I just posted on firemans thread. Putting what i think some of these courts could be upto. I am now in my 7th week of waiting since my AQ was received by the court . Could the courts now be delibrately holding these claims up now to try and force the banks to settle. It is a sort of seige mentality of starving the banks into submission. The courts know that interest is being added to these claims on a daily basis. Which will be costing the banks a fortune. Cobbetts will be fully aware of how many claims are bogged down in the courts. Any thoughts ?

yeah they could be i suppose...Thinking of writing to the judge asking for it to be struck out to be honest.. if NW can't be bothered to enter the AQ, even tho they are 10 days late, surely i am within my right to start pushing a bit...

In your case with cobblers not submitting their AQ you must have reasonable cause to have their defense stuck out. For abusing the court system etc, etc,

you are well within your rights to apply to strike at any time now, even though the judge may or may not go along with it, personally i would be doing it like tomorrow !

 

the courts are certainly holding these claims up as the entire british court system is entirely bogged down with these claims, much to the dismay of the judges. So they seem to be doing them in blocks of claims, which is not really fair for the first person in the queue.

 

I hope an order is made in parliment asap to do something about this, the banks are taking it too far, wasting everyones time and generally causing alot of trouble where trouble doesnt belong.

I don't think the government will do anything about it to behonest. They are staying well out of the way considering how long it has been going on for...

 

To much corporation tax to lose me thinks... or is that just me being cynical...:)

Correct me if i am wrong here, but the office of fair trading is government run. So i

suppose they are being very clever by attacking the banks through the back door. Without hitting them full on, which would hit their corporation tax revenue from the banks.

The OFT is the tool they use to drag things out as long as is possible. In my own industry (Newspapers) there has been an ongoing enquiry for over 4 years...

 

This is something the government could have sorted a long time ago, and in fact probably knew all along that one day this would get out..

Quite possibly. A good debate my friend for 9.45am, which only history will show. So we now have to wait for abit of history to accumulate, and everybodies happy. ;)

I'm in the same situation as you; I received a letter from the court (a copy of the one sent to Cobbetts I assume), requiring them to file their AQ by 4pm on the 30th March. Their deadline was 17th March.

 

AFAIAC a deadline should be a deadline!

I agree.. i have had nothing at all about this. I called yesterday and the court said the Judge still has it... I have decided to wait a bit to see what the judge comes up with rather than apply for it to be struck out..

Well now i'm getting a little impatient.. decided to once again try and settle with NW, faxed another letter to Cobbs but have had no response... again!!!....

 

I shall repeat - patience is a virtue, play the long game - even if you end up in court, it's what the whole thing is about. Don't make settlement offers, wait for the court process to go on. Yes, some people get their money quicker, but at the end of the day, you have to be prepared for a fairly long slog.....

jos,

 

like mcuth and glenn have said dont think cobbetts are in the slightest bit bothered about what you send to them, or will even be so gracious as to read them. I personally wouldnt get into any more correspondance with cobbetts at all. I would just forget about them for now, the more letters you fax them, the more you appear to be crapping it :eek: so be ready for a long game of poker and make sure yor face is set in stone mate.

 

me myself i would be applying to strike now, cobbetts DO NOT GIVE A S**T about your claim, you, the judge or anyone else, they really couldnt care less. They have acted unreasonably and you are well within your right to apply for their defence to be struck out. If anything doing this will be the speadiest way of getting a response out of them.

Called the court today and apparently it has been referred to a District Judge for a review on the 27th March..The original judge had it on 22nd March!!.. Still no AQ from NW either...

 

Not sure if this is standard procedure or not but was told by the court to just wait...

No, absolutely nothing as yet.. i ring the court every two days just to check but the District Judge has still got it.. I have had half the money paid into my account so its just the other half i am going after..

 

I just hope it will get sorted over the next week or so as i am getting a bit bored with the wait..
