Sent my first letter of and got my statements today (with my £10 cheque returned).

I am now sending my recorded letter of claim (sticky 2 letter) with the breakdown of charges + interest today.

 

Total claim £850 ish

 

Will update the thread when I know more.

Saturday 9th December is the response deadline date for the second letter.

 

If I don't hear anything then 3rd letter as per template bank goes out to them....

 

(typing this here so I can keep a clear record of dates etc)

oh-oh I think I made a mistake.

 

In my first letter after the data request letter I did include a schedule but I also did include interest at 8% !?!?!

 

Please can someone advise what I should do ? (I sent the letter a week ago) and just realised my error.

i did exactly the same thing - it was before i discovered how to use vampiress' spreadsheet. at the next letter, add a sentence saying, please find enclosed a revised schedule of charges. so, between now and then - you need to do a revised schedule of charges. have you included overdraft interest? try using the spreadsheet, if you use the advanced one - it has two tabs at the bottom - one for charges and interest and another for the 8% interest to be added at the court stage. if you haven't yet done the overdraft interest and think it might be hard to do - let me know and i'll post my really beginners guide to the spreadsheet only don't ask me any technical questions - it's just a how to fill it in - coz i have no idea how it's done.

so, chill over the error - just get it all tidied up for the next letter.

here it is:

ok, take it from the top. you have all your statements for the last six years, right. go through them and mark all the charges: Charges description on statements - Please Read this is the list of charges you can claim for. now, next to those charges there is often an debit for "interest". so, as you are marking all the charges, mark all the interest items as well. look at everything with a DR next to it, if it is on the list in the link, mark it, and all the interest with DR next to them.

then, go to:6. Interest calculation spreadsheets go on England, Advanced - Works (or excel) to get the spreadsheet. now, at the bottom, click on Charges & Interest. this will bring up a blue and yellow spreadsheet.

start with the oldest item marked on your statements and start entering them, the date listed on the statement, next column the charge - just call it exactly what the bank called it and next column put in the amount.

when you come to an interest one, move tab to the right hand side and put in the date, the interest, the balance at that point (here i will tell you that if the balance is in the minus numbers, a portion of the interest will go onto the spreadsheet - if you are not in negative balance - nothing of that interest will be added - so you will only see an amount come up if you have a negative balance at that point). as for the agreed o/d amt.

(i don't think this column was in there when i was doing mine - so try leaving it blank - if this messes it up - you will have to ask someone else what to do with it)

proceed through your statements from the oldest to the newest adding on all the charges and interest debits. you will see a total emerging, one on the left side and another on the right side. at the end those are the "you have taken £XXXXX(left side) plus £XXX(right side) which you have charged me in o/d interest.....total £XXXX.

That's about as clear as I can make it - i don't claim to understand it - it just worked for me. This is the information you will need for your prelim. letter and the spreadsheet is your schedule of charges.

 

more info but not for the prelim. and lba letter:

when you have the spreadsheet done that far, you can click on the 8% button at the bottom and reenter it all again with the date (put a date about 30 days from now - that way, it will be figuring your 8% interest that you can add at the mcol stage at about the same date as you will be filing) it figures the 8% for you based on how many days have elapsed since you incurred the charge. this gives you the 8% interest you will add when you file your mcol.

 

again, i really never understood what i was doing - just followed the step by step instructions at the top of the site and honestly - the spreadsheet was pretty simple - even for me and i'd never done anything like it before.

good luck with it - you'll soon be ready to send that prelim and you'll be on your way to getting it all back!

 

steve, in your case you'll be tidied up for the lba - that really is the last point you want to be changing things - although you could actually add any last minute charges just before you file. we'll deal with that later.

take a look at it again with the above in mind and see if you can't just crack it - i've had some good responses. and we are here if you have questions.

did the instructions i sent help you do the s/s? any way i can make it better? thanks.

 

take the time from now until you need to file to read up on the filing your court claim in the step by step instructions.

the mcol is very easy to follow - in fact, you could register now, work your way through it and get your particulars just so while waiting for the 14 days to pass. you can pop in and out of the claimsite and just don't press submit or pay until the time has elapsed. that way you are totally ready to file your claim as soon as it is time. also, this would become the time when you are claiming 8% interest - so get the s/s ready as you will need it to reflect that interest when you send it (a couple of days after you actually file the mcol) both to the courts and to bank's solicitors.

I have just emailed mine as I spotted a post with Debbie's email address in it. I think you will need to wait until the claim is acknowledged as technically you wouldn't know who to send it to until the information appears on the acknowledgement notice from the courts :)

Letter received today from Colin Langdale - hasn't completed his investigations yet....will get back to me by 23rd January.

 

Standard letter and will ignore and continue with action.

(interestingly took over 1 month to respond at all)
