    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.
    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OMG that is so shocking! Mine was via the phone which was bad enough! My account finishes just after xmas and that will be the end of us. They have no scruples. Honestly when it happend to me I thought it was an isolated case, then I fell on this forum and thought no way! My husband if he knew would be mad that they have duped so may people.

to cut a long story short i bought a re-conditioned cooker from bh i paid my weeks money and 25 pound delivery.they arrived on mon with it no manual etc they didnt even know how to connect it.i arrived home on mon night to find the oven didnt work.i phoned on tue and they said it was the timer as i was at work again i had to wait till i got home in the evening to try again.on the wed i told them it still wasnt working the said they would get an engineer out to look at it.thur i called again and they gave me the number for the engineer he said he would get back to me within 48hrs with a time to come out.fri he told me it would take 5 days for the part????what part???i went to the shop on sat and told them to come and take it away(forgot to say they uplifted my old cooker when they put in the other one)they brought me out another one on monday (not the same make of course)i also still had to pay another payment on the sat for a cooker that didnt work i also had to through out the food i had as i didnt have a cooker to cook on.i dont know what the cost of the other cooker is as i didnt want a new cooker if i wanted one i would of bought one so i still havnt been told how much my payments for this cooker is going to be as no one has told me?as i asked if i was getting the same deal and the girl in the shop said i couldnt as it was a new cooker but when i checked last night the cooker had a refurbished sticker on the back???

ask them if they can re write your account coz they can ! The store has to achieve a target each Saturday on there collections and its done in percentage { ie if they need £200 pounds to reach a target ) if you owe 180 they can re write your account and clear your debt thus clearing 180 off there debt ! they are under great pressure to achieve these goals so tell them you can pay one weeks payment only .You wont get any money back for what youve paid already if you return the stuff .

sorry to hijack this thread, firstly hi :-)

Next week ill be half one though my sentence, sorry contract and am i right in thinking i can end my contract with them without any penaltys?

Me and my partner now have better credit ratings and can shop at comet currys etc.

Would i have to arrange to take my LCD tv back to the shop or would somebody come and pick it up?

Hi all,

 

I'm new to this forum but would like to say thank you to you all for stopping me in making by the looks of it, a very very bad decision.

 

Let me explain why, due to circumstances beyond my control (i was made redundant in july) work and money has been pretty slim on the ground. And as with everything something always breaks when you dont have the money to fix or replace. I.E our tumble dryer packed up on us and as we dont have a very good credit rating we have been looking elswhere to get money or credit for a new dryer.

 

My wife spotted on the TV a commercial about BH and it sounded ideal. Just what we wanted. We could get a new dryer with no credit checks. Brilliant. However because of the particular search engine i used for BH it threw up a thread from this forum.

 

Being of the inquisitive mind I looked into it and was horrified at what i've read. Hence the reason for this post and a BIG thankyou to you all for stopping me from making what looked like a very big mistake.

Have you tried your local Freecycle list, somebody there might havve a tumble dryer. I got my bed, desk and bedside table from Freecycle... and got rid of various unwanted items through them.

 

At least we have saved you from the horrors of Brighthouse... well done for finding us first.

Hopefully more people will come across this forum and take note. I know that not all people have problems with BH but I`m not gonna take the risk. Got too much hassle in my life as it is without the extra hassle lol.

I think what Former is trying to say is that contrary to popular belief in these forums there are no guns held to peoples heads when they sign for the optional service cover.

 

If you are big enough to sign for it, you are big enough to pay for it. Any questions can be answered simply by picking up the phone or in person at the store. If you are desperately unhappy cancel within 7 days and get your money back.

 

Where is the line of responsibility? The store can only be held accountable so far along the way - at some point the customer made a decision - can the store be held accountable for peoples free will? simple answer - no.

I don't plan on getting into any kind of public disagreement with you. You are absolutely entitled to your views and opinions, as is anyone else on this forum. Your posts are well thought out, and you come across as being very pleasant. :)

Personally, I think you are (very foolishly) just spinning the company line, and unless you genuinely and honestly believe in what you are saying, your views may simply come across as "BrightHouse damage" control to other posters.

I am not spinning any line, this is my oppinion, believe me if my direct colleagues acted the way suggested on many posts here I would have something to say about it! I treat my customers with respect and do my best for them, without blowing my own trumpet customers comment to my manager about my cust service all the time!! (which is nice )

There are clear cases for concern amongst these posts and I have sat here dumbstruck with some cases, which clearly need attention. However not all stores are the same.

What I am saying in my previous post here is not from my work background just common sense!

My 1st post today...and wow am I greatful I found your thread!!

 

I would just like to say a "BIG" thank you to all, well especially the helpful comments in NOT taking out any so-called credit with Brighthouse!!

I unfortunaltey got myself into debt a couple of years ago due to a family illness, and am currently 2/3rds through paying it off through an IVA. So as some are aware cannot get credit for anything really!

 

Moved house 2 weeks ago, and as usual something had to break, and it was my fridge/freezer. Borrowing a little bar fridge off a friend..but way to small. Saw the ad on telly the other night and thought......wow bargain, just what I need??

 

You know what, thanks to you guys..." JUST HAVE TO GO SHOPPING FOR FOOD EVERY 2nd DAY" Hahahhaa.

 

I will certainly not be using Brighthouse.

Ive been a brighthouse customer for four years and have paid off 2 hp agreements and only ever had one late payment.Now im left with one lcd tv and a laptop,two weeks ago my partner and i was made redundant without any notice and have to claim monies owed off the state.Rang brighthouse to explain the problem but was shocked at the way they spoke to me ,been very friendly before.I was told you cant pay so send them back or they will fetch them,i told them that i wouldnt send them back as i only owe 200+ on the £1400 tv and payed half off the laptop.Everyday since then they fone 5 or 6 times aday none stop telling me they want the goods back and THAT IM ££££S IN AREARS .I wrote to head office reguarding my situation and offered a reduced payment + could they refund the monies ive paid for insurance (damage) because i have contents insurance .but all head office did was fax the letter to the store now the fone calls start again .

 

Been in contact with bh today well they have been phoning all morning,was told take my goods in today they would halt my account till i find another job.YES HALT IT TILL I HAVE THE MONEY TO FINISH PAYING THEM.Asked if i would get the same tv+laptop back ,wouldnt coment,asked if i could have it in writting answer was NO.

Had a reply to the letter i send H/office today regarding all the harisment /service they will look into it but no reply to the reduced payment i offerd .Do i send it back with out getting this in writting ive paid £280 off a £670 laptop ANY ADVICE NEEDED QUICKLEY

Y'know, it's hard to keep track when you switch posts! Would have been better (and had more continuity) if you had kept you questions all together. ;)

As I have advised previously, if you feel you should return some items then do so. Only YOU know what your essential items are.

BrightHouse absolutely CANNOT forcibly enter home and repossess their goods without a court order.

You are COMPLETELY wasting your time trying to negotiate with a local store manager. Direct all your communications IN WRITING to head office.

They only want you to return them because they would need a court order to get them back has you have paid almost half

dont send anything back tell the store you will only deal with head office also state you are not affriad to go to court on the matter has you have offered a reduced payment and with todays crunch a judge would be sympathetic

also state under the communacations act you would like all calls to stop as its harrasment and you will inform the relavent partys only deal in writing
