    • Hi I was caught shoplifting 4 items £20 worth, I’m petrified the Police will come to my house now please can you help. What can I do I worried about my job. 
    • I heard nothing more from J&P but have now had an email from the bank saying they have instructed IDR to act on their behalf?  so are they just passing it back? Selling it on again? I don’t know if this is a good or bad thing 
    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got my notification through from the court today, will be deemed served tomorrow and the have until the 15th March to respond.

Recieved letter from local court today informing me that Cap One intend to defend the whole claim, they were deemed served on the 1st so they have til the 29th to file defence or settle in full. Just got to wait for a letter from them now with their improved offer.

Interest from them would amount to another £800 so am tempted to just let it expire. would make my life much easier though if Lloyds GOGW £750 was to go into my account as promised.

tezviper, just to update you, have not filed court claim yet although it is ready to go, had to ring cap one with a few questions about default and after a bit of discussion with colleagues they have told me they are removing default. So while I wait for proof of this (should be this week) I have postponed court claim on jonni2bads advice as it will obviously make my claim much simpler, but as soon as I have seen it off my credit record it's off to court I go.

In reply to your question doo, no they weren't for the halifax credit card, just normal accounts. Can I have the number you rang please so that I can speak to someone there about the default removal. would be good if I could get mine removed even though have filed at court already.

Firstly I rang Debitas as the account was with them just before default stage and wanted to recheck dates, it seemed there was a discrepancy in the dates and I had paid, but try this number 0845 2345151. If not try the cap one number 0800 9524914 as they are now dealing with my default removal. Good luck and put a post out to let us know how you get on.

Well, as expected I got my letter through today, telling me they have investigated my claim ( blah blah blah ) and that charges are levied when I breach my contract etc!!!!!!!!!

But as a GOGW they have cleared the balance on my credit card and are sending me a cheque for £270.

As i expected there is absolutely no mention of the default removal that is part of my court claim so I wont be contacting the court to cancel my claim as they have not met the requirements of the claim.

Nice to know I am getting somewhere now though.

 

Just to add, my missus got a call from mint about her CC with them they decided to call from a witheld number and wanted to ask her some security questions. Good thing I have advised her not to answer security questions in that situation and so she refused to answer and explained to them her reasons for doing this, and her response was " you will be hearing from our solicitor then!" and they slammed the phone down.

tezviper, don't accept the cheque, tear it in half or whatever and send it back with rejection letter, I'm sure you have followed Tanz's thread so follow his lead. Good luck

Thats the plan mate, Am going to call them on Monday morning to test the water but have already put rejection letter together using the template I got from Tanz's thread.

Save you searching for my thread I'll give you update. Default has now been removed (just) so will now be submitting my claim, have POC ready (just finalising it) then it's all systems go.

 

Tanz is full of great advice and information, he fully deserved his result let's hope yours will follow shortly.;)

Cheque arrived today, but I will be hanging onto it for a few days as I have already sent my letter to them rejecting the offer as it doesnt completely satisfy my claim as there is no mention of the default removal.

I write in response to your ‘settlement offer’ letter dated 22ND March 2007 and acknowledge receipt of this.

 

I reiterate that my claim is in 2 parts and they are intrinsically linked.

I thank you for your attempted settlement, but since you are unwilling to see the correlation between the unlawful charges imposed on my account and the subsequent default notice, I must inform you that I do not agree to the settlement offered and my claim will continue through the courts.

 

I am confident of my position and believe that I will be able to show a Judge that I was never lawfully indebted to you by the amount that is shown on the default register, or at all.

 

At the time of the default notice, you had imposed £600 in unlawful penalties. By offsetting this amount against the actual balance of the account, my financial position would have been a positive balance of £33 thus the information passed to Credit Reference Agencies was inaccurate.

 

Clearly I have no power to stop you from crediting my account, but I wish to make it perfectly clear to you that your actions should not be interpreted as an agreement on my part. Hiya, the money they have offered to pay is it for the full amount claimed with contractual interest? Hopefully this letter should grab their attention - have read a few threads on here lately where they have removed defaults so hopefully yours is next, keep us posted.

 

Eventually filed my N1 am now waiting for it to be served.

It is full settlement for all money owed including interest and court fees. They just failed to mention the default, possibly an oversight but \i doubt it. Hopefully the letter will do the trick. Shame they dont have a contact number for that dept. I would have liked to have spoken to someone.
