Hello there,

 

Are in the the very first stages of claim with HSBC.

Sent off the first claim letter 17th November and no response at all.

Send off this time by recorded delivery second stage letter.

What kind of response can we expect?

 

Has anyone been successful in claiming costs back from HSBC and if so did they close your account?

 

Any advice would be appreciated

Hi and welcome to the site,

You've definately taken the first step into claiming back what's rightfully yours.

 

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

 

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

 

Once you start the process of your claim remember to open a thread in the relative bank forum, this will enable you, and others helping you, to keep track of your claim.

Everyone has been successful. It can sometimes be a drawn-out process but you'll get there.

Accounts sometimes are closed but not often. Because of the possibility, it's worth opening a parachute account, just in case.

 

I suggest that you spend a couple of days reading the FAQs and the step by step guide. That will answer most of your questions.

 

Please open your own thread in the HBSC forum and post any questions and progress reports there. You will be able to draw on the experence of other users who are also dealing with HBSC.

I've sent the 1st letter and then the LBA (14 days later) to HSBC with no immediate response. However, on 23rd Dec received confirmation that they have acknowledged my letter and and that they would reply on or around the 15th Jan. This will be about 2 weeks from the 14 day time limit noted in the LBA.

Should I wait for them to respond or commence with the claim.

Any advice appreciated.

You should commence with your claim. It is you who decides on the deadlines, NOT the bank!!

Stick to your timetable. Don't let them take charge - remember that it's they who are on the back foot.

Yes the next stage is to file your claim. This can be done through MCOL website or through your local court using the N1 form.

Hi your posts moved into HSBC.

The online prompts when doing your claim will tell you if the address is recognised or not.

Its the head office you need to use.

Just got letter from bank offering payment of £2118 against my total claim of £3300.

 

My original letter to bank was for £2,560 (penalty charges) and £379.65 (interest). Just got standard reply off them so proceeded with Money Claim on-line. This included some very recent charges plus 8% interest and £120 court fees.

 

Legal proceedings started on 8th Jan and my letter from bank is dated 11th. Can I assume that the bank have burst into print after they were made aware of legal proceedings.

 

As I am prepared to follow thru' for the whole amount should I write back to them declining theie offer and advise them of the courts having a claim against them (in case they don't know).

Hi Simon,

This happened to me in that the bank replied with a partial offer after I had filed the MCOL - I don't think it's that they have decided to offer you some of your money back because you have started court proceedings but simply that they have a mountain of replies to LBA's that they are just getting further and further behind on.

I actually ignored the letter from HSBC with the partial offer and just waited for DG correspondance / AQ papers from the court (as they filed a defence). It's out of the hands of HSBC now and into the hands of DG Solicitors so if I was you I would ignore the letter (that's just what I did and it made no difference at all as I received a full offer from DG Solicitors......eventually!) and follow your schedule.
