    • it's 85k of turnover (well, now £90k). However, you're digging yourself into another hole here. That ship has probably long since sailed. Is it worth pursuing this? You're not going to get anything back from it either way.
    • Hi,   A few pointers from yesterday to take note of evris cpr 27.9 failed again so we should really make issue of this also their WX fail to comply with CPR so again we should take issue with their statement of truth  you cant get tort if you get damages under subsection 7 of CRA because its double recovery  - not sure what we think of this? however its the first time i saw the judges make reference to your non automatic rights from s49 which s54 and 57 assist with. We should start stating this specifically for claims as I think its much better than just 49 and 57 as we need to make it clear where our non automatic rights come from as 54 automatic frankly dont help  I have sent the claim form and defences to the admin email because I can’t upload them for some reason as it wont let me but thought this may help as its the first time we’ve taken tort to trial. although i think the DDJ was honestly struggling to understand some parts of the law because he was asking me about them and how he should interpret them, especially for the automatic. Will apply for transcript if you want it?
    • I decided on confrontation - which I hate.  Omg the arrogance of the driver.  They refused to say who had given them the alleged permission to park on the private land - unless I proved ownership.  I couldn't believe they could be so objectionable.   They advised they couldn't take public transport to work as they lived too far away.  They couldn't rent a local garage as none were available. I simply said that's their issue not mine. It was infuriating that this person had such misplaced entitlement.  However I decided to humour them and show them the title deeds.   They couldn't respond.  Although at this point they alleged some guy in a city up north - whose name they couldn't remember - gave permission!!    They then asked if they could buy the garages and land!! Yet can't afford to park on a meter !! They seemed to back down and agree to now park elsewhere.  I hope so. 
    • I've worked out the contractor invoiced apx 250k - Without adding vat to the invoices.  So based on above he should have added vat to all invoices once he reached 85k?  Obviously he had to pay his labourers - would those payments get taken off what he received?  Or it doesn't matter cos he invoiced for the high sum?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received a PCN yesterday (10/03/20) for parking at Haven Banks Retail Park Exeter.

 

The alleged infringement (not sure what it should be called) was for parking there 0n the 22/02/20 to take my nephews tenpin bowling.

The PCN is dated the 06/03/20 but I only received the plain manilla envelope with no date stamp yesterday.

 

The PCN has two very dark pictures of a vehicle entering and exiting with my VRN but no picture of ticket or person driving

(I presume it is the vehicle that I am the registered keeper of).

 

I have been to the bowling alley today and taken pictures of all signs in the carpark (Management coy is Smart Parking which by reading a lot of the threads is well known to this forum site) and also been in to speak with one of the managers of the bowling alley in regards the matter and to see if I can get this notice cancelled, I was informed they have no input or control of the parking arrangements.

 

On the evening of the 22/03/20 we did park and I'm confident I did pay (0nly £1 for 2hrs + you can get refunded at the Bowling alley, my wife had gone ahead with the kids while I got the ticket), It is possible I may have not entered the exact VRN as it was raining hard and I did not have my glasses (quite poorly lit and hard to make out the key pad).

 

The time I entered was 19:55:58 and left at 20:33:16 just enough time to have one round with the nephews and get home,unfortunately I do not have the parking receipt.

 

Having spoke to Chris one of the bowling alley managers today (he did not want to give his surname)

he informed me the owners of the car park was Colliers International and they also owned the bowling alley + gave me their head office number.

 

He also found our reservation and payment for the 22/03/20 and gave me a copy of receipt as evidence we had been there but said they did not keep the parking refund slip you tear off for a re-imbursement.

 

I contacted Colliers Int and explained there must had been some mistake and could they get the charge cancelled (£90 or £54 if paid within 14 days of the date of the notice).

 

The lady I spoke to said she would pass on to one of their land managers,

took my name and mobile and said someone would be in touch

- I have had nothing so far and get the feeling I won't.

 

I'm not sure how to set up this issue on the Parking Charge Topic so apologies if I'm in the wrong place.

If so, contact the CEO pointing out that you were a genuine customer and demanding they cancel the charge.  

 

I'm sure the site team will pull Smart's daft invoice to pieces anyway, but belt & braces.

As you say a well known trouble spot.

Now  Smart, according to their dates have doen things on the last day possible but the reality is you received it 2 days late. that is easy to explain, the weekend made it impossible for them to complay with the POFA when using the postal system but that is hard cheese for them.

 

Now there has been a cahnge of the rules for BPA memebrs as errors in entering VRN's so they SHOULD lose any appeal. dont appeal yet but try any other sensible method first and come back here and tell us when you have exhausted them

also their NTK doesnt actually say what yu have done to breach the terms and conditions but rambles on about everything and nothing.

I think you are best suited trtying to sort this out with the bowling co if possible, the landowner wont care to help you as they have no impetus to do so.

Thanks for the reply and advice EB, as you pointed out I haven’t a clue what the charge is for but I also struggled with actually reading the tiny font (with glasses on) Smart have used on the PCN. I would of thought this in itself is underhand, the rest of the guff on the form informing you how to contact Smart is in large font!

 

On another note I also sent an email last night to DVLA to request the dates that they were approached for my Registered Keeper details as it was actually 17/18 days by the time the PCN was delivered.

DVLA replied this morning informing me they have forwarded it to the relevant office and for future reference there is a dedicated email for this process :

I am slightly concerned I may miss some deadlines as I am due out of the country 20/03/20 - 02/04/20 but back before the 28 day deadline threat.

Quick update and advice please.

Have just spoke to Colliers International and been put through to Ian (i presume one of their real estate managers.

He has asked me to send a copy of the PCN front and back + a copy of the receipt from tenpin bowling and he will look in to it for me.

 

When sending the PCN should i send the redacted copy I posted on here or send him the original with all my details?

 

would it be appropriate to post his email on this forum?

would only be limited to alley use.we don't want him receiving emails from everyone that's got a speculative invoice in that carpark because they haven't bothered to read here and self help first before doing things.
