself or telling others how :D

I don't serve with the vikings, the nickname comes from elsewhere. I do have mates that do though, they said it was not too clever out there. The series Ross Kemp made is the best portrayal or service life in the middle east we have seen. I would love to say that the government sat up and took notice, but they don't give a crap. Out there our lads are not fighting for queen and country, not for Brown or that BLIAR before him, not cause they believe it's right, they are fighting for each other, nothing more and nothing less. The forces are treated like sh*t by the governmet, we are quite simply at breaking point. Should we have to fight another war tomorrow, we'd be up the proverbial creek without a paddle, boat, life jacket or the ability to swim.

 

To get home after experiencing that kind of thing and to be expected to slip back into normality overnight is an impossibility. I am proud of my job, I am proud to defend my country, I am willing to risk my life. But I'd like to see the mugs that decided that we were going into afghanistan on the frontline, stood next to the troops under fire though, just to see how much they sh@ themselves. We will be there for many years to come and many, many, many more lives will be lost.

Good to see you again Rob.

I don't think any apologies are necessary for speaking your mind. You do a job that is difficult enough without the govt making thing worse. I for one am grateful that you and the rest of the forces are willing to continue to do your job.

How you manage to cope with the extreme differences of life on the front line and life at home when on leave I will never know. Big respect to you.

Sorry rob, - I just naturally associated you with the vikings. I know one or two of them myself.

 

I know where you're coming from with your comments . It used to be traditional in the forces to moan and blame everything on the government - it released the pressures - trouble is now -it's true -it's them to blame........

 

I agree with freaky - I have the greatest respect for all of you in the mob these days - you've earned it.

Greetings lattie, glad to hear you're still floating about. I expect you might have a little more to do once the verdict is released in the year 2053! Sorry, I meant July this year. Although saying that, which ever way it goes it is almost certain to go straight to appeal IMHO, so that'll take many many more years! Think I'll be drawing my pension before the banks pony up!

 

Really the way I see it is simple, ignore the arguments from both sides, all this is going to boil down to is 1 simple fact. Has a high court Judge got the minerals required to rule against the big banks? Remembering that we have a judicial system that is nothing if not antiquated! I'm hoping the man in question (who's name eludes me!) does have the required stones. I expect that the banks at high level are massively corrupt and may even try to bribe/pressure the man to rule in their favour. It ashames me to think that such things might happen in this day in age, but I believe they still do. I do hope I am way off the mark though. All of that is of course IMHO and doesn't reflect the views of anyone sane.

Good morning Rob, I think thats a fair assessment of the situation, if things go as expected the stays should come off when the judge hands down his verdict in July(ish) but there are many things that may affect this.

Even ignoring the basic nature of the human animal and the corruption this can lead to it may be seen that as banking is one of the UK's major industries now (and the government do now own a bank) they need to be protected from the vicious consumer :rolleyes:.

I would love to think that the Judge would hand down a considered, unbiased and fair verdict (which would obviously be in our favour!). But having been screwed over by the government more times than I care to remember in my line of work, forgive me if I display a slight lack of faith.

 

IMHO the coroners from Wiltshire and Oxfordshire that do the investigations in to the Deaths of servicemen/women when they are repatriated from Iraq/Afghanistan should have heard the case. They have absolutely no problem with highlighting the governments failings in public. This has the government so worried that they are actually trying to change the law so that military deaths can only be investigated by military coroners, so all the repeated failures by the clowns in parliment and how a £40 piece of kit could have saved lives, will never make it in to the public eye.

 

I ask you how corrupt can you get!

Back onto subject, I do however take slight comfort in the fact that the Judge has delayed the release of his verdict until July. In my heart I hope that this is due to him taking the time to consider the case and make sure he findings are correct. If the banks had got to him (which they may/may not have) then it would have been found in their favour already.

 

In my head I suspect however, the delay is to alow him to take a longer holiday and get a decent tan before his findings go public!

Funny pete, I was under the impression that the government owns b****r all ;) . The only money they have is ours, so the bank is owned by us ...........:D . So why don't we give ourselves a loan...?:rolleyes:

I don't think any of us mind you getting on your soap box Rob, what you have to face when on tour makes all of this pale into insignificance and we will always be indebted to you and all of your mates.

To be honest I personally welcome your comment otherwise all I would see is what the media want me to see which again can be subject to distortion or not reported because they think it is now "old news" :rolleyes:.
