Bank has the same deadline as you.

 

Usually what happens next is in about a month the court will issue directions, these should include a trial date, when and what documents have to be submitted and allocation to a track.

 

As I do not have a HSBC claim, I cannot comment on what they may do in terms of settlement.

Yes the bank will have the same deadline. What usually happens now though is that they miss the deadline and the judge gives them a two week extension!!! Not fair I know but that is how it works at the moment.

i think you could ring and say - i'm calling on my father's behalf to find out the status of this claim # xxxxx. could you ring from his so if they want him to verify that it's ok to discuss it with you he could..... i do this with my mother'in'law when ringing the council for anything.

Got a letter from the court Tuesday and the final deadline is today.

 

Problem is my father is away for the weekend, so is it okay to leave it and phone them on Monday to see what has happened?

you can wait for the paperwork - probably the aq will be dispensed with - it is in most cases now - so - then try another nudge - time to get dg to make an offer. if before you said you have not submitted your defence - now it's i see that you have now sibmitted your defence - along the same lines - emphasizing how you are trying to resolve this to save the court's time.

Have had a letter from DG today, with a pitiful offer (less than old Langdale offered).

 

They are still disputing the charges, saying some of them don't exist and they've disappeared from online banking but we have paper statements with them on. Someone isn't playing fair...

 

They've also said:

"We are at a loss to understand why you have sought to recover, what appears to be overdraft interest from our client, and in addition 8% interest per annum upon the interest. Please confirm the basis of your claim from our client of what would seem to be overdraft interest applied to your account."

Blah blah, interest rates are advertised. So they won't refund it

 

Now what do I reply?

they are absolute [edit] stick with it- they try to make you think that you have got it wrong and dont know what you're doing every time.

Continue with your claim againsy them - bet they settle (eventually) in full :)
