I received a letter today saying that I have been overpaid by £2400 for 2015

as I had been claiming for child DLA element when I did not receive it.

 

The DLA had stopped and I did write to tell them but heard nothing back

- they kept paying the amount so I thought maybe they were paying it from previous years

and wouldn't be paying it unless I was entitled.

 

The letter states that they have stopped my tax credits and that they will decide and notify me on what will happen next

- either penalty or criminal conviction.

I'm worried sick

- any advice on what I do next?

too scared to call them!!

hi,

we got one as well,

they seem to have made a lot of mistakes as heard others saying they have had letters,

I have offered to pay in instalments at so much a month, mine is for nearly £1,500

 

You could ask for a SAR ,

I am no expert but hopefully someone will come along and help who has better knowledge

- it was the paragraph on criminal proceedings that spooked me,

it would be their word against mine

- was that section in your letter?

 

 

I cannot offer repayment just yet as they have not sent me a bill as they are working out my 2016-17 tax credit award

- I was wondering if I should act first by sending them a letter stating that a letter was sent

or should I hold off until their decision letter arrives and that way I know what I'm dealing with.

Is the letter from hmrc?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

You need to send a SAR to see if HMRC have the letter logged.

 

Send the request to:

 

TCO SAR Team

Group 7

Area F

Floor 1 St Marks House

St Marys Street

Preston

Lancashire

PR1 4AT

 

If they do it is unlikely you need to pay the money back.

 

Did you send the letter recorded?

 

When they respond you need to file a dispute and or appeal.

 

In this case its likely a dispute. You will have 3 months to file this from the 18th August.

 

If you are worried about legal action against you. Write to HMRC saying that you are raising a dispute for the Tax Credits. State that you are awaiting a response from the SAR team and ask for all action to be put on hold for 14 days after you receive the response.
