Unfortunately due to Xmas and House Sale I've taken the eye off the ball in helping my wife's claim against Lloyds.

 

Due in County Court on 15th January 2007.

 

I am just looking through the legal stuff again but we have not got our documents together in time for the ' not less than 14 days before the Preliminary hearing '

 

Looking for some advice.

Obviously with a couple of days working on it I could get the documents to the court and to the defendant sent on 2nd January - do you think we should do this?

Should we contact the court and ask for a delay?

This is clearly a penalty charge and NOT a service. It is NOT a service you asked for in any case. Just say something along the lines that you are disputing their claim that this is a service, as it is quite clearly a penalty charge. The courts will pay no heed to their defence as it is nonesense.

sorry its late

to consider:

a. to stay the claim pending a test case

b. to give directions for this claim to be heard as a test case, and if so reallocate to the Multi Track

 

Any clues as to what is likely to happen???
