    • So as I stated, I posted my letter off but over 2 weeks later I've had a visit from one of their reps. I didn't indulge him in any conversation, and I just stated that any such debts are statute-barred and closed the door on him. I was hoping they'd take notice of the letter. Where do I go from here? Thanks
    • I apologise if I was being unclear. Where it currently stands is that they will have it repair, placing scaffolding in our garden for 5 days. They have moved fast, but we will still have to postpone our contractors, meaning, we won't necessarily have the work done in time for the wedding and therefore will incur additional expenses for either a marquee or a wedding venue. They are vehemently against having any kind of liability in any regard but continue repeating that they are legally entitled to use our garden for their repairs (I believe this is true unless the work can be carried out using a cherry picker). The neighbour seems either indifferent or oblivious to the fact they can't reach all of the side of the roof from the space where they can place the scaffolding. They have asked their roofer of choice about using a cherry picker but the roofer has said it wasn't possible. It's not clear whether the roofer doesn't want to use a cherry picker or whether there is an issue with it. They have told us it is a problem that we are installing a gazebo as it will prevent them to access their roof from our garden in the future?!?
    • Couldn't agree more, really wanted a true ruling on this just for the knowledge but pretty sure the Judge made some decisions today that he didn't need to?.. maybe they all go this way on the day? We hear back so few post court dates I'm not sure. Each Judge has some level of discretion. Their sol was another Junior not even working at their Firm, so couldn't speak directly for them! that was fortunate I think because if she would have rejected in court better, she might have  been able to force ruling, we are at that point!, everybody there!!, Judge basically said openly that he can see everything for Judgement!!!  but she just said "I can speak to the claimant and find out!" - creating the opportunity for me to accept. I really think the Judge did me a favor today by saying it without saying it. Knowing the rep for the sol couldn't really speak to the idea in the moment. Been to court twice in a fortnight, on both occasions heard 4 times with others and both of my claims, the clerk mention to one or both parties "Letting the Judge know if you want to have a quick chat with each other"! So, it appears there's an expectation of the court that there is one last attempt at settling before going through the door. So, not a Sol tactic, just Court process!. Judge was not happy we hadn't tried to settle outside! We couldn't because she went to the loo and the Judge called us in 10 minutes early! - another reason to stand down to allow that conv to happen. Stars aligned there for me I think. But yeh, if the sol themselves, or someone who can make decisions on the case were in court, I would have received a Judgement against today I think. She was an 'advocate'.. if I recall her intro to me correctly.. So verbal arguments can throw spanners in Court because Plinks dogs outsource their work and send a Junior advocate.
    • that was a good saving on an £8k debt dx

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

One of the respondents in oaksh*ts thread I think

She of course seems to be simply trying to claim lockdowns were wrong - rather than the actual facts that the methods and requirements of the implementations were mismanaged and incompetent, and that prior failures made the requirements more urgent.

(as detailed in the closed mutating virus thread)

Shes even spinning the leak

Jacob Rees-Mogg had a Covid test for one of his children couriered to his home by health officials at a time when there was a testing shortage.

An initial test for one of Mr Rees-Mogg’s children had been lost by the laboratory, prompting Matt Hancock’s special adviser to organise a courier to deliver a new test that night, wait for the child to take the new test, and then take it directly to the laboratory.

Two days before the test was personally delivered to the Rees-Mogg family home, the director of testing at NHS Test and Trace had been forced to issue her “heartfelt apologies to anyone who cannot get a Covid test at present”.

Reports at the time suggested a backlog of 185,000 tests waiting to be processed on September 11 2020, the day after the test was couriered to Mr Rees-Mogg, who at the time was Leader of the Commons.

I see Lineker has compared the UK guvernments small boat intentions to the Nazis pogroms of the 30s..

... which as expected has quickly raised complaints and condemnation from a handful of Rottenführer, Anwärter and poopmeisters.

The BBCs Oberjunker is understood to be checking Linekers antecedents and requiring him to understand his oaths of allegiance to the BB-Creed.

" The BBC reported that while Lineker was not bound by the strict social media policies of BBC news and current affairs staff, the director general, Tim Davie, had discussed the issue of his comments in the past and it was understood he would be reminded of his responsibilities."

I see Rishi and Suella have upset all the right people, must be a vote winning policy then

Tory deputy chairman Lee Anderson told MailOnline: 'Yet again Gary Lineker has been allowed to kick about vile and baseless accusations, and the public are sick to the back teeth of it. It's time to tackle this woke crisp salesman and hold him to account for the nonsense he spews.'

Former minister Robert Jenrick said: 'My children are the grandchildren of Holocaust survivors, and I think those sorts of words should not be thrown around lightly. Gary Lineker is paid for by the British taxpayer. And it's disappointing that he is so far out of step with the British public.'

The BBC said earlier today that Lineker would be 'spoken to' and 'reminded of his responsibilities'.

Seems its Tory Poopulist policy on everything - goals that way .. but kick the ball into the long grass or we'll lose

Even this latest version of the withdrawal protocol is little different in real terms to Truss' apart from the backstop

- and the backstop was only there in case the UK didn't implement the systems - we had some years on trus't (sic) where trade continued largely avoiding the situation we are now in

and aside from Sunack getting it through parliament (almost a certainty) without imploding his party (thats the real question), sunck still has to implement the systems and NOT trash the oversight (the other real question)

- which they clearly didn't believe they could - or even want to try with Truss' version.

