    • 4 hours were soft play with the kids then moved to one of the restaurants for a meal. Restaurant took ages with our order but it was a group of parents so we were in no massive rush.  Ive been trying to find how to determine 100% if the road is public or not as I just based my assumption on the street signs, traffic lights and the bus. Regarding the PCN, does it covers all requirements needed to enforce or do you guys see any clear weak spots? Considering the size of the place and different areas and businesses reachable through that road where the cameras are, I believe is a massive assumption to use those photographs to calculate the time someone was actually parked in a designated parking spot as there are numerous other areas to load, unload, wait for people, drive throughs of restaurants, etc all within the area accessible through the one road where the ANPR is. One can go through most of the areas on street view in google. You can even see a car parked in the middle of the roundabout for example.

    • Incidentally, congratulations on not buying the warranty. That is another Big Motoring World rip-off. See what we have to say about extended warranties and the Big Motoring World attitude to them is particularly unhelpful
    • well that google is from 2019, but the photos are certainly of someone driving on the public highway in/out by an ANP system, though the site of where the camera actually is, is not showing there are anpr cameras up by the low yellow barriers but they wont get from facing shots from there. interesting, needs to be checked if the road IS a public highway but on private land, cause as you say, if the whole area is max 4hrs , how does the hotel work< ?? must have a reg entry system.  now as for taking pictures of cars on a public highway then guessing the are parking ...erm.... i dont thnk thats right nor allowed under GDPR. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It was worth a try though. I would also have called. Perhaps you should add this into prelim saying something like how disappointed you are they want to dance to the same tune again (particularly as you are now a hardened veteran, hee, hee). Sally

Hi, I've been reading your thread and your mission to reclaim your charges from the Halifax, congratulations on getting your money back off them!

 

I'm mid way through trying to do this and would really appreciate your thoughts. It got off to a shakey start but I've now I've finally had my statements and sent off my first letter (the LBA I think!) I've got the same letter you initially got back something along the lines of 'we're sorry to hear about your complaint blah, blah, blah' then they go on about not having to do anything for 8 weeks but I might hear back from them in 4 if I'm lucky.

 

Would you wait for the 4 weeks or after the 14 day timescale that I originally gave them, then send out my second letter?

 

Any help you could give me would be great!!!

I have now sent another prelim to Halifax -- I didn't send the one in March, but have since had another couple of charges :mad: .

 

I amended the prelim to say that I had already been refunded, so we are both fully aware that they do admit to their charges being unlawful or they wouldn't have refunded me (well words to that effect). I've requested a direct payment to my account within 7 days (I'll send the lba after that time). Lets just see what happens!!!! I've also requested they do not close my account as this would be seen as taking "retaliatory action" against me, and that some financial organisations had been fined for such behaviour!

 

I await a response :)

Have received a standard "declining your complaint" letter this morning. They've obviously changed their stance since the beginning of the year!!!

 

Will send off the LBA tomorrow. How far are Halifax taking it now --- they settled in full with me the last time at the deadline of the LBA, but they'd not declined me, they'd already made an offer!!

 

Oh well, off we go again!!!

I've just prepared my prelim for the second batch of charges- mostly saying, thanks for paying up, I've found another four charges not included in my court claim, so pay up, because you KNOW I'll take it all the way if you don't.

 

See if that works.

i am at the stage where i have filed my MCOL claim and sent the details of charges off to the court and now i am waiting for Halifax to lodge there defense. i am hoping to high heaven then dont so i win £4,500 by default. fingers x'd!

Hello all ... apologies if this is in the wrong place, I'm a bit of a technophobe and can't figure out what's going on (Doh!)

 

Anyway, just to introduce myself to the site. My and 'Im Indoors only decided to do this a few hours ago after discovering we had been charged a £30 fee for a £1.20 card payment which took us over the O/D limit. I think it was payment for a butternut squash in tesco - a £31.20 butternut squash! :-o I can't get my breath ... it's all out war. Our only reservation is that our lives are in the hands of Halifax - our mortgage, credit card, loan, bank accounts etc. What will become of us?!

 

p.s. please someone point me in the right direction if I'm in the wrong place

If you see in the main Halifax section, there is a new thread button at the top, so you can start your own thread for your specific claim.

 

That means you can ask everyone for help, and keep us updated on how you're doing.

 

It is advisable to start a parachute account- an account with a different bank, in case the Halifax get nasty. But if they have a chance to keep getting more money off you, they will keep your custom.

 

Plus, they haven't been closing accounts recently- and the FSA are frowning on them at the mo.

I've faxed back an LBA, to the number on the original decline letter and I've proof that is has been sent OK. I've given them 7 days - they replied to my letter in 2 days, so that is sufficient I believe, given that they've already been through this with me once before!! Watch this space ........

I would also send them a hard copy of the letter by recorded mail. I've seen them deny getting letters before, but they can't argue with a signature from the Royal Mail.

I've just rang the Halifax to check that they received my Fax OK - I had confirmation that it had gone through ok, but wanted to know that they had it - they have, it's on their system. Let's see if I get payment by Wednesday .....................

I'm not expecting the amount to be credited, but I gave them the 7 days that they give me when they take the charge out -- given that I faxed the letter it got straight through to them.

 

However, if the money's not there on Wednesday, I'll ring and say if they don't put it in I'll be taking them to court :eek:

 

They were quite good the first time I claimed, but it looks like they've changed their stance since then!!

 

Will keep the post updated and see what Wednesday brings

Hi - i've just spoken to a really nice guy at Halifax Customer Complaints. He was really happy and polite and just sounded too nice to be working in such an environment!!!!

 

Anyway, he says that according to their timescales they have until 19 August to respond. I said that the LBA deadline had expired, but as I was going on holiday on Monday, I wouldn't be proceeding any further until I returned (31 July). He gave me his name and said if I'd not got a response by the time I returned, to give him a ring and he'd sort it for me.

 

Looks like I hopefully won't have to go through the court process -- fingers crossed x

Have just got back from hols and have received a second letter from Halifax confirming they won't be refunding charges. However, the nice guy I spoke to before I went away told me to ring when I got back from my hols. I'll try ringing him later today, although I now think, the battons are down since the announcement of the OFT and the court case against the banks!!

 

Will report back later after the phone call!!!

Hi All

I am trying hard to get my money back from Halifax but little reply to my thread. Just waiting for an outcome as they stated they intend to defend the claim so I am waiting to see what their defence is before i submit a bundle to the court as its all up in the air with the test case coming on the scene.
