    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I have received my statements now (it only took a week) and they are all in order.

 

I am sure i know exactly what i can claim back off these statements - However there is one thing I am not sure of.

 

On my statement for example:

 

Charges 6th Oct, AC:******** £6.00

Charges 6th oCT AC:*********£14.00

 

Charges 29th Aug AC:********£26.00

 

There are loads like this for different amounts over the years, but it doesnt actually say what they are charges for.

 

Can i still claim these?

I'd also urge you to change to a regular current account unless of course you feel you're getting your money's worth from the AG (it seems most people don't).

Its actually just a standard current acount.

 

Most of the charges are more or lest spelled out - ie referral charge, card misuse etc.

 

But i have found quite a lot that dont have any explanation just "Charges"....

ranging from around £6 up to £38

And they all seem to happen at the end of each month.

 

Thanks for the link I read it earlier but couldnt seem to find the answer.

 

Do you think i should just try to claim them?

I can only answer as I understand it for an advantage gold account, but I expect that it will be similar for any account.

 

£12 is the monthly charge for running the account, there will also be an interest charge, all the rest is reclaimable fee's

 

The £12 will be lumped in with other charges if any so might not be obvious.

if its astandard account claim everything as the only thing u cant claim is a service charge - i.e advantage gold fee and u aint got one!!!!!!

NatWest (CLAIM 1) - £2181.24 SETTLED IN FULL

VIRGIN MBNA - £377 SETTLED IN FULL + INTEREST

NATWEST (CLAIM 2) - £1008.30 - SETTLED IN FULL

Embo- I have the answer and it isn't advantage Gold but unarranged borrowing. I have some links on my signature one which is charges throughout the years since 1991. Sorry I missed the thread. Can you confirm that the last charge was £28 not 26?

I managed to figure it out in the end!

My brain clicked into place - and all of a sudden I understood it.

 

Now i feel so clever - my prelim and schedule of charges went in the post last night.£4093 - without the 8% interest.

Embo, I'll be keeping up with your post (NatWest) as it seems we are both at roughly the same stage and i'm also going after a similar amount with NW. My LBA will go off next Friday, maybe before if I hear anything in the meantime ! We had the nice job of taking off all our Ad. Gold charges, but it wasn't too daunting, just took a while ! you have to send the LBA as a formality to satisfy the courts that you have engaged in reasonable communication with them.

 

they are sending pretty standard bog off letters to everyone, stick to the procedure and you'll get there in the end.

Since I sent my approach for reypayment letter i have aquired two more charges (almost £60) shall i add these to my schedule of charges and change the total on LBA letter ?

 

My thinking is that once i file a claim with the courts and give them a figure and schedule of charges, then obviousley i cannot change it if i get any more.

 

So i am thinking up until that stage i can change the figure and the schedule of charges.

 

Does that sound ok?

Yes thats fine also ring and tell them what you are doing and that any future charges will be claimed for at a later date. :grin:

I really could do with some help....

 

I am entering my particulars of claim - I am at this point:

 

5. Claimant claims: (a) return of the amounts debited of £4045; (b) Interest per S.69 County Courts Act 1984 of 8% - £928.25 continuing at 8% until judgment or settlement at a daily rate of £0.xx; 6. I cannot understand how to work this daily rate out!

 

Does any body explain to me how to do this?

Any help would be much appreciated.

i think i have worked it out, would some body mind checking my figures - i was never any good at Maths

 

amount of claim: £4045

8% interest £928.25

 

total - £4973.25

 

times: .00022

 

= £1.094115 (daily interest)

 

is that correct?

Hi

 

I am in the process of filing a money claim.

 

However the schedule of charges is different now to the two that i have sent to Natwest previously.

This is because i have had extra charges which i have added, and also because i took a couple off from the front (because i didnt want to go over £5000)

 

Do you think it would be ok for me to send another (amended) copy to Stuart Higley (who has been my contact)

Hi

 

My claim was served on Natwest on the 5th November....

And they acknowledged it about a week later.

 

The only thing i have had since then is a letter from the court saying that they intended to defend..

 

To my reckoning, on Sunday 3rd December their time is up but i havent received anything in the post since the letter from the court.

 

Should I have received something from Cobbets - with their defence etc?

I thought i would have to fill in th cpr18 (or not fill it in

 

If any one can shed any light on this i would be grateful - i am worried i have missed something?...

Cobbetts/Nat West seem to be one of the most awkward banks to break down at the moment and are certainly using up all their timescales permitted. You say that you filed your claim on the 5th Nov, well you should allow 5 days for this to be deemed served. They then get 14 days to acknowledge the claim. If they acknowledge, which in your case they have, they then get a further 14 days to file their defence. So basically they will get 33 days from the date you filed your claim. You should expect them to file their defence on or around 8th Dec, if they havn't done it by this date then I would advise you leave it a couple more days before filing judgement against them. Its not unusual to not receive any correspondence in this period, I felt the same thinking that maybe I'd been forgoten, its not the case though, they just seem to enjoy making us all wait!!

It was deemed served on the 5th - i filed it a few days before this..

 

As long as it is usual not to have heard from cobbets - i wont worry just yet.

Sorry dates wrong!! No nothing to worry about, like I said though they will get 33 days in total from the date you filed, so expect something around then!

 

In my claim they filed their defence right on day 33, typical Cobbetts.
