No new news I am have to put claim on hold until funds are available. A total pain in the deriere. and proably what barclays want. I will win in the end

Thanks for the support. Got to ensure i keep some money aside for AQ section to. I am claiming over £ 2000 so the cost going to be high ish. I guess as soon as I am paid i need to syphon off the money pdq.

Quick question in the value section of the N1 do you claim £120 for court fee or is it £220 ( with AQ fee ). I assume I then take one copy to the courts , i keep a copy and do i send a copy to Barclays ?

You can add the total of costs together.

you wont need to forward a copy to barclays, the court will do that so they can enter their defence [LOL - PMSL- LMAO - ;) -:lol:]

And judging by Barclays on Whistleblower last night seems they are now in real trouble.I wonder how profits will be effected after last night. espcially as they could refund this money with out all this hassle. vbmenu_register("postmenu_663811", true);

Not entirely sure I understand your question, but you will have to pay £100 for your AQ as and when you receive their defence. You get this back too when they settle.

No, you should receive acknowledgement within 14 days of date of service, then they have a further 14 days to enter a defence. I got my AQ with a copy of their defence.

Just to keep you all updated I submitted MCOL Claim in as of this morning, and it was processed by 10am today.

 

So I assume I just sit on my hands now for 14 days, or should I be preparing my court bundle and or AQ questionairre ?

help my claim was issued on MCOL on 31/3/07 but is yet to show the status of served ( its still showing issued ) 9 days have elapsed since the issued date this seem strange. I have emailed the Court but obviously no answer during bank holiday. It should have been deemed serevd last thursday.

 

Any advice appricietted

In case you are not aware and as you filed using MCOL send 2 copies of your schedule of charges, clearly marked with your claim no. and a brief covering letter asking for them to be filed with your claim to:

 

The Court Manager,

Money Claim On Line

Northampton County Court

21-27 St. Katharine's Street

NN1 2LH

 

Dear Sir/Madam

 

(Your Name) –v- (Bank)

Claim No: ********

Date Issued: xx/xx/xx

 

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

 

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

Seems I was having a blone moment. OK spoke with MCOl this morning and Barclays Have up until the 18th April 2007 to acknowledge. Nothing asof yet but I guess the easter breaks been in the way a little.

 

Reading some of the other barclays threads it appear that they acknowledge some early, some at th eleventh hour. But has anyone had a case acknowledged late or not at all with barclays.

2 days until D-Day for Judgement by Default. I guess there will be a later standard acknowledgment. I wonder why the coursts are allowing the banks to be so shoddy with there responses.

 

If the shoe was on the other foot I am sure Barlcays wouldnt have gave me all this time to pay them back. I bet it would have been less than 14 days. How the law can be interpretted so differently.
