    • Write to DCBL asking them if the £70 charge is made by them or are Excel demanding the charge. Also ask  if the charge includes vat. If it does why are you expected to pay their vat? Explain that you will need to know these answers before you go to Court and they already know that you are not going to pay so you are looking forward to going to court. Give it a few days and write the same letter to Excel apart from reversing  DCBL and Excel's names at the beginning. IE write to Excel asking them if the £70 charge is made by them or DCBL. Then continue with what was asked in the first paragraph.

    • Hope we're in the correct place. Have, today, received a court order for a car loan debt taken out in 2015.  The car loan was issued solely to my (vulnerable) wife, based on her annual income (at the time) of around £9000. The loan repayments were set at around £240 pm (plus a last balloon payment of roughly £3500 - after 5 years). The loan total given to her, with interest, was £14,318. Irresponsible lending at its best? We had 3 young children at the time.  We tried keeping up with the payments but after the last payment we made (Feb 2018), we simply could not afford to pay. My wife got the odd letter/threat but nothing until a solicitors' letter arrived. She wrote back, making sure it was clear that she was not acknowledging the debt, but requested all the necessary paperwork. A few weeks later they sent her some (not all) of the paperwork, but the Terms and Conditions document was incorrect, it was different to the original. With that in mind, we just let it be.  They didn't write for two years, until they demanding payment again. Wife wrote back (again not acknowledging the debt) and told them the paperwork they sent 2 years previously was incomplete AND it had the wrong Ts & Cs. Nothing again for a year until a new person wrote- they were told the same and hadn't heard anything again until the court order arrived today. Will ignore the fact that the court order say Miss and not Mrs but just looking for a steer on how to respond. Does she simply quote the Limitations Act in her defence? Does she mention that they've never sent the requested docs to prove the debt, let alone sending the wrong Ts and Cs. She has 14 days to respond but like to get it done well before then. Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry I am not sure if I am posting this thread in the right category, but I am hoping for some advice or a steer in the right direction.


My 70 year old mother in law was recently taken into hospital with quite severe health complications. Whilst she has been in the hospital myself and her son have been sorting out paperwork etc and have discovered that 5 years ago she had Zenith double glazing (no longer trading) replace some windows and doors, to our astonishment we found the cost to be over £30,000.

 

They never put the orders through as one amount, instead putting them through as smaller loans, but still all adding up to over £30,000 which astronomical as it is a small 2 bed bungalow. I approached the subject with my mother in law and she got very upset saying that they kept pestering her.

 

Unfortunately my mother in law isn’t use to doing these things, as her husband dealt with everything, but I can only assume she didn’t want to bother us and she says she feels embarrassed and ashamed by how bad things are, as she said financially she is struggling she has even taken a couple of little cleaning jobs to be able to buy groceries. 


On further digging We found that Zenith had put all the loans through Barclays, who we feel did not do their due diligence, as my mother in law is paying over £650 a month for these windows and doors, we have found out that this is basically leaving her penniless every month and some essential bills are going unpaid because of it.


So my question really, is how or where do I start with trying to fight this, as surely it is not right that Barclays are taking £650 a month from a pensioner, leaving her nothing to live on. 

Please any advice would be appreciated
 
I am furious with Barclays as I feel they didn't do their due diligence, but also with my mother in law for not telling us!!

So your starting point would be to send BC a SAR and also a section 77 request CCA with regards the loan/s agreements.Gather all the information then you may be able to unravel this situation.

An SAR under the much publicised GDPR regulations, is probably the most powerful piece of legislation in the public realm.

 

It can effectively shine a light under the deepest information that any entity has on you and bring it out in the open.  A request puts Barclays under strict proof to give you every piece of information they have. That includes screen shots, phone conversations, emails, notes etc. 

 

I'd also be sending a note to Barclays explaining the situation, that your MIL is a pensioner and because they are taking £650 per month from her she is unable to buy food. Explain that she's in a high Covid 19 risk group and she's being forced to enter people's houses to clean in order to earn enough money to eat. And you request immediate suspension of payments.

I have found the templates and I am composing them now to be sent, but I will also contact them to let them know the situation they have put her in too.

Honestly I could kill her, as she kept it all a secret and we have only just found out

Don't be angry at her be angry at Zenith. Chances are if you ring Barclays also and explain the situation your MIL is in.  Please mention she cant buy food, please mention she is working putting herself at huge risk of C19! You may need your MIL to call in, and give you authorisation to speak about this.

Is your MiL still in hospital ?

 

She's not to blame for signing the sales forms, nor for being too embarassed to tell you about it. The person to blame, the salesman, is no longer part of this scenario so focus on getting the info you need from the bank.

 

You need your MiL to sign the SAR.

 

And you should also ask her to sign a Letter of Authority for you or  her son to act on her behalf because the bank will not communicate with you without your MiL's written consent.

Please keep us updated on this.

 

The FOS will first have an Adjudicator investigate and make a decision but this is commonly not a result the Complainant is happy with.

 

But you have the option to appeal and ask an Ombudsman to review and make a ruling.
