    • Hi everyone, I have an update on my case that I’d like to share with you all.  so after submitting 371 pages in my bundle, a witness statement and skeleton argument for my court case due to take place in Manchester on June 21st I got an email from my litigator stating that hmrc have pulled out and the case is now closed!    this is the body of the letter….. This letter, which is copied to the Appellant, pursuant to Rule 17 of the Tribunal Procedure (First-tier Tribunal) (Tax Chamber) Rules 2009, the Respondents gives notice to the Tribunal of their intention to not defend the above appeal.   The Respondents respectfully invite the Tribunal to allow the appeal and close its file. In lieu of the above the Respondents would respectfully ask the Tribunal to vacate the hearing scheduled for Friday 21 June 2024. We would accordingly invite the Tribunal to close its file. Obviously this is extremely good news which hasn’t sunk in that after 3 years of fighting it is over.    I do have a further fight on my hands in that the Group Action I had joined with Independent Tax that had been disbanded in November last year and I chose not to continue with them. They are trying to bill me over 5k for the work they did under that Group Action which is ludicrous bearing in mind the whole point in joining was that it would keep the cost to a minimum as it would be shared between us all. They had asked if I wanted to continue to have them represent me on an individual level which I declined, if I hadn’t, goodness knows what they would have been trying to charge me now.

Oh I am the British PM lets just leave early I have better things to do and as he is called out on disrespecting all those veterans that served our country for the freedoms we have today he gives a groveling apology to little to late. He knew about this event for a long time and also knew that this is probably the last D Day Commemoration due to the age of those Veterans who gave so much for there countries freedom. Even on the day of the D Day Commemoration he still could have changed his plans As PM and stayed but choose not to showing such DISRESPECT to those Veterans, those that lost there lives and Families for the Freedoms we have today Being a Veteran myself I have never known a PM to show such disrespect what the hell was he thinking SHAME ON YOU PM SUNAK

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Letter out of nowhere threatening court action within two days of receiving said letter for a debt dating back 15 years which we know nothing about.

HFO , at the moment it has gone quiet but last week i told them i didnt acknowledge the debt to them and if they wanted me to co operate they must send me a full and true credit agreement signed, they said that they didnt do that and demanded payment, they the proceeded to call my moble 37 times in 5 days and my wifes phone 32 times in the same period, times ranging from 08.30 - 21.30

i will now reinforce my case in writing to them and request no more calls at all , everything in writing, i have kept a record of all calls and will report to the police if they try that crap again.

HFO are a bunch of thug criminals and must be stopped. how can they ever be deemed fit and proper to hold a consumer credit lisence !!!!!!!!!

IF THE SYSTEM WONT PROTECT US FROM THESE ANIMALS THEN I MAY HAVE TO GO TO THERE OFFICE PERSONALLY TO DISCUSS FACE TO FACE WITH THEM ( AS SOON AS I RETURN FROM AFGHANISTAN WITH MY PARACHUTE REGIMENT IN TOW)

1st credit for harrassing us telling us to get a loan or remortgage or borrow the money from family and freinds,threats with ccj and charging order and force of sale of our home,in the process of waiting for a CCA have received two letters the same saying they are contacting their clients and this could take 6-8 weeks.

 

Eversheds for refusing payments from Payplan and for being totally verbally arragont while on the phone to them :mad:

I need some quick advice guys n girls. I have agreed to pay the DCA £200 a month and swipe dept in under 2yrs. The problem is they have not only taken a good will gesture payment but taken out the £200 before the date we agreed first installment of this amount. im devastated and NEED that money. how can i get this back?? im in trouble if i cant get this money, this will put me in even more of a hellish predicament. help!!

Thanks for replying. I agreed first installment for 5April, beginning of this month my cicumstances changed, cut a long story short I had t move out. I called them to renegotiate and I agreed that they take out £50 so i cover myself this month, they took payment and 'Chris' confirmed that the first installment would be on the 5th of May. So although I had the £200 for 5th April in writing - didnt sign anthing mind. I havent got anything confirming our latsest convo. well im guessing which way this is going, right? Im not going to get that cash back am I mrmarmite??, okay i could realy cry right now. :(

When I called back in Aprill to re organise the amount for just this month they took the solo for £50, the direct debit stood for future payments, so i made no adjustments myself to my account i.e told the bank that there is a payment that should not be allowed to be taken on the 5th Aprill (that first installment of £200?,

 

so i guess im in the crap house now. I have never been in this situation and im panicking so much about this i really am. is there any point in me calling these guys monday and crying about this? jeeeeeze. im pulling my hair out here.

You should be ok. Either go to or call your bank on Monday.

 

Tell them that the Direct Debit payment was made in error and it should not have debited your account as you DID NOT AUTHORISE that payment

 

Inform them that you are fully aware of the Direct Debit Guarantee and as such you demand an immediate refund as per your rights under this Guarantee.

 

Your rights

 

The Direct Debit Guarantee

  • If the amounts to be paid or the payment dates change, the organisation collecting the payment will notify you normally 10 working days in advance of your account being debited or as otherwise agreed
  • If an error is made by the organisation or your bank or building society, you are guaranteed a full and immediate refund from your branch of the amount paid
  • You can cancel a Direct Debit at any time by contacting your bank or building society. We also recommend you notify the organisation concerned.

If the person that you speak to at your bank refuses, ask to speak to their manager. Tell them about your right to a full immediate refund. If they refuse, tell them that you will make a complaint to the FOS and ask them for the name and address of their chairman, as you feel he will be interested to know that members of his staff are willing to ignore the Direct Debit Guarantee.

 

You have to be really strong with them or they won't do it. They will say they need to investigate it... Just keep telling them that you are entitled to a refund...

 

As far as they are concerned the payments were supposed to start next month. Don't tell them much more then that...

Go to your bank and ask then to file an indemnity-(this is the wording you will need)- for the direct debit, you will also have to cancel the direct debt as well and re set it up later. You shouldn't have any problems doing this as they have broken the agreement they told you on the phone. The money should be back in your account within 24 hours max., easily solved :)

thanks. Il give it my best shot and ile get back to you about it all. If I dont get this cash back I wont know what to do. I cant get an overdraft facility with Natwest im credit listed because my previous employer couldnt pay me for 2 months, say no more eh. I cant get credit cards to build up my credit rating. I earn less than £1,000 a month and im sick of not earning enough to pay bills, the more hours you work the more your taxed hardly makes sense does it. Im telling you I can understand why people turn to prostitution or throw them selves off buildings. I hate struggling like this every month. Ive never been on the dole but I know why people just give in and stop working, its not healthy. Sorry about moaning.

okay everyone, gettingback to everyone who helped me with the DCA taking money from my account when they shouldnt have. I went to the bank to explain my situation and they got my money re ebursed to me the next day. So im safe for now, oh and another thing, I asked for my bank manager to update my solo and he said it was not possible couldnt untill the dept was replaid yeah, all £3334 of it, well i guess ile be reviewing my financial situation in two years then!

 

A big thanks to everyone who helped me through the money [causing problems] of the DCA. cheers.xxxxx:grin: your all brilliant!!
