Please don't do anything at all – in particular don't send a letter of claim – until you have done all the reading and I would suggest that probably you will start drafting your letter of claim over the weekend. Also, you haven't told us anything about what has happened. We don't know dates, items dispatched, value, whether they were properly declared, whether you bought so-called insurance, you have been declined reimbursement but we don't know why. If you want us to help you then you will have to give us this basic information. Also the fact that you are an eBay trader makes this slightly more complicated although it doesn't at all affect your chances of success.  Read the other threads on this sub- forum – and especially the pinned threads at the top in order to understand the principles. You also quickly understand the kind of help that we will give you and you will understand some of the draft documents which have been used in other successful claims.
    • Thanks, I'm finishing up the skeleton and hope to have it done today. Will look at statement of case too and get that done over the next few days.
    • But, but, but... They've already sent you a letter of claim, which said... "Should the outstanding balance not be settled by 20/04/20204 we will commence legal proceedings against you without further notice." 🤣 🤣 🤣

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

Based in scotland and being constantly harassed by Lowell ie calls and letters. 

They are chasing me for £1150 credit card debt.

I am at my wits end on how to approach and deal with them.

I took early retirement 2 years ago because of severe mental health issues which were affecting my daily work routine. 

I am 60 years old and a homeowner without a mortgage

any help would be greatly appreciated.

Someone will be here to advise but in the meantime please add more information.

Was the debt actually yours?

When did you contract it?

When was the last time you made a payment against it (if any) ?

Whilst I'm sorry to hear about your Mental health, it probably won't be a factor in this, not at first. Stick to numbers and dates for now.

Unfortunately Lowell won't give a toss about your mental health and wellbeing.

You should ignore them *totally* until you get a letter of claim (this will usually come from Overdales, who are the same people just in a different part of the building). Then come back here and we'll deal with it.

I do hope you're able to make some small steps towards a more positive outcome re: your mental health though.

you say this was a credit card?

who was the original creditor please?

and have you moved since taking this card out and never informed the OC?

a DCa is NOT A BAILIFF

and have 

ZERO legal powers on ANY debt - no matter WHAT it's type.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

As Lowell are now the owner of the debt you should write to Lowell informing them of your new address.

Can be as simple as "Please note that my current address is xx"

Quote your reference number at the top.

Protects you from backdoor CCJs, as they're quite legally entitled to send a court form to your old address if that's the last one they officially have on file. Grabbing your current address off a credit report is just them getting lucky to have reached you normally :)

you must must write.

and do the same to any other debt owners of any old debts you last used or paid within say 7 yrs.

you are in danger of backdoor CCJ's that you might not know anything about until court bailiffs appear at your door
