    • Oh I see! thats confusing, for some reason the terms and conditions that Evri posted in that threads witness statement are slightly different than the t&cs on packlinks website. Their one says enter into a contract with the transport agency, but the website one says enter into a contract with paclink. via website: (c) Each User will enter into a contract with Packlink for the delivery of its Goods through the chosen Transport Agency. via evri witness statement in that thread: (c) Each User shall then enter into its own contract with the chosen Transport Agency. Packlink does not have any control over, and disclaims all liability that may arise in contracts between a User and a Transport Agency I read your post at #251, so I should use the second one (and changing the screenshot in the court bundle), since I am saying I have a contract with Evri? Is that correct EDIT: Oh I understand the rest of your conversation. you're saying if I was to do this i would have to fully adjust my ws to use the consumer rights act instead of rights of third parties.     • First, those are the wrong terms,  read posts 240-250 of the thread ive linked to Second donough v stevenson should be more expanded. You should make refernece to the three fold duty of care test as well. Use below as guidance: The Defendant failed its duty of care to the Claimant. As found in Donoghue v Stevenson negligence is distinct and separate to any breach of contract. Furthermore, as held in the same case there need not be a contract between the Claimant and the Defendant for a duty to be established, which in the case of the Claimant on this occasion is the Defendant’s duty of care to the Claimant’s parcel whilst it is in their possession. By losing the Claimant’s parcel the Defendant has acted negligently and breached this duty of care. As such the Claimant avers that even if it is found that the Defendant not be liable in other ways, by means of breach of contract, should the court find there is no contract between Claimant and Defendant, the Claimant would still have rise to a claim on the grounds of the Defendant’s negligence and breach of duty of care to his parcel whilst it was in the Defendant’s possession, as there need not be a contract to give rise to a claim for breach of duty of care.  The court’s attention is further drawn to Caparo Industries plc v Dickman (1990), 2 AC 605 in which a three fold test was used to determine if a duty of care existed. The test required that: (i) Harm must be a reasonably foreseeable result of the defendant’s conduct; (ii) A relationship of proximity must exist and (iii) It must be fair, just and reasonable to impose liability.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Wasn't sure where this should go, please move accordingly.

 

I want / need to change my name.

Some mods here will know the situation I am in, well if you do that guy is getting very passive aggressive and I have had to press charges with the police as he is continuing to harass me at 9pm at night with emails and texts and now has my full name since when the police messaged him they used my full name, great. He has been threatening to use a tracing agent, and I have met this guy and he looks like no nice guy, I don't trust him.

 

I will be moving house in 2 weeks anyway, planned for some time now, and when I do I want a fresh start so this evil man can not possibly find me.

 

Can someone advice on name change by deed poll, the .gov site is useless, no concrete steps to take.

 

Does't even sem to be a central body to go to? I found this site? Is it legit?

Yes, this guy is not sane, he is evil in my opinion, I can tell from his threatening emails. He is slightly psychotic - emailing me at 9/10pm ay night "I won't stop till you pay me back".

 

 

I just can't take that risk, I need peace of mind. Police calling me today to take a statement I think, I had to press charges as he had a text from the police to not harass me any more, and lo behold 7 hours later he's at it, and then relentlessly.

 

The .gov site is useless... Just gives you a kind of copy paste thing, but does not tell you what to do..

A deed poll recognises a change of name of an adult or child - make your own, use official forms, or get one through a specialist agency or...

 

I am reading in places it costs £42, but .gov mentions nothing.

You are entitled to change your surname any time you want and without any formalities. However it is better to register it. There is some system of registration but I'm not sure how it works or where you will find it.
This will allow you to satisfy various authorities for passports et cetera.

Deed poll only refers to your given names. They need to be changed by deed poll.

That's about as much as I know about the subject.

There is no clear direction on how to chnage by deedpol?

If I just chnaged my surname all I have to do is choose it and call banks, dvla, council etc and just tell my new surname? Seems odd?

Just checking, but how is this person harassing you? Is it by emails and text messages?

 

If so you can block the emails and text messages easily enough or change your email address and phone number which has to be easier than changing your name?

I want to chnage name because he is threatening t use a trace agent, and I do not trust this thug as far as I can throw him. He's a grunt. I have to consider my own wellbeing now.

I spoke to DVLA on the phone, seems simple enough, they just asked for a deedpol certificate... but back at square 1, where does this magical certificare come from?

Seems to be no advice, just loads of scam companies online using HM logos.

Use the following wording:

“I [old name] of [your address] have given up my name [old name] and have adopted for all purposes the name [new name].

“Signed as a deed on [date] as [old name] and [new name] in the presence of [witness 1 name] of [witness 1 address], and [witness 2 name] of [witness 2 address].

“[your new signature], [your old signature]

“[witness 1 signature], [witness 2 signature]”

A specialist agency or a solicitor can make the deed poll for you instead - they may charge a fee.

After you’ve made it, you can use your deed poll as proof of your new name.

Right   - Some progress...

So there is no central agency who handles deedpoll, just a rag tag bunch of private companies who act as intermedieries.

It's just a case of choosing the best one.

 

The copy and paste info from .gov I posted above is like a lick of the stamp, does nothing, you need an 'official' cert by an 'official' company who probaly have some special gold stamp or something!

@mrk1 you say that the gov.uk site doesn't  say how to do it but this page gives you detailed instructions and the forms to use.

I'll bet that the company you are going to pay £33 to is just going to send you these. Which are free on gov.uk.

 

You also say that the £44 fee is not explained on gov.uk. But it is clearly explained as far as I can see. There is a difference between an "enrolled" and an "unenrolled" deed poll.

 

"Enrolled" means registered with the High Court. The court fee for enrolling a deed poll is £42.44. It is then on the public record.

 

Do some organisations insist on an enrolled deed poll? Banks? If so it will be on the public record anyone can find out your new name.

 

I agree with others that this seems a very convoluted way to deal with harassment. If this guy doesn't stop the police will eventually arrest him.

 

And I very much doubt that changing your name will prevent a trace agent finding you.
