    • Well we can't predict what the judge will believe. PE will say that they responded in the deadline and you will say they don't. Nobody can tell what a random DJ will decide. However if you go for an OOC settlement you should still be able to get some money
    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I used to have a student and a current account with Natwest, which they closed without my permission when I was out of the UK for over 8 months! I owed £1900 in May 2005 and they agreed for me to pay it off at £20 a month. So I did until June 2006. then the payment defaulted due to human error on my bank's behalf. So Natwest sent the account to the creditors: Capquest. Cap have recently contacted me saying I owe £2500 now or go to court in 7 days. I put them on hold for 7 days. Called Natwest and it turns out the interest was accruing on the account for £30 a month, despite agreeing to me paying it at £20! completely pointless!

 

I have now issued an SAR to Natwest and have given them 40 days from 6/11/06 to respond. I asked for this initially over the phone, and they did not comply. Have sent the cheque for £10 etc. Have also sent a CCA to Capquest to keep them off my back for 28 days.

 

So what happens now? I would be very grateful to hear from anyone who has been in the same situation!

Have now got all my statements back from the last 6 years for 2 Natwest Accounts. Have gone through the charges and interest accrued and they owe me around £1800! I have a Prelim letter all ready and typed but haven't got a clue on how to write a Schedule of Charges! The Spreadsheets look very complicated and not sure which one applies to this one! I need one for interest and charges!

 

I also need to write a letter to Capquest to prove to me that they own my debt! Is there a template for such a thing? Any help would be muchly appreciated!

I have now sent a prelim letter to Natwest with a schedule of charges at interest rate of 0.01% which is what they charged on the account. Am also sending a CCA to Capquest. 12 days for them but how long for the prelim letter?

Interest rate you have quoted isn't right at all, you are quoting the measly credit interest rate for a current account not interest on the charges which is definitely more than that. Hi guyes Am Back,

Guess wat I did send off teh third letter "Letter before Action" and within 5 days i got a reply back from a customer services relations officer stating that this complaint is very complex and that she has passed it on to a sepcialist officer to deal with it.. and on Monday it will be 14 days and i still havent heard anything from them.

So i am now looking on this site to put in a claim to my local court.. but I will wait until Tuesday and see if I hear from Natwest Bank..

I havent ever put in a claim to the court and i really dont know how to do that in any way, form or shape.. and basically the stuff here online i really dont understand everything there. can any one explaine to me what the "AQ" thing is and do i need it to submit the claim in to the bank.

Any help, suggestions for anyone and everyone is warmly welcomed.

Hi there Eastwind,

Try the simple schedule og charges spreadsheet if the others seem far too daunting. There's not much to get wrong on this one.

Don't worry too much about the previous mishap as Natwest will probably send you all the std BOG-OFF responses. Just ensure that you send a corrected schedule with any future correspondence, especially if you actually take them to court.

Make sure you have read everything in the FAQs (and absorbed it) before continuing, it really does help. Any probs then just ask.

Can anyone advise on what to do? I sent the prelim to Natwest 14 days ago tomorrow and have the LBA all typed up and ready to go. The only thing I've received is acknowledgement of the letter and another one saying it's been passed to a different department and they will respond by the 4th January. The 14 days is up tomorrow so shall I send the LBA tomorrow or wait until they respond by the 14th January? Any help muchly appreciated!!! :!:

Remember Natwest are now working to your timetable. So ignore the prevarication.

My advice has hardly any legal foundation whatsoever, however you never know it it might just work!

Hi guys! Natwest have until this Friday to respond to my LBA. the only thing they have sent was a letter saying it's been passed to the customer care team and will be responded to within 10 working days. the letter was dated the 5th and arrived today, the 9th! Do you reckon they're backdating!

 

anyway, I just wanted to get an idea of what i do now? do I have to file a court claim this Friday?! or shall I wait for them to get back to me within '10 working days'!

 

any ideas most welcome! thanks! x:confused:

Do not delay by even a day, you are dictating the pace now so crack on. You are about to begin the legal process, and it is a significant step to file a claim against a multi national financial coporation. Therefore make sure you have correctly prepared your schedule and calculated your charges and interest. The more professional you are the more certain you can be of the correct outcome.

Have you managed to file your claim, yet? When you first joined us you had problems getting to grips with the schedule of charges spreadsheet, is everything ok?

To be honest I still haven't figured out how to do the spreadsheet properly and am not quite sure how much interest to add prior to court stage!

 

Their deadline was Friday so I am going to be typing up the list of charges and filling in the court forms tomorrow plus the 8%.

 

Do you think I should change my original schedule of charges now and see if I can work it out, or just stick to what I've done and just add 8%?

 

Any tips would be greatly appreciated and thank you so much for all your help so far!

I haven't tried any other spreadsheet other than the one you saw I think at 0.10% interest. The thing is, in my letters I have claimed for the list of my charges, detailed in the spreadsheet, plus around £511 which they subsequently charged me in interest, not included on the spreadsheet. All the interest was accrued after the account was closed down and they were trying to find me.

 

Also, with the 8%, do I simply times the whole amount i.e. £1862 including interest by 8%?

 

My god this maths bit is confusing! Don't want to mess it up though! I have heard of lots of people largely increasing the amount of their claim when they add this 8% for some reason. But this only increases mine by about £140! Hardly seems worth it!!!

Dont apologise honey, it's all rather confusing at first:)

 

I haven't seen your spreadsheet, must have confused me with someone else. I think it might be in your best interest to try and get to grips with the simple spreadsheet found in the templates section, if you can. In the long run I think it will really help you and save you a big fat headache down the line.

This spreadsheet is indeed easy, you simply enter the details of each charge, the amount and date in which the charge occurred, it then works out the 8% side of it automatically. No real maths or complicated workings out necessary..which has got to be a bonus!!!!

 

Yes you can amend the amount you wish to claim right up until the point of submitting your claim through the courts, make sure though that this doesn't make your claim longer than the 6 year limitation.

Thanks very much for that Muggins! Have just been beavering away filling in the schedule of charges and it was indeed nice and easy! Someone sent me another one initially which was very confusing!!

 

Have done a seperate schedule with a list of the interest charges as well which brings the total to £2223. So just the N1 to fill in now and I shall be going to file the claim first thing on Monday! Oh maybe second thing on monday! AM going to have my contract terminated at work so will have no job and no car! Yey! Here's hoping NAtwest pay up!
