Hi all,

What a fantastic resource this website has been! I'm looking for some advice. My situation appears very similar to lots of other people's experiences. In brief:

I sold something on eBay, paid for fully insured postage on Packlink via DPD.

The item then spent about 3 weeks moving around but sitting in a delivery depot for 10 days.

I phoned DPD during this time but they refused to discuss it with me stating that I was not the sender, it was Packlink.

I then raised a claim with Paclink who would not investigate as it was not within 28 days of my buying the postage - I explained to them that it was not within 28 days because the parcel was still moving and trackable for over 3 weeks and so I didn't know it was lost.

They didn't care and said they wouldn;t discuss the matter any further.

Obviously if Packlink were in the UK I'd take them to small claims court directly, but as they're not, I suppose the easiest course of action is to take DPD to small claims court, citing right of third parties act?

DPD do not have an email address and so is it best I just post them an LBA and then start proceedings? They're arguing they don't have a contract with me, all the usual stuff, but obviously this is all verbal communication and not documented. 

I'd be very grateful if someone can confirm an LBA is the best thing to do now.

Before sending off anything, please read as many of the stories as you can on this sub forum in a couple of days. Not only DPD but also EVRi and the rest.

This will help you understand all the principles.

there are numerous threads here regarding DPD, but you'll need to fully understand your 3rd party rights contract.

but they are your target yes.

you'll need to write a letter of complaint first

their address to write to can be found on the court claimforms in dpd claimform threads 

dont rush red up lots first.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I hope you have been reading up on the stories on this sub- forum as we have advised. If you haven't then you won't really understand the principles. You won't have the confidence and you will keep on asking us questions which for us are obvious and the answers to which are already in the stories contained on this sub- forum.
This is a self-help forum. We guide you all the way that we want to know that you have done your bit.

What was the item?
What was the value?
Was the item and its value correctly declared?


You have referred to the rights of third parties act so you are busy have done a bit of reading. Have you made a written complaint to DPD? Have you had a written response?

Incidentally, even if Packlink were in this country, the requirement that you report within 28 days would not be an enforceable term. Once the breach has been committed then you have six years to bring an action.
We don't really understand why Packlink is registered in Spain. It was registered in the UK and then suddenly moved over to Spain for no apparent reason.

Pardon my scepticism that this was done in order to try and make it more difficult for people to get their money back when their items were lost or stolen or damaged.

Yes, I have been reading the other threads and understand that I need to cite the right of third parties act against DPD. My communication thus far with DPD has been over the phone and over email with Packlink. I will now send a complaint by post to DPD's headquarters.

The item was a coffee grinder, worth £150, which I paid for insurance with via Packlink. The item and value was declared correctly. I would like to drag Packlink through the mud but it seems it will be yet another instance where they get away with it. I too am sceptical of their move out of the UK.
