      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

wonder what sort of story Mr Hester has been given by the old rearguard still in the RBS............how many little pork pies they will have Mr Hester believing......we will have to and see the outcome,

I am seriously thinking of making my story into a "Proper Book" and publishing it...........are there any writers on the forum ...or does anyone know one who could give me some guidance on how to format it and help write it..........I am serious about this .........it will open peoples eyes at what Banks can do.....the storey will begin in 1971 onwards to date, any ideas anyone???

Certainly RBS reputation is in the gutter, and there would be interest in this which might highlight some of the more dubious tactics that banks have indulged in.

 

That said best to wait for all proceedings to come to an end, or an arrangement reached before publishing.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

But is that not just typical - surely it would have been just good manners for someone just to drop you a line or email saying that the meeting had happened and they would contact you within xxx days to confirm outcome.

 

Its rude inconsiderate and just plain lazy to make you have to chase yet again.

It appears Andrew Miller was contacted at the House of Commons and told of what we proposed to do.

 

I then received a return phone call from the local office, who informed me that Mr Miller had asked them to tell me that the meeting had been “very constructive” ( read into that what you will, I have).

 

A letter from Stephen Hester and RBS is now being awaited.

 

 

Even the smallest of decent businesses in the UK takes notes of meetings, and if necessary would email within 24 hours. If I was you I'd pester hester to get a response by return.

Hello Sparkie!

 

It is just me, but does anyone else get a queasy feeling when thinking of MPs and bankers getting all close and friendly in the same room?

 

Especially when their meeting ends and it is followed by a deathly silence...i.e. not a squeak of what went on is willingly relayed to you and Paul?

 

I understand Edinburgh is particularly nice at this time of year, I can recommend the Travel Inn, very reasonable and it's nice and central. Make sure you Book an extra Room for all of the Boxes of RBS-Sucks Leaflets.

With journalists breathing down our MPs knecks as well as a legal challenge in the pipeline it's not surprising they are keeping things close to their chests...don't forget this a Government owned bank now.

Edinburgh is lovely, if a bit chilly at times, mind you was only a kid in those days, but had great fun playing on the ramparts of Edinburgh castle, whilst my dad spent a few hours in the Sgts Mess! Oh happy days!

 

Hope you hear something soon........ I'm quite cynical myself these days, where bankers and MPs are concerned.
