I have a few questions regarding the unfair bank charges....bit of a complicated one.... I had a NatWest account for several years which was closed approx 3 years ago, the account was defaulted however the balance shows as satisfied on my experian report.

 

The address that NatWest has me living at is no longer my current address, so is there another letter I can send to get a list of charges?

 

When I originally opened the account it was just in my name, but then when I got married I changed it to a joint account, I have been separated from my husband for 2 years and we are financially dissasociated, how will this affect my claim?

 

I have recently changed my name by deed poll, so now shows as different to what was on the account....how will this affect proceedings?

 

Told you it was complicated!!!!! Please help!!!

Well, with the satisfied default, I guess. Who satisfied it? Was it you or your ex?

 

The fact that it was a joint account could be a bit complicated, unless someone says otherwise. I would think that both parties would have to pursue the action. Just as you have joint and several liability, you have joint rights to any money coming back. If it was you alone who satisfied the default, then you MAY (I repeat, may) be able to pursue on your own. Likewise, your ex.

 

Possibility: if, while your account was in your own name only you were being charged, then you may be able to claim those back in your own right.

 

As to the address: you'll just have to quote the account number and supply your new address. Change of name: you'll have to produce them a copy of the Deed, I would expect, with maybe other forms of ID. They may actually tell you what they require, if you ask!

 

If you have any statements from the period when it was your account, have a look at them first. Unlikely, I know, but it may just be worth checking that it's worth opening up the old wounds again.

 

If I'm wrong, I hope someone will pop up and say so, quick!!

If the account was in joint names, and either of you could sign for withdrawals or cheques then you will be able to pursue the bank on the charges from the joint account.

The change of name isn't a problem - it's still you but as has been said before, you may need to produce the original (or a certified copy of) the deed. Your solicitor should have provided you with a couple of certified copies at the time the deed was signed for situations such as this.

 

With regards to claiming charges on the joint account, I can't see any reason why you shouldn't carry on. You are entitled to recover the charges as a party to the account. Anything that you do recover would be a matter between you and you ex if you choose to share with him. It doesn't affect the claim.

Hello,

 

I have already been successful with a claim of unfair bank charges with Halifax - they paid up after the first letter!! However I have started a new claim with NatWest I have sent all the relevant letters and I have issued a court claim, they acknowledged the claim which has bought them 28 days, which would have been up today, however just been online to moneyclaim and I can't apply for a judgement as they submitted a defence yesterday!!!! Can anyone out there who has got to this stage give me a little reassurance that I may not need to go to court??? Also the courts are sending me an Allocation Questionnaire, I have been told this will cost a further £100, will I get this back too? :???: Helen.

dont worry this is normal, if you pay the £100 you will get it back, but the way my claim went you will probably get an offer before you have to file it

Ok firstly this is standard and nothing to worry about. You need to have a read of the step by step instructions and the FAQs. These will guide you through the rest of the process.

 

Allocation fees.

Allocation to track:

claims for money of £1,500 or lessno feeall other claims£100

 

The fee is added to the claim.

There may well be an offer , but at the AQ stage it is unlikely to be for the full amount.

Hi

 

I have just received the defence submitted by Cobbetts, why they can't write in plain English is beyond me, I think they think by using big words they can intimidate!! Not this bunny! Although I am confused! They have asked for clarification and further information, by April 6th I'm not sure what it is they want. Do I just wait for the AQ from courts???

Have been reading through previous threads and stickies theres so many to read, so can someone help me please....

Have recieved a Defence and request for further information from Cobblers, do I send the letter drafted by Martin 3030 in sticky dated oct 06 or is there a new letter/information to send?

Want to get this right....!

hi

 

you need to read it thoroughly and amend any info that isnt relavant to your claim, then pop it in the post to cobbetts and to the court (keep a copy 4 yourself) remember to send it recorded delivery

Ah Thanx Guys for taking the time to reply and helping...... Have already made a donation from previous Halifax claim and will be doing the same again once I get this money through...... I hope everyone else who is succesful donates too, because without this site a lot of us would be out of pocket!!!! Any ideas now as to how long I will be waiting... had my AQ through this morning? :)

I would say that your settlement should be about a week or so after the AQ deadline.

Oh sorry this may sound a bit thick but i'm filling out my AQ and it asks do I want permission to use an expert's report at hearing? I'm assuming I say no to this....would that be right? And would I need to put in any other info in that section?? :p Hels