So the 2/3 cores of implementation are still ... nowhere.

Ah, some good news starting to be reported at last

GB News records £30 million losses from a little over  £3 million revenue

"The broadcaster paid more than £11 million in wages (3x its income) and salaries to its staff during the year,

many of who include Conservative MP’s who have been given platforms to present their own shows."

Its directors were reportedly 'satisfied' with the above.

Perhaps they are just trying to make the BBC look good eh?

Effective way for them to get paid to put out 'opinion' that even Con Central wont allow.

Bad news for you Jugg is that GB News has secured substantial new funding from new investors

Meanwhile returning to what actually matters

The Labour leader, Sir Keir Starmer, is quite wrong to say that the BBC has 'caved in' to Tory MPs. Sensible BBC managers recognise that Mr Lineker has gone too far and they cannot just do nothing.

Sir Keir should imagine (admittedly it is hard) the rise to stardom of a brilliant and charming footballer with strongly conservative views, who eventually comes to present a premium primetime programme.

He should imagine such a person gaining nearly nine million Twitter followers as a result, and using this platform to excoriate Labour's long years of failure to control immigration, and indeed its long years of actively encouraging it.”

so then @theoldrougeyour support of free speech only reaches as far as supporting anti-vax liars rights to promote anti vax lies which are easily proven as lies or at VERY best disinformation,

.. and you don't support free speech when its a REAL persons quite legitimately and honestly held and  long time supported (by actions) views on a subject?

I think that rather defines you and those like you.

So, Given Lineker was quite conservative (in the traditional sense) in his statement,

and it has been reported that Lineker had been told by the BBC that there would be no further action ...

Which do people think occurred:

1. The poopulist guv intervened to pressure the BBC to censor Lineker in a rather Russia/Iran manner

2. The Tory pals shunted into positions of power in the BBC decided off their own backs to attempt to censor Lineker

Given the reported prior decision by the BBC of 'no further action' .. gotta be the former hasn't it?

and also given that "BBC Chair Richard Sharp is under pressure for failing to declare his involvement in facilitating a loan for former Prime Minister Boris Johnson shortly before he was appointed to the role. "

Former BBC chief Greg Dyke warned on Saturday that "it looks like - the perception out there - that the BBC has bowed to government pressure"

ROFL Cheered me up no end that you are upset about paying toward Linekers wages

re GobNews:

Given the massive fees and albeit rather limited platform given to right wing ministers to promote their own views and the simple fact that other than right wing sponsors are extremely limited

one could be forgiven for thinking  that GoBNews is just a way to route more funds and give a whistle to the CON artists from their few donors and promoters bypassing other  limitations and requirements.

So @oldrouge you haven't told us yet why you dont rail against  much more obvious real conspiracies

like

* bleach as a covid treatment asmong other real issues

* Blatantly OBVIOUS RT'esque Political interference in a public funded  'National broadcaster  (which they are crapping themselves about LOL)

Little history lesson for lefty’s

The real problem with Gary Lineker is that he knows as much about politics as I know about football. But, while you will never catch me giving my opinions on soccer, Mr Lineker thinks his TV and advertising fame qualifies him to discuss politics and history.

Actually, it is amazing how little so many people know about these things. Although modern school history seems to cover nothing apart from the wives of Henry VIII and Hitler, nobody seems to know one crucial fact. The Nazis were very left-wing.

.. Which you ARE clearly bereft of

For info

Just because they called themselves National Socialists or whatever doesn't mean they were or are

.. rather like the claims of Stalin, Mao or Johnson

- all just wannabe dictators - JUST some more successful than others.

Fascism is a far-right, authoritarian, ultranationalist political ideology and movement,[1][2][3] characterized by a dictatorial leader, centralized autocracy, militarism, forcible suppression of opposition

So why dont we see you railing against real conspiracies @theoldrouge

* Like Trumps claims about bleach

* Like the Tories routing 100+ million to 'Moneys firms and  that having to be exposed by journalists while the poops were denying anything was wrong

* Like the Tories sending a Hercules to Turkey for (worthless) PPE they lied about ordering when journalists exposed the lack

* like  the uk GUV  politically interfering in the BBC as if it were RT

* like the UK guv implementing suppression of  rights of protest

* Like the UK guv putting laws into the hands of ministers rather than  Parliament or the courts

Perhaps referring more directly to the title of this thread, and for those who have been following the US Silicon bank collapse and the fallout in other nations including the UK

The following is PRECISELY what the UK conservatives are doing, deregulating the financial institutions putting them back on the platform they were on before the financial collapse.

Perhaps worth noting hat Biden has said the US taxpayer will NOT carry the can (directly) and that the banking systems will carry te cost and the directors fired if its within his power to to it in the US

Likely certain that won't be the case in the UK.

NEWREPUBLIC.COM

This is what happens when you deregulate checks on financial institutions.

Wonder how much the UK taxpayer is funding the HSBC 'takeover' of the UK arm?
