      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OK update----

 

Still haven't had the CRA file cleared.

Still receiving default threat for what is now a £2.65 balance (interest added after the clearing goodwill credit from Colin Pugh.

 

Going to see if Colin Pugh is back from hols on monday - and I shall be calling him (allsorts) to ask what the hell they think they're up to.

I know, it's crap isn't it, I asked for a CD, they bought 4 that had "MUM" on them but not the one I wanted and I have got a bunch of something plonked in a vase with the wrapper and price still on! LOL!!

 

Am defrosting chicken for lunch as we speak, as I normally only work part time I wouldn't be worried, except tomorrow I have got to do all washing, clean house, go to Tesco's, have all uniform and PE kit ready as well as Mr Corn's work clothes as he going away for the week and it is bloody Mother's Day!!! Yes, in my house, it is Mother's Day For More Work!!! LOL!!!!:rolleyes:

Hiya, just been reading this thread,... am about to take MBNA on myself... with the section 85 queries... how can I find out when the cards where renewed as I got rid of most of my cards last year?... but i'm sure that when they sent them out they neva sent a copy of the agreement.... :confused: Plus my hubby has had some accounts for years so I know that they most prob renewed them a couple of times... but cannot remember the 1st date... Thanks

i know i'm sorry for hijacking the thread but when I read something that seems relevant in someone else's thread I try to ask while the query is in my head otherwise it leaves very quickly neva to be found again! Lol. I have just asked the same question on the credit agreements thread as Ive spent nearly all day on that one! lol... just as perseus was thinking of going down that route thought he mite know the answer?!? Anyways will be starting my own MBNA thread very soon along with some other threads for other offenders.... got 3 mbna accounts to go for, two of my hubby's and one of mine... corn I think I put a message on ur MBNA complaints one, which I will sort 2mrw and email Battleaxe the details! :D

Card renewals....my thoughts, for what they are worth.

 

With the S85 issue, card providers are replying that replacement cards are sent out on what they call "credit card mailers" which they insist satisfy the terms of S85. (These are the bits of paper which the new card is stuck to and most of us rip off the card and bin the piece of paper). I am simply going to write to my issuer and ask them to supply me with the dates that replacement cards were issued, and also to supply me with copies of the mailers that came with the replacement cards. Because each mailer should be EXACTLY the same - because if it's a copy of your agreement, and you only ever have one agreement - then they should all be exactly the same, however many times the card has been replaced. I can't remember which thread it's on (possibly CCA) but we have all been scrambling around trying to find these "mailers" and some have been scanned & posted.

 

However, you would also have to send a CCA request, in order to compare the original agreement with the mailer, and even if they have sent you slightly different mailers with each replacement card, they will probably only send you a copy of the current version of the mailer even if you have had more than one replacement card. If you know you have had more than one replacement card, you ask for the mailer that came with each card.

 

If anyone on this thread has got a credit card mailer could they post it here please? Or if you are due a new card in the near future, don't throw the mailer away!

I am laughing now. I have never returned any of the cards or cut them up as requested, i have kept them, makes me wonder why, now I know, sixth sense. This is how I can establish the dates of the re-issued cards and both MBNA and Crap One hate it as I have proof. Never get rid of anything. What can they do to you? Nothing. You keep all the evidence from now on.

 

Take a guess from when you opened the account, (you should have that with your CCA or SAR) add four years, that is generally the shelf life of the card, add one month and there you have the approximate month of the first default.

MBNA and Cap 1 run on 24 months for cards, as far as I can see.

Hi BA

 

NO!

 

The inconsiderate git is on his honeymoon - won't be back until the end of next week!

So I spoke to his secretary, and she's passed the chase-up onto another Customer Advocate Officer.

She also advised that according to the file, the CRA - Equifax, will update last months file history on 23rd of this month. My 30 day free trial expires 26th so at least I'll be able to confirm it before I cancel.
